The Supreme Court on Monday upheld the Bombay High Court 's order that allowed Adani Cementation to cut 158 mangrove trees for construction of a captive jetty project along the Amba river in Maharashtra's Raigad district. The jetty construction project , which allegedly fell within 1.26 hectares of Coastal Regulation Zone regulations-IA area (being mangrove forest and mangrove buffer zone area), will help Adani transport cement, clinker and other raw material through waterways along with a conveyor corridor and an approach road to the proposed cement grinding and fly ash processing unit, a back up storage unit in Shahapur and Shahabaz in Raigad district to meet the increasing demand for cement in the Mumbai Metropolitan Region (MMR).A bench led by Chief Justice B.R. Gavai dismissed a petition by the Bombay Environmental Action Group, an NGO, alleging that the HC failed to appreciate that mangroves and mangrove buffer zones were ecologically sensitive and geomorphological features which play a role in maintaining the integrity of the coast and their destruction would threaten Maharashtra's fragile coastal environment. The HC judgment 'fundamentally erred in prioritizing the commercial interests of a private entity over the paramount ecological importance of mangroves,' the NGO said.Considering the large demand of cement in the coastal areas and seeing the current congestion of roads in MMR, Adani said that it had conceptualised setting up of cement manufacturing unit along Amba River, with an intention to reduce the carbon footprint and to help reduce the overall pollution and also accelerate the infrastructure development in Mumbai, and hence it was in larger public interest. The HC had on March 5 allowed the project "keeping in mind the goal of sustainable development of striking a balance between the necessity of the project, which aims at meeting the every increasing need of cement.' The HC found no difficulty in granting the requisite permission to Adani as the requisite statutory permissions were granted in favour of the project, subject to strict compliance of the conditions imposed upon it by various statutory authorities for ensuring protection of ecology and environment.

Bombay HC dismisses review plea and allows Motilal Nagar Redevelopment in Goregaon West
MUMBAI: Bombay high court on Friday dismissed a review plea and paved the way for the redevelopment of 141 acres of MHADA land in Goregaon West, called Motilal Nagar. MHADA recently appointed Adani Realty as the consultant and Development Agency (CDA) for the project. It is touted as the city's largest housing project. Motilal Nagar Vikas Samiti, a residents' group, filed the review petition seeking recall and quashing of the HC ruling dated March 6, 2025, by Chief Justice Alok Aradhe and Justice Bharati Dangre. The residents sought, as interim relief, a stay on MHADA and the developer awarded the contract from going ahead. The society's three main contentions were that firstly, as a society, they can and ought to be allowed to self-develop the premises under the govt policy. Secondly, the society of residents can, under rule 33 (5) (2) of the Development Control and Promotion Regulations (DCPR), appoint a developer of their choice. Thirdly, any development undertaken by such society, with MHADA NOC, by appointing a developer, requires 51 percent consent of the members. The housing authority, through its senior counsel, said no new points were being raised and that the HC, after considering all aspects, recognised MHADA's rights under the law as the owner of the property to redevelop the premises through private developments by inviting bids. The counsel also contended that the society, in an affidavit, earlier said it wanted MHADA to do the development itself. Maharashtra Housing and Area Development Authority (MHADA) said it floated bids and appointed Adani Realty as the CDA. The review plea before the same division bench challenged the appointment of the developer. The HC said a reasoned order will be made available later. By Friday's development in court, Motilal Nagar I, II, III redevelopment projects can proceed, said a MHADA lawyer. In 2018, MHADA said the estimated project cost was Rs 21,000 crore. The developer will bear all costs, including costs for transit and rehabilitation of eligible tenements, shops, slum dwellers, and other amenities. In 2013, Manjula Veeran and Tekchand Khanchandani filed two PILs before the HC seeking directions to MHADA and Brihanmumbai Municipal Corporation (BMC) to demolish the 'rampant unauthorised horizontal and vertical constructions'' at Motilal Nagar I, II, and III, Goregaon West, MHADA Colony, Mumbai. The colony originally housed 400 tenants, mostly row houses. In 2013, HC directed MHADA as the landowner to carry out a survey based on which to decide on the course of action. MHADA found over 3,600 unauthorised constructions, which it then sought to include in the redevelopment plan. The HC in March 2025 accepted the housing authority's stand to ensure rehabilitation through a bidding process. What MHADA envisages in its plan for Motilal Nagar Rehabilitation for both existing and commercial users. Building markets, shopping centres, offices, houses and workplaces, mixed-use buildings, cultural centres, clubs, public halls, recreational centres, schools, community centres, shelters for women and children, shelters for the old, healthcare and medical centres, hostels, and residential buildings for sale. In December 2021, TOI reported that only three construction firms, Adani, L&T, and Naman Developers , submitted bids to redevelop Motilal Nagar, touted as the city's largest housing project.

Not covered in FTA, carbon tax may spoil in India-UK free trade mood; here's why
Britain's proposed Carbon Border Adjustment Mechanism (CBAM) is not included in the FTA with India because London has not yet formally notified the tax. read more The free trade agreement between India and the UK does not cover Britain's proposed Carbon Border Adjustment Mechanism (CBAM). However, officials stated on Friday (July 25) that if such a tax is introduced later, India will have the right to take measures to offset its impact on domestic exports, reported Economic Times. The CBAM is not included in the agreement because Britain has not yet formally notified the tax. In December 2023, the UK announced plans to implement the CBAM starting in 2027. STORY CONTINUES BELOW THIS AD The issue was raised during negotiations for the Comprehensive Economic and Trade Agreement (CETA). 'If it is implemented and negates the trade benefits of India under the agreement, India will have the freedom to rebalance it. We can take counterbalancing measures. This much understanding has been made in the form of note verbale,' an official was quoted as saying by the ET.. A note verbale refers to a diplomatic communication exchanged between two countries. 'There is an understanding that in case the UK make it effective against India in future, then we will also have the right to take counterbalance measures… India can take away the concessions and there will be a mechanism for that,' the official further noted. India is also engaged in discussions with the European Union, which is planning its own CBAM. The two parties are negotiating a trade agreement, expected to be finalised this year. India has labelled the CBAM as a trade barrier. A carbon tax is considered a non-tariff barrier. The European Union has already implemented such a tax on imports exceeding a specific carbon emission threshold. For every tonne of excess carbon emission, a levy ranging from €1 to €100 per tonne is imposed. India and the United Kingdom (UK) signed the Free Trade Agreement (FTA) on Thursday (July 24) during PM Narendra Modi's visit to the UK. STORY CONTINUES BELOW THIS AD New Delhi and London concluded talks in May to reach a bilateral Free Trade Agreement, discussions for which first began in January 2022. As per the British government estimates, the FTA will boost its GDP by £4.8 billion ($6.5 billion) annually. Indian exports to the UK are expected to double by 2030.
