Is racial profiling undermining South African healthcare? A call for accountability and reform

Apologies are necessary, but are not enough; material redress and structural consequences should be the next steps against medical schemes that racially profile black healthcare professionals.
Healthcare workers union, Health & Other Services Personnel Trade Union of South Africa (Hospersa), expressed deep concern and condemnation following the announcement of the findings of the Section 59 Investigation Report in which three medical schemes, namely Government Employees Medical Scheme (Gems), Medscheme, and Discovery Health, applied discriminatory risk ratios to black health professionals.
The discrimination affected black healthcare professionals in disciplines such as physiotherapy, psychology, and social work, who are said to be 'more likely' to be guilty of fraud, waste, and abuse (FWA).
The panel reviewed statistical and testimonial evidence, and found that black providers were disproportionately flagged, audited, or penalised through opaque FWA systems.

The investigation was launched in 2019 after several healthcare providers made allegations that they were being unfairly treated by medical aid schemes based on race and ethnicity.
The affected section relates to the payment of claims by black medical professionals.
Hospersa spokesperson, Lindelwa Mdlalose, stated that the report confirmed the suspicions and personal experiences of many black healthcare professionals.
The union called for remuneration and class action litigation against the medical schemes found to have applied such racial profiling, resulting in financial and reputational harm to individuals.
Hospersa stated that the medical schemes should be held accountable and issue formal public apologies.
It also sought a restitution framework, overseen by the Council for Medical Schemes (CMS), designed to review and remedy individual cases fairly, efficiently, and with a sense of urgency.
'As a union steadfastly committed to justice, equality, and transformation, Hospersa cannot allow this moment to pass without demanding full accountability, restitution, and long-overdue structural reform.
'To ensure that this injustice is never repeated, Hospersa calls for systemic changes across the private healthcare sector. All race-based profiling algorithms must be immediately discontinued and outlawed. Oversight mechanisms must be strengthened to enforce transparency and accountability in audit practices. Affected schemes must implement anti-bias training and submit to regular, independent audits of their fraud detection and disciplinary systems,' said Mdlalose.
The union said the issuance of the findings and recommendations of the Section 59 report 'must serve as a turning point'.
'The Section 59 Report is more than an indictment of past practices, it is a call to action. Racial profiling in the healthcare sector is a betrayal of both ethical norms and constitutional values. It undermines professional dignity and perpetuates racial injustice under the excuse of fraud detection.'
Meanwhile, Discovery Health strongly disagreed with the findings and called on CMS to carefully review the panel's conclusions to prevent harm to medical scheme members and the long-term viability of medical schemes.
Discovery Health CEO, Dr Ron Whelan, said the conclusions from the investigation are 'based on flawed methodology, unscientific assumptions, and misinterpretation of complex data'.
Dr Whelan said they are currently reviewing the report in full and considering their options, including a formal review of the findings, which drew numerous conclusions that, according to Dr Whelan, is not supported by credible evidence.
Discovery Health said: 'No evidence has been presented to support the allegations that (we have) investigated or sanctioned any healthcare professional in a biased or unjustified manner. In fact, the panel's own interim report in 2021 confirmed that the processes used by medical schemes were legally sound and showed no explicit evidence of racial bias.
'Furthermore, all complaints submitted to the Section 59 Panel by healthcare providers against schemes administered by Discovery Health were shown to have legitimate grounds for investigation, with no evidence of racial profiling.'
Gems said over the past three years, since the release of the Interim Section 59 Panel Investigations, they have 'taken comprehensive steps to strengthen its FWA management framework to eliminate any potential for disparate outcomes'.
According to the medical scheme, after the interim report made several recommendations, they have already begun to implement policies which 'largely reflect reforms'.
Gems principal officer, Dr Stanley Moloabi, said: 'It is reassuring that the panel has found no evidence that GEMS acted with racist intent. This distinction is critical - structural outcomes must not be confused with deliberate discrimination.
'(We) will continue to work closely with the CMS, healthcare providers, and members to ensure that our FWA systems are transparent, fair, and compliant to all laws and regulations of the Republic of South Africa.'
Enquiries to Medscheme had not been answered by deadline.
During a portfolio committee meeting held on Friday, Health Minister Aaron Motsoaledi pointed out the 'silence' in the National Health Act regarding remuneration or corrective measures to be taken in cases where discrimination against health professionals is identified.
He also called for algorithm and software transparency in which the department is able to be privy to information regarding risk ratios against black health professionals.

