
Case for Scottish independence greater now than ever
Indeed, in the opinion of Professor Black, the "Union" is merely a political fiction bereft of any substantive meaning. Black likened Scotland's situation post 1707 to that of a corporate 'takeover' rather than a 'merger".
He said that contrary to the prevailing opinion in legal and political circles, Scotland and England did not merge into a new state with the Acts of Union, pointing to the facts that for England nothing much changed after 1707, treaties that the pre 1707 English state had entered into, such as the Treaty of Windsor which the kingdom of England signed with the kingdom of Portugal in 1386, continued to remain in force, whereas treaties signed by the pre 1707 Scottish state were rendered null and void as Scotland had ceased to exist as a state in international law.
Speaking at the Scottish Sovereignty Research Group's conference on Saturday, he said: 'No honest and conscientious lawyer can look at what happened in the first decade of the 18th century to the institutions of government north and south of the Tweed and reach the conclusion that the pre-existing states of Scotland and England both ceased to exist and that a new state emerged, phoenix-like out of the ashes.

'The evidence, the facts on the ground support no judgment other than that Scotland ceased to exist as a state in international law and was absorbed into a still-extant England, cosmetically renamed 'Great Britain'. Scotland's legal status today, more than three centuries later, is therefore not that of a partner in a union – unequal, perhaps, but a union nevertheless – but is that of territory absorbed into a larger country.
"A territory with only limited self-government and with its resources exploitable and exploited by the larger country for its own benefit and purposes."
He explained that in legal terms, Scotland's legal system was altered while England's remained intact, with the House of Lords becoming Scotland's final court of appeal over its pre-Union equivalent.
He also highlighted a legal opinion by distinguished legal experts Alan Boyle and James Crawford published before the 2014 referendum, which said that in the event of Scottish independence, the remainder of the UK would be the 'successor state' in terms of international treaties.
The Scottish Sovereignty Research Group is associated with an attempt by the organisations Salvo and Liberation Scotland to have the United Nations recognise Scotland as a 'non-self-governing territory' like Bermuda, the British Virgin Islands, or Guam. The groups are working with Geneva-based Justice Pour Tous Internationale (Justice for All International) to present Scotland's case to the United Nations.
The Swiss organisation rates as "strong" Scotland's case to be recognised as having colonial status and thus to come under the aegis of the United Nations' special committee on decolonisation. However, the United Nations is very much a creature of the powerful existing states and is highly reluctant to add new territories to the 17 which it currently considers to have colonial status.
An attempt by West Papuan leader Benny Wenda to have the territory's case heard by the special committee on decolonisation was rebuffed in 2017. West Papua was a Dutch colony which was annexed by Indonesia in 1962 despite Dutch attempts to prepare it for independence in its own right.
The population of West Papua are culturally, linguistically, religiously and racially distinct from the rest of the Indonesian population, having far more in common with the people of the independent Papua New Guinea which occupies the eastern half of the massive island of New Guinea. In 1969 Indonesia organised a 'referendum' amongst 1,026 hand-picked village elders who were bribed, threatened and cajoled into voting to ratify the Indonesian annexation.
Since annexation, Indonesia has exploited West Papua's natural resources and embarked upon a campaign of resettling hundreds of thousands of people from the over populated islands of Java and Madura, displacing the native Papuans. Political activity amongst native Papuans is severely repressed by the Indonesian government.
West Papua is unarguably a colony if the word is to have any meaning, nevertheless, the UN's special committee on decolonisation refused to hear a petition signed by 1.8 million West Papuans and smuggled out of the territory. Committee chair Rafael Darío Ramírez Carreño of Venezuela said that the committee could only deal with the 17 states that had already been identified as 'non-self-governing territories' by the UN General Assembly.
As West Papua proves, having a strong, even unimpeachable, case is no guarantee of recognition by the UN as a non-self-governing territory. Given this background, Salvo's and Liberation Scotland's chances of success in presenting Scotland's case to the UN seem slight.
The Conservatives have catastrophically collapsed to fourth place in a major new opinion poll from YouGov, behind Reform UK, Labour, and even the Lib Dems. The poll confirms other recent polling showing that the hard right English nationalist Reform UK is currently surging ahead, at least in England, where Westminster elections are decided. Despite Keir Starmer's Labour party currently being as popular as the BBC executive who cancelled River City, the Tories are not the beneficiaries of Labour's fall from grace. That support is going to the political con trick that is Reform UK, the party of 'anti-elite' millionaires.

