's 'life saving' speech at Kannur during the Nava Kerala Sadas tour in 2023 amounted to the offence of abetment under Section 109 of IPC.
The bench of Justice V G Arun issued the interim order while considering a petition by the chief minister challenging the Ernakulam chief judicial magistrate (CJM) court's order of July 3. The CJM court had held that the alleged speech prima facie contained elements of abetment, observing that it instigated the use of muscle power to suppress protestors. The court also held that cognizance of the offence could be taken only upon production of a sanction for prosecution from the governor.
While considering Vijayan's petition, HC observed that there appears to be prima facie substance in the petitioner's contention that the CJM exceeded his jurisdiction by entertaining the complaint, since the alleged incident occurred outside the court's territorial limits. The bench also noted that the contention that the contents of the alleged speech do not attract the offence under Section 109 IPC is a matter requiring serious consideration.

The case arises from a complaint filed by Ernakulam DCC president Muhamed Shiyas, alleging that a speech delivered by the CM at Kannur on Nov 20, 2023, during the Nava Kerala Sadas tour, amounted to abetment under Section 109 IPC. In the speech, the CM praised bystanders who prevented protestors from coming in front of the moving Nava Kerala Sadas bus, describing their actions as 'life saving.'
The complaint alleged that this statement led to brutal attacks on Youth Congress workers who were protesting against the Sadas, accusing the govt of maladministration.
The attacks were allegedly carried out by CPM, DYFI and SFI members.
Earlier, acting on the CJM's directive, police had submitted a report finding no material against the CM. However, the CJM rejected the report, observing that the speech prima facie amounted to the instigation of criminal offences.
In his petition, Pinarayi contended that the CJM, Ernakulam, lacked territorial jurisdiction to entertain the complaint since the alleged incident took place in Kannur. He also submitted that the complaint is politically motivated.

Raipur: The Chhattisgarh High Court partially upheld the conviction of three individuals in a 2021 kidnapping case. The court set aside charges related to kidnapping for ransom and criminal conspiracy due to a lack of evidence regarding any ransom demand, wherein one accused was aquitted. A Division Bench comprising Chief Justice Ramesh Sinha and Justice Bibhu Datta Guru observed that while the prosecution successfully established that the accused deceitfully took the child and wrongfully concealed him, there was no evidence to support the charge of a ransom demand. Khilawan Das Mahant alias Nikhil, Amardas Mahant, and Sanjay Sidar were convicted under Sections 363 (kidnapping) and 368/34 (wrongfully concealing a kidnapped person with common intention) of the Indian Penal Code (IPC). The trial court sentenced them to seven years of rigorous imprisonment. Pritam Das Mahant, to whom the vehicle used in the crime belonged, was acquitted of all charges. The three convicts filed appeals against the judgment dated July 19, 2024, passed by the 2nd Additional Sessions Judge, Raigarh. According to the prosecution, Ramesh Kumar Agarwal, a resident of Chhapriganj, Kharsia, employed Khilawan Das Mahant alias Nikhil Kumar Mahant as a cook. His services were discontinued on Feb 18, 2021. On Feb 20, 2021, Khilawan went to Agarwal's house on the pretext of retrieving a mobile charger. He then lured Agarwal's six-year-old grandson with chips and took him away on his motorcycle without the family's consent. When the child and Khilawan did not return by 7:30 pm and his phone was found switched off, Agarwal lodged a report at Kharsia police station. An offence under Section 364-A IPC (kidnapping for ransom) was registered. CCTV footage from a shop owned by Gopal Bansal confirmed that Khilawan took the child on a motorcycle. Call Detail Records (CDR) showed that Khilawan's phone was switched off after the incident. Investigators tracked a related mobile number, belonging to Amardas, which was found moving towards Jharsuguda in Odisha. Police coordinated with authorities in Chhattisgarh, Odisha, and Jharkhand. The accused were intercepted near Khunti police station in Jharkhand, where they were transporting the child in a car (CG-13-UE-7055). The child was found hidden between the seats. Police recovered a country-made pistol, plastic rope, a chemical substance, adhesive tape, chips, biscuits, water bottles, and mobile phones from the possession of Khilawan, Amardas, and Sanjay Sidar. Further investigation revealed that the motorcycle used in the kidnapping belonged to Pritam Das Mahant, brother of Amardas. Pritam removed and concealed the number plate at the residence of Manik Das in Banjari. His statement led to the recovery of both the number plate and the motorcycle. The child also testified, stating that Khilawan took him on a motorcycle, bought him chips, and later transported him in a car towards Khunti. He identified Amardas and Sanjay Sidar as the other two individuals in the car. The High Court upheld the conviction of Khilawan under Sections 363 and 368/34 IPC, and that of Amardas and Sanjay under Sections 363/34 and 368/34 IPC. However, the court ruled that the essential ingredients of Section 364-A IPC (kidnapping for ransom) were not met. It found that the prosecution failed to prove charges under Section 364-A/34 IPC against all accused. Therefore, the conviction and sentences under these sections were set aside, and the accused were acquitted of the said offences.

