Incitement of violence online: How law deals with this while shielding free speech
While freedom of speech is a right, incitement of violence is a punishable offence, the South African Human Rights Commission (SAHRC) and legal expert Emma Sadleir have cautioned.
The warning follows threats on social media against foreign nationals ahead of Youth Day.
The SAHRC said it had alerted the national police commissioner's office about the threats and would monitor the culprits. It reserved the right to pursue charges under the Cybercrimes Act.
'While the commission does not dismiss genuine grievances about crime or service delivery, we remind the public that freedom of expression does not extend to speech that incites hatred or violence,' it said.
The commission encouraged people to report any alleged criminal or unlawful activity to police and other competent authorities rather than taking the law into their own hands, and to consult the SAHRC Social Media Charter for guidance on responsible online conduct.
It said it was encouraged by the Hawks confirming they would urgently look into this matter.

Drugs worth R10m seized in KZN, two suspects arrested
Two alleged high profile drug dealers, one of them a Congolese man, are expected to appear in the Durban magistrate's court on Friday after two separate sting operations netted drugs worth more than R10m on Thursday night. Police spokesperson Col Robert Netshiunda said police recovered drugs worth an estimated street value of R10m and arrested a 37-year-old man during an intelligence-led operation in Quarry Heights. He said members of the provincial drugs and firearms unit operationalised information about a man selling drugs and the suspect was found in possession of drugs. Further investigations led police to a residence on Caters Street where more heroin, crystal meth and cocaine was seized. 'The suspect was also found with an illegal firearm and 47 rounds of ammunition,' said Netshiunda. TimesLIVE has been told by several sources close to the investigation that the suspect was distributing large quantities of drugs and was using a residential storage facility to conceal them. The suspect has two addresses linked to him. In a separate incident, Hawks members from Port Shepstone's serious and organised crime investigation unit, together with the Durban metro, K9 unit, flying squad and infrastructure task team arrested a 43-year-old suspect for dealing in drugs. Hawks spokesperson Lt-Col Simphiwe Mhlongo said police received information about a laboratory cultivating cannabis plants near Morningside, Durban. 'A disruptive operation was conducted and they proceeded to the building. During the search police found indoor cannabis plants, ecstasy tablets, crack cocaine, chemicals and equipment to the street value of about R350,000,' said Mhlongo. The suspect was arrested and will appear at the Durban magistrate's court on Friday.

Police officer accused of corruption set to appear in court
An internal investigation flagged the officer of being involved in corrupt activities. A 46-year-old Eastern Cape police officer who allegedly demanded a bribe in order to make 'things easy' for a suspect is expected to make his first appearance in court. The Directorate for Priority Crime Investigation (DPCI), also known as the Hawks, served a court summons on the officer on Thursday, charging him with corruption. Corruption Hawks spokesperson Lieutenant Colonel Avele Fumba said the alleged corruption occurred when he was stationed at the Humewood Saps. Fumba said an internal investigation identified the officer as being involved in the incident. 'It is alleged that on 2 April 2024, the officer, acting in his capacity as an investigating officer, summoned a male suspect to the station regarding a reported assault case. The suspect was thereafter allegedly released without any formal charge being laid,' Fumba said. Court Fumba said Ngeni's actions constitute a violation of Section 4(1)(a) of the Prevention and Combating of Corrupt Activities Act 12 of 2004 (PRECCA), which criminalises the acceptance of gratification by a public officer in exchange for performing or not performing an official act. He is expected to make his first court appearance at the Gqeberha District Court, New Law Courts, on 17 July 2025. The Provincial Head of the Hawks, Major General Mboiki Obed Ngwenya, reaffirmed the team's commitment to upholding the rule of law and eliminating unethical conduct within their ranks. The suspect was arrested on Thursday during a joint operation between members of the Hawks' Port Shepstone Serious Organised Crime Investigation unit, the Durban Metro Police Drug Team, the Metro K9 Unit, Durban Flying Squad, and the eThekwini Infrastructure Task Team.