Loneliness and isolation – the hidden threat to health we cannot ignore

Social disconnection — when a person lacks sufficient social contact, feels unsupported in their existing relationships or experiences negative or strained connections — is an increasingly serious but often overlooked danger to health and well-being. There are several forms of social disconnection, including loneliness and social isolation. Today, about one in six people globally report feeling lonely. Among adolescents and young adults, as well as people living in low-income countries, the rate is higher. But loneliness and social isolation are not just emotional states — they can be lethal. From 2014 to 2019, loneliness was associated with more than 871,000 deaths annually — equivalent to 100 deaths an hour. We now have irrefutable evidence that social health — our ability to form and maintain meaningful human connections — is just as essential to our well-being as physical and mental health. Yet for too long, it has been ignored by health systems and policymakers alike. The Humans are hardwired for connection. From our earliest years, relationships shape our brains, our emotions and our chances of living a healthy life. Conversely, disconnection, whether through loneliness or social isolation, can have devastating effects. It increases the risk of heart disease, stroke, depression, anxiety, dementia and premature death. It can also result in poor school and work performance, and costs economies and societies billions a year. But the good news is that solutions exist. The commission's report outlines interventions that work — from national policies and community programmes to campaigns and individual support strategies. It highlights a range of successful examples: peer-to-peer support for low-income older people in South Africa; 'social prescribing' of activities to older adults in the Republic of Korea such as music storytelling, gardening and self-help groups; integrating social connection into broader development policy in Djibouti; embedding it as part of ageing policies in Albania and in mental health policy in Spain; establishing dedicated national strategies in countries such as Denmark, Germany, Japan, Finland, the Netherlands and Sweden; and campaigns to encourage small acts of kindness in Australia, Great Britain and the United States. We call on all countries to prioritise social connection. This is not only about personal health and well-being. It is also a cornerstone of economic prosperity, national resilience and social cohesion. Societies that foster trust and connection are more innovative, more secure and better able to respond to crises. The Covid-19 pandemic brought this truth into stark relief. As lockdowns forced physical separation, the human need for connection became unmistakable — and so did the costs of its absence. The WHO Commission proposes a global roadmap built around five key pillars: policy, research, interventions, measurement and engagement. The key actions it calls for are to develop national policies that integrate social connection into health, education and labour agendas; invest in research to better understand what works; scale up culturally relevant and cost-effective interventions; collect better data to track the problem and measure progress; and build a global movement to change attitudes and reduce stigma. It is critical that this movement include the voices of those who have endured the pain of loneliness and social isolation because they understand what real solutions look like. As leaders, we cannot afford to remain passive. Every day we delay is another day of lost potential, unnecessary suffering and preventable death. But if we act boldly, collaboratively and compassionately, and on a large scale, we can build healthier, more connected and more resilient societies. Social health is not a luxury. It is a human need. ‘Broader investigation overdue' – ActionSA lodges criminal complaint against medical aids
The party said a criminal investigation would go a long way in exposing the 'deep-seated rot' within the health sector ActionSA MP and member of the Health Portfolio Committee Dr Kgosi Letlape has lodged a criminal complaints against medical aid schemes. This follows a report, commissioned by Minister of Health Aaron Motsoaledi, that found racial discrimination against black service providers by the schemes Chairperson of the independent investigative panel, Tembeka Ngcukaitobi, presented the report's key findings to the minister on Monday, 7 July. Findings The panel was tasked with determining if there were any racial undertones in the medical aid schemes' treatment of practitioners. ALSO READ: Medical aids slammed for procedural unfairness in new report 'The risk ratio is a tool we developed to work out the likelihood that a black practitioner would be subjected to an investigation, a finding and a penalty, versus a white practitioner,' explained Ngcukaitobi. 'What we did have the power to do was make findings of fact, and that finding of fact simply leads to one conclusion: the evidence of risk ratios showed racial discrimination against black service providers by the schemes.' Ngcukaitobi noted how, in 2017, one private medical aid scheme found black psychiatrists guilty of fraud, waste and abuse (FWA) at more than three times the rate of their white counterparts. In the government employee medical scheme, black dental therapists were generally three times more likely than non-black dental therapists to be found guilty of FWA in 2014. 'Critical step' against medical aid schemes On Monday, ActionSA said that laying formal criminal complaints was a crucial step to enable investigators to lawfully access the relevant records, communications and case files. The party said a criminal investigation would go a long way in exposing the 'deep-seated rot' within the health sector, 'ensuring that criminal conduct is rooted out and that discriminatory practices which undermine the very principles of South Africa's constitutional democracy are brought to an end'. This follows damning findings against the country's largest medical schemes, which were found to have applied discriminatory risk ratios to Black health professionals. These providers were disproportionately flagged, audited, or penalised through opaque fraud, waste, and abuse (FWA) systems. The investigation, commissioned in 2019, examined allegations of racial discrimination and procedural unfairness in the application of FWA processes by major schemes and administrators, including Discovery Health, Medscheme and Gems. Health Minister Aaron Motsoaledi received the final report from the Section 59 Investigation Panel last week. 'The final Section 59 Panel Investigation Report makes several recommendations, many of which align with reforms Gems has already implemented. These include the revision of FWA policies to prevent bias and improve oversight, along with extensive stakeholder engagement and awareness programmes aimed at preventing rather than remediating FWA. "Gems has also revised its standard operating procedures to support greater flexibility this includes accommodating reasonable timeframes for information provision, conducting affordability assessments during debt collection processes, and allowing cooling-off periods for Acknowledgement of Debt (AOD) agreements.
