
Arunthathiyar candidates can compete in SC general quota too: HC
The court was hearing an appeal preferred by E. Surya, belonging to the Hindu Pallan community. The Teachers Recruitment Board issued a notification in 2019 for the post of Lecturers in Government Polytechnic Colleges and Special Institutions (Engineering/Non-Engineering). She had applied for the post of Lecturer (Information Technology) under the Scheduled Caste category. However, the two vacancies for the post were filled up by candidates belonging to SC (Arunthathiyar) community.
The case of the appellant is that one Ms R, Jeyasudha, who scored more marks than her, ought to have been selected against the SC(A) category in the first instance. In that event, in the SC (General) vacancy, the appellant would have competed with others, all of whom had scored lower marks compared to her.
Since Ms Jeyasudha was selected against SC (General) vacancy in the first instance itself, the appellant who is not an Arunthathiyar could not be considered for the remaining vacancy which had been reserved for a person belonging to the SC(A) category. She contended the procedure adopted by the recruiting agency was not in conformity with the statutory provisions. A Single Bench dismissed her petition. She preferred an appeal against the order.
The Division Bench observed that reservation was introduced with the aim of advancing and giving adequate representation to Scheduled Castes, Scheduled Tribes and other socially and educationally backward classes of citizens.
It is well settled that candidates who make it on their own merit have to be adjusted against the General Category candidates. In other words, when vacancies are filled up, the open quota opens first and candidates irrespective of caste, sex etc., are allowed to compete based on merit. The meritorious candidates should be first selected as against the open quota vacancies. Only thereafter, selection has to be made for the vertical reservation category from among the remaining candidates belonging to that particular reserved category (vertical) based on merits, the court observed.
It must then be seen if sufficient numbers of candidates to satisfy special reservation (horizontal reservation) have been selected. If not, the required number of special reservation candidates shall have to be accommodated as against social reservation categories by deleting the number of candidates therefrom. At any rate candidates who were selected against a post under the open quota shall not be adjusted against the reserved quota under vertical reservations, the court observed.
When a reserved candidate can compete in the open quota on merit and his/her selection would not affect the number of vacancies earmarked for his/her group the same approach should be adopted in the case of sub-reservation also. The court consequently upheld the manner of selection made by the Teachers Recruitment Board.

Rejecting a writ appeal of the State government, a Division Bench of Orissa High Court recently upheld a three-year-old judgment passed by a single judge Bench, which had ordered that maternity leave and associated benefits could not be denied to women employed by the State government on contractual basis. In August 2022, the Orissa High Court had ruled in favour of a contractual employee of the Department of Health and Family Welfare, whose maternity leave application from August 17, 2016, to February 12, 2017 had been rejected by the department. The State government appealed against the decision of the single-judge Bench. Rejecting the contention of the State government that only women civil servants were entitled to avail maternity leave, the Bench said 'women employees, for the purpose of availing such benefit, do constitute one homogenous class, and their artificial bifurcation founded on status of appointment falls foul of Article 14 of the Constitution'. Declining any further indulgence, the Division Bench of Justices Dixit Krishna Shripad and Mruganka Sekhar Sahoo broadly agreed with the reasoning of the single judge Bench that maternity leave with pay or comparable social benefits were to be assured by the state through policies and programmes as India is a signatory nation to the International Covenant on Economic, Social and Cultural Rights, and the Convention on the Elimination of All Forms of Discrimination Against Women. 'These conventions highlight the social significance of 'maternity', and the role of both parents in the family structure and in the upbringing of children. It is said that God could not be everywhere and, therefore, he created mothers. The idea of maternity leave is structured on 'zero separation' between the lactating mother and the breast-feeding baby,' the High Court said, adding that child psychiatrists and obstetricians were of the considered opinion that the physical companionship of mother and baby is mutually advantageous, and promotes bonding between the two, which is essential for their well-being. 'A lactating mother has a fundamental right to breastfeed her baby during its formative years. Similarly, baby has a fundamental right to be breastfed and brought about in a reasonably good condition. These two important rights form an amalgam from which the State's obligation to provide maternity benefits, such as paid leave to the employees, within the permissible resources, would arise,' the Orissa High Court said.

Vijayawada: This is another case for trolls, Justice K Srinivas Reddy remarked while granting bail to the accused in the Tirupati laddu ghee adulteration case on Thursday. The AP high court judge was referring to the social media trolling he was subjected to for the last two days, after his orders in the culpable homicide case under which former chief minister YS Jagan Mohan Reddy and other YSRCP leaders were booked. The trolling started after he stayed all further proceedings against Jagan and others in the Cheeli Singaiah hit-and-run case. Justice Reddy also expressed his displeasure during the hearing of two different petitions, filed by former minister Kakani Govardan Reddy seeking grant of bail and challenging his judicial remand.
