A Key Fight Over the Most Infamous Police Project in the Country Is Coming to a Head
Last week, Dave Wilkinson, CEO of the Atlanta Police Foundation, took the witness stand in an Atlanta courtroom and argued that a local media outlet had no right to request his organization's records under Georgia's Open Records Act. Why? Because, he claimed, their coverage of the controversial police training facility known as 'Cop City' would be used to turn the public against the project and 'terrorize' the companies building it. In other words, the highest-paid police foundation executive in the country essentially argued that journalism is a form of terrorism.
Wilkinson was in court responding to a lawsuit filed by the Atlanta Community Press Collective, a small nonprofit newsroom, and Lucy Parsons Labs, a transparency-focused research organization. The case represents more than just a fight over meeting minutes: It's a battleground for the future of transparency in public-private partnerships, where private actors are increasingly embedded in state functions—and using that status to shield themselves from public scrutiny.
At the heart of the lawsuit is a critical question: Can the actions of the Atlanta Police Foundation—a private nonprofit—be considered public for the purposes of Georgia's Open Records Act? The plaintiffs argue yes, pointing out that APF runs nearly two dozen programs on behalf of the city of Atlanta, including the construction of Cop City—a sprawling, militarized police training facility in a metro Atlanta forest—and the development of the city's surveillance infrastructure. These are not peripheral projects; they are central to how public safety in the city is shaped and enforced. As such, they should be subject to the same transparency standards that govern public agencies. If the court sides with the foundation and allows its refusal to comply with records requests to stand, it could set a dangerous precedent—paving the way for governments to outsource core public functions to private entities shielded from public scrutiny.
The story of Cop City is both deeply local and intensely emblematic of national trends. From its inception, the facility faced widespread public opposition, including mass protests, forest defense occupations, and hundreds of hours of oppositional public comment. It also faced accusations of secrecy and deception, thanks in large part to its funding model: a public-private partnership, or P3. The proliferation of P3s across the U.S.—from transit to housing to policing—has accelerated over the past decade. These partnerships are often sold as 'innovative,' but in practice they obscure decision-making, shift risk onto the public, and prioritize profits over public good. In infrastructure, that might mean a toll road built to maximize fees rather than access. In policing, it means a militarized force bankrolled by the private sector to protect capital, not communities.
Originally, the city of Atlanta promised to contribute $30 million in public funds, with the remaining $60 million to come from private donors, funneled through the Atlanta Police Foundation. So, what is a police foundation?
The short answer: a slush fund for police departments. The longer answer: Police foundations are the preferred vehicle for corporations and wealthy donors to bankroll the expansion, militarization, and surveillance capacities of police—outside of public budgets and beyond public oversight. Found in most major U.S. cities, police foundations fund everything from the very serious (the construction of training centers and surveillance networks and the purchase of military-grade equipment) to the kind of inane (sponsoring a police horse, or buying police dogs bulletproof vests, or, in St. Louis, funding the integral work of Operation Polar Cops, an ice cream truck run by police officers.) The donors are often a who's who of local corporate elites, often with business before the city. So while police already consume the lion's share of most municipal budgets, they also enjoy a second funding stream that comes with even fewer strings attached.
Independent outlets in Atlanta like ACPC have stepped into a local reporting vacuum during the lengthy Cop City showdown. The city's flagship newspaper, the Atlanta Journal-Constitution, showed little interest in investigating the project. The reason may be structural: The AJC is owned by Cox Enterprises, a major donor to the Atlanta Police Foundation through the James M. Cox Foundation. Its CEO at the time, Alex Taylor, was directly involved in APF fundraising. Despite claiming editorial independence, the AJC failed to disclose this conflict while publishing favorable coverage and opinion pieces supporting Cop City.
ACPC, by contrast, used Georgia's open records law to uncover critical facts about the project's ballooning cost and secretive planning process. Its reporting revealed that the city quietly introduced an ordinance—later passed—that would increase public spending on Cop City to at least $51 million. That included a $31 million payment to the APF, plus a lease-back agreement worth another $20 million over 20 years. These revelations likely wouldn't have come to light without records obtained through Georgia's transparency laws.
