TOKYO: A trial challenging Japan's lengthy and gruelling detention of criminal suspects opened in Tokyo Wednesday, with plaintiffs decrying "subhuman" treatment they say ignores the presumption of innocence.
Campaigners argue that lengthy pre-trial detention is meted out too easily in Japan, especially if suspects remain silent or refuse to confess.
The lawsuit is challenging the constitutionality of the system of "hostage justice" in which confessions become a de-facto condition for their release.
The term was globally popularised by ex-Nissan chief Carlos Ghosn's 2018 arrest and months-long detention, with international rights groups having also repeatedly criticised it in the past.
The new lawsuit challenges Japanese judges' ability to "rubber-stamp" detentions, and to reject bail without demonstrating "probable cause" that evidence will be destroyed, according to lead lawyer Takashi Takano.
Detained 24/7, those who maintain their innocence are often "deprived of their freedom, assets and lives ahead" even before trial starts or guilty verdicts are issued, Takano told a gathering after the first hearing Wednesday.

Pre-indictment detention can last up to 23 days, extendable by multiple rearrests.
Only after indictment does bail become possible, but the option is often dismissed if the accused denies the charges, campaigners say.
One of the plaintiffs is Tomoya Asanuma, who last year was held in police custody for nearly four months over charges he was ultimately acquitted of.
"It was like I was in a zoo cage, being fed food through a small window", Asanuma said after the hearing, recalling life "with no privacy".
"They treated me like I was subhuman."
There are "many of those who succumbed (to detention) and falsely confessed in favour of immediate release, with their names forever soiled as former criminals," Takano said.
This, critics say, partly helps explain why Japan has long maintained astonishingly high conviction rates of more than 99 percent.
Proponents, meanwhile, attribute the nearly perfect conviction rates to "precision justice", where prosecutors only pursue airtight cases they are confident about winning.
The justice ministry declined to comment on Takano's lawsuit when contacted by AFP ahead of the opening of the trial.
It however said the confinement of suspects and defendants, as well as the denial of bail, were ordered "based on the law and evidence, and in a fair manner".

Over 15 days, verification of 9,586 tenants and 8,911 servants was completed by the 16 police stations of the city. This initiative was undertaken on the directions of SSP Kanwardeep Kaur in response to increasing security threats and the need for heightened vigilance ahead of the Independence Day celebrations in the city. A campaign was launched to recognise outstanding performance, with 27 policemen from six police beats being awarded a 'Class-1 certificate' and a cash prize for their excellent work. All the information recorded during this campaign has been uploaded to the e-Beatbook app. Recently, the administrator also instructed the police regarding the importance of tenant verification. Indore: Crime branch of Indore police on Friday arrested a 61-year-old man, who was absconding for three years in a major case involving fake loan passbooks used to secure bail from courts. Additional DCP Rajesh Dandotiya said that the accused, Ramesh Kalota, a resident of Barodi Hatod was part of a gang that created forged loan documents to fraudulently secure bail for individuals involved in serious crimes. With this arrest, the total number of accused held in the case has reached 37. During the arrest, the police recovered three fake loan passbooks and a notarised stamp related to a lost passbook from Ramesh's possession. Preliminary investigations revealed that the accused was operating this racket for nearly a decade, either providing fake sureties or posing as a surety himself to facilitate bail for several accused in criminal cases. Earlier, in a related development, another accused Kedar Dabi, who was already arrested in the same case was found to have used a fake loan passbook again to secure bail for Saloni Arora, an accused in the journalist Kalpesh Yagnik suicide case. Both were subsequently booked separately and arrested by the crime branch. A specially formed SIT team led by ACP Devendra Singh Dhurve was tracing absconding accused and curbing such fraudulent operations in the city. T'puram: Bringing partial relief to the protesting ASHAs in Kerala, the Centre increased their fixed monthly incentive from Rs 2,000 to Rs 3,500. The revised incentive was approved at the mission steering group meeting held on March 4, and was formally communicated in the Lok Sabha by minister of state for health and family welfare Prataprao Jadhav, in response to a question raised by Kollam MP N K Premachandran. According to a statement from the MP's office, the minister also announced that the retirement benefit for ASHAs with a minimum of 10 years of service was raised from Rs 20,000 to Rs 50,000. The eligibility norms for receiving incentives were restructured, and additional project-based performance incentives will continue. The Centre clarified that while it extends technical and financial support, the primary responsibility to improve the service conditions and remuneration of ASHAs lies with the state govts. The minister's reply was part of a broader response to questions concerning the ongoing protest by ASHAs in Kerala, who have been camping in front of Secretariat demanding a hike in the state share of their honorarium and a retirement benefit of Rs 5 lakh. So far, the state govt has not responded positively to their demands. According to the statement, despite these central provisions, disparities in state-level incentives remain wide. The lowest honorariums are reported from Andaman and Nicobar Islands and some areas in Delhi, where workers receive as little as Rs 500. Premachandran urged the state govt to act urgently and match the Centre's efforts. He said that while the Centre stepped up its role, it was ultimately the state's responsibility to ensure fair wages, service benefits, and dignity for frontline health workers who form the backbone of the rural public health system.