The YouGov poll of Westminster voting intention puts Reform UK on 29%, Labour on 22%, the Lib Dems on 17% and the Tories on just 16%. Reform UK remains in third place in the poll's Scottish subsample, which puts the SNP on 28%, Labour 19%, Reform UK 18%, Liberal Democrats 15%, Greens 11%, and the Conservatives trailing far behind on just 8%. Neither of the Tories's new leaders, Kemi Badenoch in the UK party or Russell Findlay in Scotland, are able to reverse what increasingly looks like a death spiral for the Conservatives.
According to Electoral Calculus, if the poll were the result in a General Election, the Tories could be reduced to 17 seats while Reform UK would have a majority on 346 seats. The need for Scottish independence is growing increasingly urgent.

Apprenticeship Pathway 'Should Be Promoted as a Respected and Quality Option'
Schools, colleges, employers and the Welsh Government must work together to present apprenticeships as a strong start to a career, the Senedd's Economy Committee has concluded. The Committee heard evidence from apprentices and apprenticeship providers and has laid out recommendations for the Welsh Government to help people make better choices about their education and training in its latest report, Apprenticeship Pathways. The Committee believes that if the Welsh Government increases awareness and take-up of apprenticeships this will allow people to improve their skills and earning potential, building a more productive workforce and boosting the economy. Matt, who did an apprenticeship at Gower College, gave evidence to the Committee and said: 'The biggest issue is awareness. I had no idea apprenticeships existed, what they led to, or that they were equivalent to GCSEs. When I was unemployed, no one at the job centre mentioned them—and I never saw a poster or heard about them from employers either. 'I'm now a senior healthcare assistant, and I had to either have a Level 3 qualification or be willing to study for one. While senior management supported this, many line managers don't understand how apprenticeships work or how to support staff properly. 'These qualifications are ideal for people like me who left school with nothing. Through my apprenticeship with Gower College and support from Swansea Bay University Health Board, I gained GCSEs in Maths and English, new skills for my job, and I'm now studying for a nursing degree. It's taken me from no qualifications to university.' The Committee heard that many learners are not aware of alternative routes into employment and pursue further academic study even though they could be much happier, more successful and more suited to the vocational one. The Committee has laid out a number of recommendations for the Welsh Government on apprenticeship pathways, with calls for: Better engagement and promotion of apprenticeships as a viable education pathway for students The Welsh Government should work with schools, colleges and employers to present vocational courses as a good quality option Faster progress in developing a vocational education and training strategy Barriers to recruiting and retaining skilled assessors and apprenticeship trainers to be addressed Increases to pay for apprenticeships to be explored as part of the fair work agenda. Andrew RT Davies MS, Chair of the Senedd's Economy, Trade and Rural Affairs Committee, said: 'For many people, apprenticeships can be an excellent choice. They combine learning earning, working and training. The apprentices who gave evidence were enjoying their courses and they are thriving as a result. 'However, we heard about many challenges facing people who want to do an apprenticeship, not least understanding and navigating the system itself. For young people, the academic route is clear, and schools work hard to signpost and encourage their learners to do A-levels and degrees, the same cannot be said for apprenticeships. 'We're calling on the Welsh Government to work with schools, colleges and employers to make sure that the apprenticeship pathway is promoted to everyone as a respected and quality option. 'There are huge benefits to apprentices, employers and the economy if we get this right in Wales.'

The Deputy First Minister chose daughter Naomi's third birthday to tell boss John Swinney she was ditching the cauldron of Holyrood to enjoy 'the precious early years of family life'. But party sources said Ms Forbes had also grown tired of being 'undermined' by cabinet colleagues who saw her as a threat to Housing Secretary Màiri McAllan — seen as a future Nats leader. One insider said: 'Perhaps if Kate hadn't been getting tripped up at every step by people who are meant to be on her side then she would have stayed on. 'But given the personal sacrifices, it is clearly not worth the effort any longer. 'The family issues are clearly a huge factor for Kate but may not have been insurmountable if other things were different.' In her letter to the First Minister, Ms Forbes, 35, said she had given 'careful thought' to her future before deciding she 'does not wish to seek re-election' at next May's Scottish Parliament elections. And she told broadcaster LBC of a lack of 'support' for parents at Holyrood. She added: 'I'm not the first mum who's also an MSP to cite motherhood as a reason for standing down.' The Skye, Lochaber and Badenoch MSP since 2016 said: 'It is partly because of the eight-hour return drive I do every week, and the minimum five-hour drive across the constituency. Now a managing partner at the True North think tank, Mr Aberdein said he has been inundated with messages from business leaders lamenting Ms Forbes' departure. 'That is a major problem and I hope it is not a major recalibration, because if you don't have voices within your party that can speak to that then that is a huge weakness.' A senior Scottish Government source rejected the claims that cabinet rivalry was a factor in Ms Forbes quitting. They said: 'This is utter rubbish. Kate has set out her reasons for standing down.' And Social Justice Secretary Shirley-Anne Somerville dismissed claims that Ms Forbes threw in the towel because she had become disenchanted with the SNP. She said: 'Political hacks are trying to find another angle but maybe, just maybe, it's about someone doing what's best for her and her family.' Ms Forbes, who married husband Alasdair MacLennan in 2021, became the Scottish Government's youngest Finance Secretary when she succeeded shamed Derek Mackay in 2020. She came under fire for her views on gay marriage, abortion and trans rights. And she publicly opposed Nicola Sturgeon's doomed plan to allow people to legally change sex through self-declaration. Several senior Scottish Government figures rejected Ms Forbes' stance, including Mr Swinney, despite his own Christian faith. Her profile continued to rise, however, and in 2023 she narrowly lost to Humza Yousaf in a bitter SNP leadership race. Former SNP MP Joanna Cherry acknowledged the Deputy First Minister's announcement that she was stepping down to spend more time with family but said there is 'probably a bit more to it than meets the eye'. She said: 'I have the utmost respect for Kate and I think it's a bit of a disaster for the SNP.' Former SNP MP Angus MacNeill, said: 'Kate wouldn't be walking away if there was a prospect of the SNP delivering independence.' He added: 'When there is no strategy, just cluelessness, a groundhog five years at Westminster's devolved parliament ain't so appealing.' Mr Swinney said: 'I pay tribute to Kate for her invaluable contribution to public life over the last ten years. "The challenges of frontline politics are considerable, and I understand the decision she has made, although I wish it was not the case.'