ACPC had initially accessed APF board meeting minutes by requesting them from the Atlanta Police Department—a public agency that was receiving the minutes from the foundation. But when APF stopped sending those minutes to the Atlanta Police Department, ACPC began requesting them directly from the foundation. APF refused. That stonewalling landed them in court.
This might seem like a narrow skirmish over bureaucratic documents, but the implications are wide. In court, the Atlanta Police Foundation argued that it is a private entity, separate from the Atlanta Police Department, and therefore not subject to Georgia's open records laws. But the APF's role in the construction of Cop City—raising the funds, helping select the contractors, crafting communications strategy—looks very much like a public function cloaked in private legal status.
This case echoes a troubling national trend: private actors increasingly exercising public power while avoiding public accountability. Consider Elon Musk's involvement in everything from federal transportation contracts to national security satellites. His companies shape policy and infrastructure in ways that affect millions, but as private enterprises, they operate outside of most transparency laws. That kind of shadow governance, enabled by P3s, friendly legislators, and a gutted regulatory state, is not a bug of modern governance. It's becoming the system itself.
At the same time, across the country, state legislatures are quietly but deliberately weakening the open records laws that make investigative journalism possible. Lawmakers are introducing bills that narrow what qualifies as a public record, extend response times, raise fees for requesters, or exempt entire categories of information from disclosure. In some states, public agencies are allowed to simply ignore requests without consequence. In others, journalists have been sued or even criminally investigated for pursuing records. These efforts don't usually make national headlines, but they are part of a sustained erosion of the public's right to know—death by a thousand paper cuts to the First Amendment. The result is a chilling effect on accountability reporting and a growing opacity in the very institutions meant to serve the public. In the era of Trump 2.0, as power is increasingly concentrated and privatized, the deliberate dismantling of transparency laws isn't just a bureaucratic issue, it's a democratic crisis.
Without access to documents, data, and deliberations, journalism becomes guesswork, speculation, or PR. Reporters can't hold power to account if they're forced to work in the dark. If journalism is democracy's rough draft, as the saying goes, transparency is the paper it's printed on. This case is about much more than a few withheld emails or board minutes. It's about whether the public has a right to know how power operates—and who is paying for it—when that power wears both a badge and a corporate logo.

A Rising Democratic Star Just Became a New Anti–Death Penalty Hero

When the history of America's long journey toward the abolition of capital punishment is written, it will be studded with the names of people who, in their time, took little-noticed decisions to oppose the death penalty. Kentucky Gov. Andy Beshear will likely be one of those people. Beshear, a rising star in the Democratic Party, is not a prominent and outspoken abolitionist. In fact, during an October 2023 gubernatorial debate with his Republican opponent, Beshear explained that there are 'some crimes so terrible and some people so dangerous that I do believe this law needs to continue to be on the books.' With statements like that, Beshear certainly does not sound like a candidate for the abolitionist Hall of Fame. But consider what he did late last month, when he refused to authorize the execution of Ralph Baze, who was convicted of murdering two police officers and would later be the lead plaintiff in an unsuccessful constitutional challenge to lethal injection. Beshear's refusal was enormously significant in forestalling a real step backward for the abolitionist movement. And, while it is by no means the death penalty capital of the United States, the fate of capital punishment may be determined in places like Kentucky, places I call death penalty 'swing states,' and not just in states with many executions like Texas, Oklahoma, or Alabama. A death penalty swing state is one in which the death penalty remains an authorized punishment, but in which executions seldom occur and death sentences are seldom handed down. As the Death Penalty Information Center notes, 'Although the United States is considered a death penalty country, executions are rare or non-existent in most of the nation.' Right now, there are 10 death penalty states in which no one has been executed in the past 10 years. Kentucky is one of those states, along with California, Idaho, Kansas, Montana, Nevada, North Carolina, Oregon, Pennsylvania, and Wyoming. Three other death penalty states—Arkansas, Nebraska, and Ohio—have not carried out an execution in the past five years. The