
SC finds driver who suddenly braked on highway primarily liable for 2017 accident, enhances compensation to victim
A bench of Justices Sudhanshu Dhulia and Aravind Kumar made the remarks while enhancing the compensation payable to S Mohammed Hakkim, who was a third-year Engineering student in Coimbatore at the time of the accident.
The accident happened on January 7, 2017, when Hakkim was riding on a motorcycle with his friend on the pillion. A car that was ahead of them suddenly applied the brakes, and Hakkim's motorcycle crashed into the car and fell towards the right side of the road. A bus drove over him, and his left leg had to be amputated during treatment.
The top court held that Hakkim had a role in the accident by not maintaining the necessary distance, but held that the 'root cause of the accident is the sudden brakes applied by the car driver.'
'The car insurer has taken the stand that the appellant had hit the moving car from behind and thus, the car driver is not liable. On the other hand, the car driver admitted in his evidence that he had suddenly applied the brakes as his wife was pregnant and she had a vomiting sensation. In our view, the concurrent finding that the appellant was definitely negligent in not maintaining a sufficient distance from the vehicle moving ahead and driving the motorcycle without a valid license is correct,' the SC said in its judgment.
'But at the same time, it cannot be ignored that the root cause of the accident is the sudden brakes applied by the car driver. The explanation given by the car driver for suddenly stopping his car in the middle of a highway is not a reasonable explanation from any angle. On a highway, high speed of vehicles is expected, and if a driver intends to stop his vehicle, he has a responsibility to give a warning or signal to other vehicles moving behind on the road. In the present case, there is nothing on record to suggest that the car driver had taken any such precaution,' the court said.
Liability for negligence
The Motor Accident Claims Tribunal (MACT) fixed the compensation at Rs 91.62 lakh, but reduced it to Rs 73.29 lakh after attributing 20 per cent contributory negligence to Hakkim. MACT ordered the insurer of the bus to pay the amount, while exonerating the car insurer of all liabilities.
On appeal, the Madras High Court held that since the accident occurred due to the car driver suddenly applying the brakes, he should also be made liable. The high court fixed the liability of the car driver, the bus driver, and Hakkim as 40 per cent, 30 per cent, and 30 per cent, respectively. The court also reduced the compensation payable to the motorcyclist from Rs 73.29 lakh to Rs 58.53 lakh along with interest.
The Supreme Court enhanced the compensation, and directed that Hakkim be paid Rs. 91.39 lakh along with interest at the rate of 7.5 per cent per annum from the date of filing of the claim petition. 'Since both the offending vehicles (car as well as the bus) were insured at the time of the accident, the liability for the negligence of the car driver and bus driver shall be borne by them, ie, respondent no. 3 (car insurer) to the extent of 50% and respondent no.1 (bus insurer) to the extent of 30%, respectively.'
The court directed that the amount be paid to him within four weeks of the order.

Odisha police arrests two interstate burglars from Delhi

Around 10.30 am on July 21, when no one was present in the house, the burglars entered the building by breaking open the main door. They had stolen 230 grams of gold ornaments and cash from there, said Bhubaneswar-Cuttack Police Commissioner S Dev Datta Singh. In the course of the investigation, it was found that the interstate burglary gang was involved in the case. The two accused persons were arrested in Delhi, and Rs 18 lakh in cash was seized, he said. The accused persons were active in Odisha, Bihar, Madhya Pradesh, Delhi, West Bengal, Andhra Pradesh and other states of India, he said. The seized cash is almost equivalent to the cost of the stolen gold. The seized money will be handed over to the victim, Singh said. Drugs Worth Around Rs 350-Crore Seized In Mizoram, 1 Arrested
Aizawl: In one of the biggest drug hauls in Mizoram, the state police have seized crystal methamphetamine and heroin worth around Rs 350 crore and arrested one person, a senior officer said on Sunday. Acting on a tip-off, a team comprising personnel of the Criminal Investigation Department (Special Branch) and the Special Narcotic police station in Aizawl conducted an operation near the state capital on August 1. The joint team intercepted an Aizawl-bound pickup truck, which was carrying Mithun, at a stretch between Zemabawk and Seling areas, the police officer said. During a thorough search of the vehicle, the team seized 20.304 kg of crystal meth worth around Rs 300 crore and 1.652 kg of heroin concealed in 128 soap cases worth Rs 49.56 lakh from a hidden compartment, the officer said. The vehicle's driver, identified as B Lalthazuala (45), a resident of Aizawl's Republic Mual Veng, has been arrested for transporting drugs, he said. The accused has been booked under sections of the Narcotic Drugs and Psychotropic Substances Act, 1985, he said. Further investigation is underway, the officer added.

Gururgam Man Leaves Home With Rs 7 Lakh, Stabbed Hours Later By Live-In Partner
A woman in Gurugram stabbed her live-in partner as a days-long dispute allegedly over him meeting his wife and children continued to escalate. He died during treatment. 42-year-old Harish, a resident of Gurugram's Baliyavas, and 27-year-old Yashmeet Kaur, a resident of Delhi's Ashok Vihar, were in a relationship and living together in DLF Phase-3 since over a year. Kaur often had fights with Harish, a married man with children, when the latter would go to meet his wife and family. On Saturday, when one such fight escalated, the woman stabbed the man with a knife. He was rushed to a hospital in Gurugram but died of the injuries. Hours before the altercation between the live-in couple, Harish's nephew Bharat said his uncle came home from his job in Faridabad, took Rs 7 lakh from him and left in a car in which another accused Vijay had come to pick him up. As per police, Harish also called Bharat around 10 pm, instructing him to collect a food order and pay for it. The next day, around 7 am, he received a call from Kaur, who informed that his uncle had died. Bharat added that Harish had a stab wound on his chest. Kaur was arrested and the knife used to stab Harish was seized. Vijay is being interrogated by the police and the police is trying to ascertain why the victim had taken Rs 7 lakh on the night of the incident.
