
Court orders not followed unless officials summoned, observes HC
A division bench of Chief Justice Arun Bhansali and Justice Jaspreet Singh made this observation on July 21. The court was hearing a special appeal filed by the State of U.P. through its additional chief secretary, the department of basic education and others against the respondent Jai Singh and others.
'The attitude of the officers, in ignoring the orders passed by the court till such time that notices in the contempt petition are issued, cannot be approved. On many occasions, despite issuance of notices in contempt petition, no action is taken and it is only when the directions are issued for personal presence that for the first time, the officers care for the orders passed by the Court. There are hardly any appeals which are filed without application seeking condonation of delay, which conduct on part of the appellants cannot be appreciated/encouraged,' the high court observed.
The court was dealing with a special appeal filed by the state against the order of a single-judge whereby the state was directed to permit respondents to continue in employment in the department along with payment of arrears of salary. The state filed an appeal against the said order with a delay of 345 days.
In the application for condonation of delay, administrative reasons were given for justifying filing the appeal late. It was requested that the delay was unintentional, genuine and bona fide. The respondent, in his objection, pleaded that the story by the state was concocted. It was argued that cognizance of the order was taken for the first time after six months.
The court observed that though after the judgment was passed, the state claimed to have sought opinions of standing counsel and chief standing counsel, no such opinion or request seeking opinion was placed on record. It also observed that the delay in seeking and providing opinions and the need for second opinions was not explained.
The court said, 'In the entire affidavit, there is no intention to indicate the sufficient cause for seeking condonation of delay, only formality of indicating dates has been fulfilled and thereafter, sermons on the working of the Government have been indicated that it took time in completing the administrative formalities by following certain norms and procedure of 'disciplined and systematic performance of official functions' and that among the several factors on which depend the time consumed in process, there are 'certain unavoidable and unspoken circumstances.'
The court observed that the limitation prescribed in the Limitation Act was being taken for granted by the State and the appellants approached the high court only after notices were issued in the contempt petition filed by the respondents. Declining to accept the delay condonation application, the court dismissed the appeal as barred by limitation.

Traffic diversions for Railway Over Bridge work from July 31
Traffic police have announced temporary diversions in connection with the first phase of construction of the Railway Over Bridge (ROB) at Cuddalore road near New court complex, set to begin on Thursday. A press note from Nithya Radhakrishnan, SSP (Traffic) said the diversions effective from morning aimed to minimise inconvenience of the general public and road commuters. Accordingly, all heavy and medium vehicles, including buses coming from Cuddalore towards Puducherry via Cuddalore Road, should take a left turn at Marappalam junction towards 100 Feet Road to reach Indira Gandhi Square. No heavy/ medium vehicles, including buses, are allowed to cross the Marapalam junction towards Mudaliarpet. However, emergency vehicles like ambulances, fire tenders, school buses, etc., shall take a right turn at Vinayaga Murugan Tea shop junction in Ambedkar Salai towards Sonampalayam junction. Light motor vehicles and two-wheelers coming from Marapalam towards Venkata Subbareddiyar Statue junction will proceed in the usual route up to AFT railway gate and then take a slight left towards the newly constructed designated cement road. Buses, medium vehicles, light motor vehicles and two-wheelers from CV road junction towards Mudaliarpet in Cuddalore road will take a slight right turn near new court complex and pass through the designated bifurcated portion of the cuddalore road. Vehicles used by Judges, Government officers and employees of the Integrated Court Complex are required to enter the premises through Gate No.1. While emerging out, they should take the immediate left turn at the main gate to the new cement road to reach Venkata Subbareddiyar Statue junction. The litigants and general public shall use Gate No.2 of the Court Complex for their entry and exit. They are also requested to take immediate left in the new cement road towards Venkata Subbareddiyar Statue junction. While vehicular access to the Forest department is as usual, while emerging from the premises, vehicles should take the immediate left turn at the main gate onto the new cement road to reach Venkata Subbareddiyar Statue junction. The SSP has appealed to the public and road commuters to cooperate with the Traffic Police for these temporary traffic diversion/arrangements till completion of the railway over bridge work.

He further added, 'India and the US don't trade that much in goods, and so we won't trade too much going forward either, because now both countries have higher tariffs on each other.' When one of the users asked about the state of pharmaceutical and chemical exports, Shenoy replied, 'The american importers will have to pay more for them; or they have to go through cycles of approvals for new FDA approved plants elsewhere (sic).' On Wednesday, July 29, US President Donald Trump announced a 25% tariff on India, citing high duties and non-monetary trade barriers. He criticised India's military purchases from Russia, imposed a penalty, and stated that the tariff would be effective from August 1. In a post on his Truth Social account, Trump wrote, 'Remember, while India is our friend, we have, over the years, done relatively little business with them because their Tariffs are far too high, among the highest in the World, and they have the most strenuous and obnoxious non-monetary Trade Barriers of any Country.' He pointed out that India imports military equipment and oil from Russia, the country responsible for the war in Ukraine, according to Trump. As a result, he intends to impose a 'penalty' on India from Friday onwards. India responded to Trump's tariffs by saying that it was 'studying its implications' and taking steps 'necessary to secure our national interest.' New Delhi also said that it remains committed to 'fair, balanced, mutually beneficial' trade agreement with the US. 'The Government has taken note of a statement by the US President on bilateral trade. The Government is studying its implications. India and the US have been engaged in negotiations on concluding a fair, balanced and mutually beneficial bilateral trade agreement over the last few months. We remain committed to that objective,' the Ministry of Commerce & Industry said.