2006 train blasts: Bombay HC to pronounce verdict on death confirmation pleas today

Over five months after it reserved verdict on death confirmation pleas filed by the state and appeals by the accused against their conviction in the 7/11 train blasts case of 2006, the Bombay High Court will pronounce the judgement Monday. After conducting hearings over six months, special bench of Justices Anil S Kilor and Shyam C Chandak on January 31 this year reserved its verdict on pleas filed in the high court. In 2015, the special court convicted the accused who have been in jail for over 18 years. On July 11, 2006, a series of bombs ripped through seven western suburban coaches of a train, killing 189 commuters and injuring 824. After an over eight-year trial, a special court under the Maharashtra Control of Organised Crimes Act (MCOCA) in October 2015 awarded death penalty to five of the convicts and life terms to seven others. Death row convicts Kamal Ansari from Bihar, Mohammad Faisal Ataur Rahman Shaikh from Mumbai, Ehtesham Qutubuddin Siddiqui from Thane, Naveed Hussain Khan from Secunderabad and Asif Khan from Jalgaon in Maharashtra were found guilty of planting the bombs. Those awarded life term were Tanveer Ahmed Mohammed Ibrahim Ansari, Mohammed Majid Mohammed Shafi, Shaikh Mohammed Ali Alam Shaikh, Mohammed Sajid Margub Ansari, Muzammil Ataur Rahman Shaikh, Suhail Mehmood Shaikh and Zameer Ahmed Latiur Rehman Shaikh. One of the accused, Wahid Shaikh, was acquitted by the trial court after nine years in jail. The Maharashtra government in 2015 approached the HC with pleas seeking confirmation of death penalty granted to five convicts. On the other hand, the convicts filed appeals challenging the special court order. Ansari, one of the convicts on death row, died due to Covid-19 in Nagpur prison in 2021. As the accused sought speedy disposal of the matter, the HC in July 2023, constituted a special bench led by Justice Kilor, which conducted regular hearings through more than 75 sittings. The lawyers representing the convicts argued that their 'extra-judicial confessional statements' obtained by the Maharashtra Anti-Terrorism Squad (ATS) through 'torture' were inadmissible under the law. They also argued that the accused were falsely implicated, innocent and were languishing in jail for 18 years without substantial evidence and their prime years were gone in incarceration. The appellants said that the trial court erred in convicting them and therefore the said order be set aside. The Maharashtra government opposed the appeals by convicts and claimed that the probing agency had provided sufficient evidence to establish it was 'rarest of the rare' case to sentence the accused to death penalty.

Thane: The Motor Accident Claims Tribunal (MACT) in Thane has asked the (MSRTC) to pay a compensation of Rs 1.12 crore to the family of a police constable killed in a road accident in 2022. Tired of too many ads? go ad free now In the order passed on Friday, the MACT, presided over by member R V Mohite, directed the MSRTC to pay the compensation along with an interest at 9 per cent per annum, from the date of the petition until the amount is deposited, within one month from the date of the award. Girish Ashok Harad (30), constable with the Mumbai police, was on way to join night duty on his scooter when a speeding MSRTC bus proceeding from Badlapur side towards Murbad left the road and collided with his vehicle near Sonawale village in Thane district. Harad suffered serious injuries and succumbed while undergoing treatment at a hospital in Kalyan. The Kulgaon police had registered an FIR under various sections of the IPC against the MSRTC bus driver and filed a chargesheet. At the time of the accident, Harad was earning Rs 58,822 per month. The claimants included his wife, minor daughter, parents and unmarried sister, who were dependent on his income. The MSRTC, represented by advocate H P Patil, countered the claim, asserting the accident occurred due to the sole negligence of the deceased. It argued that the bus was on the correct side and the scooter, coming from the opposite direction at high speed, slipped and collided with the bus. The claimants, represented by advocate M A Pendse, presented evidence, including the FIR, spot panchanama, postmortem report, and chargesheet. The tribunal noted the road was wet at the time of the accident. It means it was raining either before the accident or at the time of accident. Thus, the tribunal held contributory negligence of both drivers and assessed negligence of the constable at 20 per cent and of the bus driver to the extent of 80 per cent for the assessment of compensation. The compensation amount included loss of future income at Rs 72,73,728, future prospect - Rs 36,36,864, loss of consortium - Rs 2,00,000, loss of estate - Rs 15,000, funeral expenses - Rs. 15,000, and loss of love and affection - Rs 1,50,000. The tribunal ordered that the constable's wife be given Rs 60.90 lakh, his three-year-old daughter Rs 44 lakh, while his parents were to be given Rs 3 lakh each and his sister Rs 2 lakh. It said Rs 25 lakh of the compensation for the claimant's wife is to be invested in a fixed deposit for five years in a nationalised bank, while the compensation for his daughter is to be invested in a fixed deposit until she attains the age of majority.
