Delhi HC hears Leena Maria Paul's bail plea in money laundering case

New Delhi [India], May 19 (ANI): The Delhi High Court heard arguments on behalf of Sukesh Chandrasekhar's wife Leena Maria Paul in a money laundering case on Monday.
She has sought bail on the grounds of the period of custody, parity, and provisions of the Prevention of Money Laundering Act (PMLA) related to women accused.
The actor has been in custody for the last three years and seven months.
A single bench of justice Shalinder Kaur is dealing with Leena Maria Paul's bail application, which was filed last year. The court has listed the matter for hearing the prosecution's arguments on July 2.
Advocate Anant Malik, along with John Paul Edison, appeared for the petitioner, Leena. He argued that despite being in custody for around three years and seven months, charges have not been framed against her yet. At the same time, other co-accused were granted bail by the High Court and the trial court.
He further argued that the accused Jacqueline Fernandez was not arrested during the investigation. She was granted bail on the appearance on the summons issued to her
It was also argued that the twin condition under Section 45 of PMLA also has a provision related to the woman accused.
It was submitted that on December 14, 2021, a complaint was filed against the petitioner and others, 178 witnesses. The matter is still at the stage of arguements on charges on behalf of the accused persons.
Accused Pradeep Ramdani, Avtar Singh Kochar, Pinki Irani,and Jacqueline Fernandez are on bail, advocate Malik argued.
Petitioner's role is similar to that of Fernandez, he added.
Her last bail application was rejected on May 19, 2023 at which time arguments on the charge was still going on. Still arguments on charges are going on behalf of the accused and nothing had changed.
He further submitted that Avtar Singh Kochar was granted bail on grounds of delay. While granting the bail, the Supreme Court's judgment in the Manish Sisodia case was also mentioned.
A woman is entitled to special treatment while considering the bail of a woman under PMLA, the counsel said.
The Enforcement Directorate (ED) has opposed the bail plea by submitting that section 45 (2) is not applicable to a woman accused. The Supreme Court has already decided what is to be considered, the ED said.
The twin conditions of Section 45 are in addition to the provision of 439 CrPC. Besides, the conduct of the accused is also to be looked into while considering the bail plea. (ANI)

The Asset Disposal Committee (ADC) presided by Justice (retired) Dilip Kr. Seth and comprising Enforcement Directorate (ED) officials has, in the eighth round, disbursed ₹10.5 crore to 11,883 more victims of the Rose Valley Ponzi scheme. The total amount disbursed so far now stands at over ₹55.45 crore to 72,760 victims. 'In the committee presided over by ADC Chairperson Justice (retired) Dilip Kr. Seth, ED (Kolkata) has played a crucial role in facilitating the attachment, possession, and disbursement of assets of the Rose Valley Group, thereby smoothening and expediting the restitution of properties to the thousands of victims in West Bengal, Odisha, Assam, etc.,' an agency official said. The agency is actively assisting the ADC in conducting survey and valuation of the confirmed attached properties and in facilitating expeditious monetisation of assets for disbursal to the investors/victims. 'Further restitution process is expected to continue over the coming months as more claims are scrutinised and validated by the ADC. As on date, the ADC has processed 72,760 claims resulting into funds disbursal of about ₹55.45 crore,' the agency said. The ED has attached movable properties worth ₹494 crore and immovable assets valued at ₹1,069 crore, spread across West Bengal, Odisha, Assam, and Tripura, with properties in West Bengal alone accounting for ₹1,184 crore.

A Punjab Police head constable, posted as the personal security officer (PSO) to the sub-divisional judicial magistrate (SDJM) in Dera Bassi, allegedly died by suicide after shooting himself with his service revolver late Wednesday evening. His bullet-ridden and blood-stained body was found inside a locked Honda Amaze car, which belonged to the SDJM, police said. Confirming the incident, Dera Bassi deputy superintendent of Police (DSP) Bikramjit Singh Brar said that the police were alerted after the judge informed them that his PSO had gone to drop his daughter off but failed to return and his phone had been switched off. "Following the call, the SHO of Dera Bassi police station launched a search. Later, a constable from Chandigarh Police who lives near the area noticed the vehicle with the officer's body inside and informed the local police," said DSP Brar. Upon reaching the scene, police found the car engine running and the vehicle locked from inside. 'We had to break the window to open the door. The head constable had shot himself in the middle of his forehead. His service revolver was recovered from inside the vehicle,' the DSP added. No suicide note was found from the spot. The motive behind the alleged suicide remains unknown. DSP Brar said that preliminary inquiry revealed that Harjeet Singh was a well-mannered and soft-spoken individual. 'He had worked as a PSO to several judges in the past and had never shown signs of stress or depression,' he said. The deceased's mobile phone has been seized for forensic examination, and his family has been informed. The police have initiated inquest proceedings under Section 174 of the CrPC, and further investigations are underway.

Mumbai: The state govt has ordered an ATS probe into the Jamia Islamia Ishatul Ulum educational institution in Nandurbar district on charges of allegedly employing two Yemeni nationals whose Indian visa expired in 2016. It has also lodged cases against the founder and chairman of the institution for allegedly procuring fake documents for them. In addition, minister of state for housing Yogesh Kadam said the ED would probe how the institution received foreign funds to the tune of Rs 728.6 crore. The state has also ordered a probe by a forensic auditor and legal advisor. When asked about the licence of the institution, Kadam said, "The charity commissioner is conducting a probe. If irregularities are found, then its licence will be suspended." After allegations were raised that it purchased land belonging to tribals, Kadam said that the land purchase by the institution will also be investigated. BJP MLA Gopichand Padalkar asked if the state will inquire into whether combing operations will be conducted on all madrasas to see if they are harbouring illegal immigrants.