reasons why states retain the death penalty but don't use it are quite varied. Some states stop executing because of the difficulty of obtaining the drugs needed to carry out lethal injection or problems they've encountered in the administration of capital punishment. In other states, governors have declared a moratorium on executions. Still others seem disinclined to go forward with executions but have not mustered the political momentum to take the death penalty off the books. For example, Kansas has not executed anyone in almost 50 years; Wyoming has not done so since 1992. Kentucky carried out its last execution in November 2008 when Marco Allen Chapman was put to death for the gruesome murder of two children and the rape of their mother. All told, the Bluegrass State has executed only three people in the past half-century. Its death penalty history dates back to 1780, before it was granted statehood, when it carried out its first judicially authorized execution. Since then, Kentucky has gone on to set the record for the most executions in a single day. On July 13, 1928, it used the electric chair to put seven men to death, one after the other. Eight years later, it was the site of this nation's last public execution. In 1998, though, the state became the first to enact a Racial Justice Act. That act authorizes judges in capital cases to consider whether racial bias played a role in any decision to seek, or impose, the death penalty. Kentucky has not carried out an execution in more than a decade because of problems with its lethal injection protocol and various legal challenges to it. The DPIC reports that 'in 2006, death-sentenced prisoners filed a lawsuit alleging the execution protocol had not followed the proper administrative rulemaking process.' Since then, legal challenges have focused on the state's 'failure to provide a single-drug lethal injection option, inadequate protections against executing people with intellectual disability, and inadequate protections against executing those considered insane.' In 2019, a judge found the state's execution protocol to be 'unconstitutional and invalid,' and issued an injunction. But that did not stop Kentucky's Republican Attorney General Russell Coleman from calling on the governor last month to set an execution date for Baze. Coleman has been fighting to restart executions since he took office. His request put the progressive governor in a difficult spot in deep-red Kentucky. But Beshear held firm and kept his state in the group of death penalty swing states. He told the AG that he would not authorize Baze's execution because of continuing problems and unresolved legal issues with the state's execution protocol. As recently as April of this year, a Kentucky trial judge found that the state still had not fixed those problems. In response to Coleman's request, the governor would not jump the gun just to score political points. He pointed out that Kentucky 'does not currently have, nor can it obtain, the drugs necessary to carry out lethal injection executions.' So, Kentucky remains a place with 25 men on death row. The last death sentence handed down in the state was in 2014. States that move from the group that has not executed anyone in a long time to actually executing set an unfortunate example for other swing states that may encourage them to follow suit. We know that imitation is an important mechanism for the spread of policies or state actions, and this is as true in the realm of the death penalty as in any other area. As I wrote previously, 'Political leaders in one place scan the horizon looking to other places to see [what is happening] and to learn what works and what doesn't. The federal system provides the framework within which this learning and borrowing can occur.' That neighboring Indiana recently broke from the group of death penalty swing states after having not carried out an execution in 15 years makes Beshear's refusal to issue a death warrant all the more significant. It helps avoid a kind of domino effect involving other swing states, including Ohio to the north and Pennsylvania to the northeast. Beshear is an example of a political leader for whom the abstract belief that some people may deserve death as a punishment for their crimes gives way to a realistic assessment of the way the death penalty works, or does not work, in practice. It is that assessment that has fueled the substantial progress that abolitionists have made in changing the national conversation about capital punishment. For his refusal to let Kentucky restart what the late Supreme Court Justice Harry Blackmun once called 'the machinery of death' and for the political courage it took to do that, Andy Beshear may rightly be called an anti–death penalty hero. No Firefighter Is Surprised by What Just Happened in Idaho

