KUCHING (July 7): A shop assistant was sentenced by the Sessions Court here today to a total of 20 years in prison and eight strokes of the cane for raping a 13-year-old girl last year.
Judge Zuraidah Zakaria sentenced the 22-year-old accused to 10 years and four strokes for each of the two charges, with the prison terms to run concurrently.
The accused was also ordered to undergo rehabilitative counselling during his custodial sentence, and to be placed under police supervision for a year upon his release.
The offences were committed in a toilet and empty room at a workers' hostel in the Matang area here at around 12.15am and 2am, respectively, on Jan 31, 2024.
Both charges were framed under Section 376(1) of the Penal Code, which provides for up to 20 years' imprisonment and caning, upon conviction.
According to the facts of the case, the victim's mother suspected that her daughter had engaged in sexual intercourse with the accused, who was the girl's boyfriend.
The accused was arrested following a police report lodged by the mother.
The victim was referred to Sarawak General Hospital for a medical examination, which confirmed the presence of an old tear in her hymen.
The prosecution was led by deputy public prosecutor Mohd Fadzri Azham Zainudin, while the accused was represented by lawyer Moh Ung Kieng. Court crime rape underage

"Police immediately rushed to the scene and the death was confirmed by a medical assistant. "However, following a post-mortem at the Ampang Hospital forensic unit the next day, elements of foul play were detected. The post-mortem revealed that the cause of death was necrotising soft tissue infections due to skin and skeletal injuries. The victim's body was discovered inside the home of one of the suspects. "The case was subsequently reclassified as murder under Section 302 of the Penal Code," he said in a statement today. Following the discovery, a team from the district's Criminal Investigation Department (D9) arrested two local men believed to be involved in the case between June 26 and 28. The suspects are a 36-year-old self-employed man and his 73-year-old father, who is unemployed. "Police also seized a bamboo cane and an adjustable plier believed to be linked to the case," Azam said. He added that both suspects tested negative for drugs and have no prior criminal records. The first suspect has been remanded for 14 days starting June 27 until July 10, while the second suspect was remanded for 13 days from June 29 to July 11. Azam said the case is being investigated under Section 302 of the Penal Code for murder, which carries the death penalty or up to 40 years' imprisonment and a minimum of 12 strokes of the cane upon conviction. "The motive is believed to be debt-related," he added.

Nagentherah, 39, nodded in understanding after the charge was read before Magistrate MS Arunjothy, but no plea was recorded as the case falls under the jurisdiction of the High Court. He is accused of murdering K. Kumaran, 44, by the roadside at Taman Intan Baiduri, Sentul here, at 9.23pm on May 25. The charge, framed under Section 302 of the Penal Code, carries the mandatory death sentence or imprisonment of between 30 and 40 years, along with a minimum of 12 strokes of the cane if the death penalty is not imposed. KUALA LUMPUR, July 8 — A male suspect in the murder of university student Maniishapriet Kaur Akhara in Cyberjaya is expected to be charged soon under Section 302 of the Penal Code for murder, Selangor police chief Datuk Hussein Omar Khan said. The charge was initially expected to be brought before the Sepang magistrates' court at 8.30am today, according to earlier reports. However, Sepang police chief Norhizam Bahaman later confirmed that the case has been postponed to a date yet to be determined, according to a report in Free Malaysia Today. Three suspects — a man and two women aged 19 and 20 — were arrested between June 26 and June 27 in Johor Baru and Gemencheh, Negeri Sembilan, following the discovery of Maniishapriet's body. The victim, a student at the University of Cyberjaya, was found dead in her condominium unit by a friend on June 24. She had been living with five housemates, who had returned to their hometowns for the holidays on June 21. Police said all three suspects were known to the victim and confirmed there were no signs of forced entry into her unit. An autopsy determined that she died from blunt force trauma to the head and showed no evidence of sexual assault. Authorities also revealed that the male suspect used Maniishapriet's debit card to withdraw money from multiple ATMs shortly after her death. Her laptop, mobile phone, and some cash were also reported missing from the unit. The remand orders for all three suspects have been extended until July 1