John Curtice: SNP majority in 2026 ‘extremely unlikely'
"What is [[John Swinney]] doing? He is saying to people: if you want independence, vote [[SNP]]. Do not vote for Alba, do not vote for the Greens." READ MORE The First Minister's plan has proved controversial in the party, with rebels set to attempt to amend it at conference in October. One change that has the backing of 43 branches is to make a majority of list votes for pro-independence parties in 2026 a mandate for independence negotiations with the UK Government. "[[John Swinney]] does not want there to be a fragmented list vote," Prof Curtice told the audience in Edinburgh's Summerhall. "He wants people to vote for the SNP. The challenge facing the SNP — the thing that has not changed in Scottish politics despite the turbulence of the last two and a half years — is support for independence. We are still around 50/50 on the independence question. "Although you hear a lot of talk of people not being concerned about independence anymore, just tell that to most unionist voters. Most unionist voters are deeply concerned about independence. "Very few people now are willing to vote for the SNP if they are opposed to independence. That is in complete contrast to the position in 2011." But now the party was not picking up any new No voters and was only winning around three-fifths of independence supporters. Even if the SNP were to win a majority of seats, the academic said it was unlikely the UK Government would agree to a referendum. Last week's comments from the First Minister marked a change in strategy. Previously, the party said a "democratic majority" of pro-independence MSPs after the 2026 election should pave the way to a new vote. Mr Swinney said: "The necessity of independence is absolutely paramount and we have got to make that case in the 2026 Scottish Parliament elections. "But there is a logjam and we have got to break that logjam. "We demonstrated how we break the logjam in the past, by electing a majority of SNP MSPs in 2011, and that led to an independence referendum in 2014." He invited supporters of independence to back his party in the constituency vote and to "demand independence" in the regional vote. Asked about how popular the First Minister is, Prof Curtice said Mr Swinney numbers had "been kind of steady since he became First Minister." "He is not as popular now as he was when he was Deputy First Minister," he added. "In an era of fragmented politics, that is still good enough to make him the least unpopular politician in Scotland." He added: "Anas Sarwar is still suffering from the shadow of Sir Keir Starmer. Kemi Badenoch — who is she? Nigel Farage is very strong and popular among a section of Scottish and British society." He said around 40% of Leave voters in Scotland were set to vote for Reform next year. Asked for predictions for next year's election, Prof Curtice said he thought it would be "child's play" for Reform to win at least 10 seats. The problem the Tories face is that Reform are not just taking voters, they are taking donors, they are taking people. "It is very difficult to see any outcome other than the SNP still providing government. What remains highly uncertain is how strong it will be. It could be as low as 45 seats. I think the maximum at the moment is 55 seats. "But 55 seats — you have only got to find one party to make a deal. With 45 you have got to find two, and that becomes much more difficult. "I think at the moment it is a race between Reform and Labour over who comes second, and unless the popularity of the Labour government improves, Labour may find themselves in much the same position as they are at the moment." "The lesson of the last Westminster parliament is not to presume that the outcome of the last election is going to determine what happens at the next one," he added. He described the outgoing Deputy First Minister as "one of the most talented politicians within the current parliament". "Some of us are old enough to remember those promises 25 years ago of a family-friendly parliament," he added. "She is not the only person who has found it difficult to combine parenthood with being an MSP. To that extent, I think the Parliament should reflect back on whether or not it is going to make it possible for people with young children, particularly those in rural constituencies, to be MSPs."