On Sunday, 20-year-old Wess Roley, it's alleged, started a wildfire near Coeur d'Alene, Idaho, then lay in wait for firefighters to respond. When they did, he apparently opened fire, killing Kootenai County Fire and Rescue Chief Frank Harwood and Coeur d'Alene Fire Department Battalion Chief John Morrison. He also critically wounded Coeur d'Alene Fire Department engineer David Tysdal. Roley was found dead, with a shotgun by his side, later that day. The attack dominated headlines, becoming a global story and immediately sparking political tribal skirmishes on social media. The enormous interest makes sense. It's a horrible tragedy. We expect this kind of thing when it comes to police officers or other professionals for whom violence is a tool of the trade. Hearing that other crisis responders, especially firefighters, who are unarmed and there only to help, have come under fire could be shocking. But not to me, and not, I suspect, to other firefighters. Last year, almost to the day, I gathered together in a sweltering high school auditorium with about 50 firefighters, EMTs, and a small cadre of cops to undergo rescue task force training, which focuses on how civilian personnel, like firefighters, can partner with armed law enforcement to render critical aid to victims in a mass-casualty incident. The training was highly effective, emphasizing command and control, triage, trauma life support, and casualty evacuation. It lasted just a few hours and was packed with critical information, so I tried to pay close attention. I'll admit that I did have to put in some effort. Because, for the most part, I'd already been through it when I took Tactical Combat Casualty Care training before deploying to Iraq in 2007. While tweaked somewhat to deal with a domestic incident (such as dealing with distraught parents during a school shooting), the Venn diagram for the two trainings was almost a circle. Indeed, the idea that responders to shooting incidents, whether armed or unarmed, should undergo TCCC training is an element of the 2013 Hartford Consensus. This was a kind of national throwing up of the hands that accepted that shootings could not be stopped, and shifted focus to a more effective response, recommending that responders adopt a tripartite mission when time is of the essence: 1) Stop the killing, 2) stop the dying, and 3) save as many as you can. The Hartford Consensus contains elements of a variety of mass casualty programs, including Federal Emergency Management Agency, emergency medical services protocols, advanced trauma life support, Stop the Bleed, and Tactical Emergency Casualty Care, the civilian equivalent of TCCC. The protocols of the instruction were so eerily similar to my Iraq pre-deployment training as to evoke intense déjà vu, and not just in terms of the triage discussion—the brutal calculus wherein first responders make the impossible decision to focus overstretched resources on those who are most likely to be saved, with the tacit understanding that there are those who will have to wait, perhaps interminably, for help. I also recognized the trauma life support measures, from tourniquet application, to the instruction in how to correctly vent a sucking chest wound, to the direction to use an elbow, shoulder, or knee to apply pressure to a convex surface. We covered wound packing (stuffing the hole with the Curlex rolled gauze we habitually carried in Iraq for that purpose in the hopes of stopping bleeding), dealing with clotting powder, and stabilizing victims for transport. But the most striking commonality was the way this training taught unarmed first responders to move with armed operators in the 'warm zone,' an area where the active shooter was not immediately present but where a shooting threat could still manifest. Rescue task force guidance stridently reinforced the lesson that unarmed civilian firefighters like me would be required to move in the warm zone to assist with all of the duties required above, necessarily placing us at risk of … well … getting shot. As a hedge against this possibility, law enforcement officers would be assigned to our contact team with the duty of protecting us and engaging any suspects who opened fire. As a targeting officer (a kind of tactical intelligence analyst) in Iraq, I was armed, but using that weapon was not my job. I carried it as a last resort. Instead, I relied on the 'hard operators' in my team to keep me safe, knowing that if they fell, I had at least a means of holing up and shooting it out with the enemy until the quick reaction force could extract me. Much of the training I received before deploying to Iraq centered on how I could move and integrate with hard operators in my team, staying out of their way until I was needed. This instruction reflects the reality of rising levels of violence directed at firefighters. There are the instances when we have to respond to active shooter incidents, but also, there are the times people shoot at or assault us, as happened in Coeur d'Alene. In 2023 Drexel University's Center for Firefighter Injury Research and Safety Trends noted a 69 percent increase in assaults on firefighters from 2021 to 2022 (from 350 to 593). Many of these incidents occur during medical calls, rather than fire responses. And this number may be an undercount, as FIRST looked only at those incidents