Congress demands BJP MLA's disqualification after High Court upholds his conviction

The Opposition Congress in Rajasthan on Saturday (May 3, 2025) demanded the disqualification of Bharatiya Janata Party (BJP) MLA Kanwar Lal Meena following the Rajasthan High Court's order upholding his conviction in a 20-year-old case. Mr. Meena, elected from Baran district's Anta, was sentenced to three years' rigorous imprisonment in the matter.
The case pertained to an incident in February 2005, when Mr. Meena arrived with seven associates at the venue of a protest by villagers in Jhalawar district demanding a Deputy Sarpanch repoll, and threatened the Sub-Divisional Magistrate (SDM) with a revolver. He allegedly aimed the revolver at the SDM's head and asked him to either announce a repoll within two minutes or get killed.
Mr. Meena, who was not elected to the Rajasthan Assembly at the time, already had 15 criminal cases against him. He damaged the recording equipment of government officials to remove traces of his action and left the scene. He was arrested three years after the incident and released on bail the same day.
Though Mr. Meena was initially acquitted by the trial court, a sessions court in Aklera later convicted him in December 2020 after finding him guilty of obstructing government work, intimidating government officials, and vandalising property. He was sentenced to imprisonment for three years and two years, respectively, on different charges, to be served concurrently.
A two-time MLA, Mr. Meena first won the election from Jhalawar's Manohar Thana in 2013, and later from Anta in 2023. Dismissing his revision petition, which challenged the sessions court's judgment, a Single Judge Bench of the High Court ruled on Friday that Mr. Meena's conviction was in accordance with the facts and law, and based on strong evidence.
The High Court directed Mr. Meena to surrender immediately before the trial court, failing which the court would issue non-bailable warrants against him, and the MLA would undergo the sentence.
Pradesh Congress Committee president Govind Singh Dotasra and the Leader of the Opposition in the Rajasthan Assembly Tika Ram Jully demanded that Mr. Meena be disqualified forthwith in accordance with the provisions of the Representation of the People Act, 1951. Section 8(3) of the Act provides for the disqualification of a lawmaker following conviction for an offence with a two-year sentence or more.
Mr. Jully said Assembly Speaker Vasudev Devnani should immediately pass an order cancelling Mr. Meena's membership of the House in view of the High Court upholding his imprisonment sentence. A delegation of Congress leaders will shortly meet the Speaker and place the demand before him.
An alleged attack by a mob led by Mr. Meena, when he was an MLA, on activists taking part in a 'Jawabdehi Yatra' (march for accountability) in Jhalawar district's Aklera region on January 16, 2016, had also made headlines. Videos had emerged showing Mr. Meena with a lathi charging towards the activists, and beating and chasing them away. The incident had attracted attention to the movement to highlight rampant corruption in public life and fixing accountability.

The National Green Tribunal ( NGT ) issued notice on a plea from The Citizens Foundation, which alleges widespread non-compliance with the Plastic Waste Management Rules, 2016, by manufacturers of gutkha, pan masala, and tobacco products. The petition claims that banned plastic packaging materials are still being used and calls for strict enforcement of existing regulations. This includes the closure of units violating the rules and the recovery of environmental compensation. A judicial bench led by Justice Prakash Shrivastava and Expert Member Dr. A. Senthil Vel has issued notices to relevant authorities, including the Central Pollution Control Board (CPCB) and the Delhi Pollution Control Committee (DPCC), seeking their responses. Counsel for the petitioner pointed out that, despite the CPCB's earlier directives, issued on October 22, 2021, under the Environment (Protection) Act, 1986, to 25 manufacturers to halt operations unless they adopted eco-friendly packaging, these directives remain unimplemented. The CPCB had instructed the defaulting companies to submit a timeline for switching to sustainable materials and to pay Environmental Compensation (EC) with interest for any delays. The plea highlights violations of Rules 4(f) and 4(i) of the 2016 Rules, which prohibit the use of plastic sachets and specific polymers in packaging gutkha and related products. CPCB's previous reports suggested that such non-compliance could result in stern penalties, including seizure of goods, shutting down of factories, and levies of Rs 5,000 per ton of plastic used. Repeat offences could attract additional fines of up to Rs 20,000 per ton. The applicant also cited a CPCB report from January 2021, which outlines enforcement under the Extended Producer Responsibility (EPR) regime. According to this, delayed EC payments could be penalised with annual interest ranging from 12 per cent to 24 per cent. Delays exceeding three months could lead to factory closures and criminal prosecution under Section 15(1) of the Environment Protection Act. Recognising the gravity of the environmental concerns raised, the NGT has scheduled the next hearing for September 26, 2025. The applicant must serve notices on the remaining respondents and file an affidavit of service one week prior to the scheduled date, as stated by the Tribunal.

Agreeing with the police's contention that a job in a government mint is a highly sensitive position, a sessions court recently rejected the anticipatory bail application of two employees booked for allegedly using dummy candidates to appear for an online exam for the job. The court was told that departmental inquiry is ongoing against the two and at least five others after it came to light that their photographs of the persons who appeared in the online exam did not match the accused persons, who work at the government mint. The MRA Marg police station of the Mumbai Police had filed an FIR on allegations of cheating, forgery and criminal conspiracy of the Indian Penal Code and the Maharashtra Prevention of Malpractices at University Board and other Specified Examination, Act. Lokendra Kumar and Aditya Kumar — both residents of Uttar Pradesh — sought anticipatory bail, stating that they are innocent and there is no material to prove that they were involved in such an offence. They also submitted that since a departmental inquiry is already ongoing, their custodial interrogation by the police is not required. Police opposed their pleas stating that the mint is a very important office where coins, commemorative coins, medals, and medallions are produced and gold stocks are held. Police sought to probe whether those named are involved in any espionage and who helped them secure the job. It is suspected that the candidates were involved in the exams given from 2019-2023. 'By perusing the application and the prosecution's say, departmental inquiry is going on against the applicant. It is also alleged that the photograph provided at the time of the examination does not match the actual photograph…,' additional sessions judge, Avinash Kulkarni said in the order, rejecting the pre-arrest bail pleas of both the men, on July 19, which was made available on July 21. 'Accordingly, it is alleged that a bogus person appeared for the examination using applicant's Aadhaar card and other identity documents. The position in question is admitted to be highly sensitive,' the order added. The anticipatory bail pleas of two others are pending. The case relates to a complaint from the Human Resources office of the Security Printing and Minting Corporation of India. Police said that after CCTV footage of one of the exams revealed that a person who appeared did not match the photograph of the candidate, a probe was conducted into the recruitment held for the posts of junior assistants and other technical posts and a departmental inquiry was ordered against seven.