reported in the media. I can personally attest that in the hypermasculine and stoic culture of the fire service, a minor assault that didn't result in injury or generate media attention could easily go unremarked on. Indeed, in the District of Columbia in 2023, the firefighters union complained of an increase in assaults against firefighters, describing the attacks as occurring 'fairly often.' The problem isn't confined to the United States. Three-quarters of German firefighters experienced some form of public violence during a response as of February of this year. A recent assault on a Canadian firefighter prompted changes to the criminal code to include firefighters and emergency medical services, and a small town in British Columbia authorized 15,000 Canadian dollars to purchase body armor for firefighters after an attack. While the impact of warfare is obviously a separate scenario, I would be remiss not to note the terrible toll Russia's invasion of Ukraine is taking on European firefighters. Numbers from the U.K. show that the figures are even worse for EMS responders, with whom firefighters usually work closely. The critical question is: why? The answer is complex, evolving, and desperately in need of attention. Spiraling distrust of institutions is an obvious culprit, and the tight bond between fire and police services, who often share resources, means that tensions in the rapport between the public and police are reflected on anyone showing up to a crisis with a uniform on. Then there's the increase in mental health–related calls, which frequently put firefighters in situations in which they are dealing with potentially unstable and reactive individuals like Roley, with the corresponding potential for violent outcomes. But the bottom line is that we don't know why this is happening, only that it is. The American fire service is largely dependent on volunteers and is already under increasing stress from climate change, a decline in volunteerism, and shifting technological demands. Violence against firefighters will only make this worse and may affect the decisionmaking of the people on which the entire system depends. I'm not getting paid for this—why am I risking my life? is a question Americans contemplating volunteering may be forgiven for asking. Given the trends, it's a question for which we owe them an answer. The time for formal, funded, and organized study of the reasons for violence against crisis responders is now.

Rather, the evidence that Suri had been targeted over his First Amendment-protected speech — and that the administration had intended to deport him quickly, with minimal due process — warranted the judge's intervention, the 4th Circuit panel ruled. Suri, a native of India who was studying and teaching at Georgetown under a student visa, was arrested amid a crackdown by the Trump administration on foreign academics residing in the United States who had expressed support for Palestinian causes or participated in pro-Palestinian or anti-Israel protests. Secretary of State Marco Rubio revoked visas for many of them, igniting quick deportation proceedings, claiming their activism had veered into antisemitism — claims the targeted students and researchers have denied. Rubio's determinations have met pointed condemnations in federal courts, where judges have described them as an unconstitutional attack on First Amendment-protected speech. And the 4th Circuit panel noted that the Trump administration largely declined to challenge that conclusion, instead arguing that federal courts simply didn't have authority to hear the cases at all. There were warning signs, however, for Suri's camp. The lone dissenter on the appeals panel, Judge J. Harvie Wilkinson III, contended that Suri's race to a Virginia federal court gave short shrift to the parallel immigration and deportation proceedings. Wilkinson, a Reagan appointee, worried that the intensifying rush by deportees to seek relief from federal courts was quickly becoming a way to frustrate immigration proceedings meant to be largely shielded from judicial review. Allowing Suri's case to proceed in federal court and immigration court 'would presage a perennial clash of rulings and orders between two different sets of federal tribunals,' Wilkinson wrote. Wilkinson predicted 'severe systemic damage' if immigration detainees are allowed to pursue legal challenges outside the immigration-court process. But the appeals court's majority called Wilkinson's concern 'speculative' and said the dangers of parallel court cases paled compared to the risks of unwarranted and illegal detentions of immigrants. 'We cannot so easily consign an individual's liberty to the concerns of bureaucratic tidiness. The Constitution does not yield to administrative convenience, and due process is not suspended merely because two courts may be asked similar questions,' Wynn wrote. 'Our courts should not become sanctuaries for efficiency at the expense of justice.' The Trump administration could ask the full bench of the 4th Circuit to take up the issue or appeal to the Supreme Court.
