
Appeals court acquits man, 66, of murdering disabled stepsister-in-law
The three-member panel, comprising Justices Datuk Hashim Hamzah, Datuk Mohamed Zaini Mazlan and Datuk Noorin Badaruddin, unanimously allowed Muhammad Johari Ng Abdullah's appeal against the High Court's decision delivered in January last year.
Delivering the court's decision, Justice Hashim held that the circumstantial evidence adduced at trial was insufficient to sustain a conviction.
'Therefore, we find the conviction to be unsafe. As such, the conviction and sentence are set aside, and the appellant's (Muhammad Johari's) appeal is allowed,' he said.
Following the decision, Muhammad Johari, 66, expressed his gratitude to the panel of judges.
Muhammad Johari, a former security guard, was initially sentenced to death by the High Court for the murder of 26-year-old Nor Izzati Ghazali, who had dwarfism.
The offence was alleged to have taken place at an apartment in Villa Apartment, Jalan Temenggong 19, Off Jalan Sungai Jati, Klang, Selangor, at 2 pm on Feb 19, 2019.
During today's proceedings, Muhammad Johari's counsel, Hafizuddin Salehuddin, argued that the trial judge had erred in failing to consider the reasonable possibility of another individual, namely, the deceased's stepsister, being involved in the commission of the offence.
'There is no irresistible conclusion that the appellant was the one who caused the death of the deceased. We respectfully request the court to acquit and discharge him,' said Hafizuddin, who was assisted by Hilmi Zawawi.
Deputy public prosecutor Faizal @ Amrin Noor Hadi, however, asserted that the trial judge had not erred in his findings and urged the Court of Appeal to uphold the conviction and sentence.
According to the case facts, a neighbour stated in a police report that the deceased had previously complained to him and his wife about being physically assaulted and abused by the appellant.
A post-mortem examination revealed 24 clusters of injuries distributed across the deceased's entire body. — Bernama

Cops hunt couple who abandoned car after it plunged into Langat river
KUALA LUMPUR, July 9 — Police are tracking down a married couple who fled after the vehicle driven by one of them plunged into the Langat River in Hulu Langat earlier today. Kajang District Police chief ACP Naazron Abdul Yusof said the police received a report at 9.30am from a member of the public that a car had fallen into the river at Jalan Kuari Sungai Long. According to Naazron, eyewitnesses living near the area reported hearing a loud noise from the direction of the river around 9am and saw a man and a woman exiting the vehicle before fleeing the scene. 'Further inspection by police, with the assistance of the Fire and Rescue Department, confirmed that no individuals were inside the vehicle when it was recovered, and no casualties were reported,' he said in a statement yesterday. He said police had traced the vehicle's owner, who revealed that the car had been rented to a man and later borrowed by the couple involved before the incident occurred. Search underway in Miri for fisherman feared attacked by crocodile
MIRI, July 9 — A search and rescue (SAR) operation will resume this morning for a 58-year-old fisherman who is feared to have been attacked and dragged away by a crocodile yesterday afternoon. Karim Osman was last known to have been fishing alone by the riverbank near Kampung Pandam in Limbang. According to a police report filed at the Limbang District Police headquarters, only Karim's fishing gear and personal belongings were found at the scene. The Sarawak Fire and Rescue Department (Bomba) Operations Centre (PGO) said it received a distress call from the police at 3.13pm and immediately activated a SAR operation. 'The SAR team from the Limbang fire station arrived at the location around 4.30pm and began their search approximately 1km downstream from where the victim is believed to have been attacked,' Bomba said in a statement. 'During the operation, a crocodile was seen surfacing momentarily with what appeared to be a human body in its jaws.' The operation had to be called off at 6.17pm due to fading daylight and safety concerns. On Monday night, a 40-year-old man narrowly escaped a crocodile attack at Kampung Telahak in Limbang, when the reptile bit into a pail, narrowly missing him. The man, who had gone to the Limbang River to collect water for his family due to a five-day water supply interruption, said the incident occurred at around 10pm as he and his family were at the riverbank to bathe and wash dishes. The incident raised alarm among villagers over the increasing crocodile population in the area, located about 43km from Limbang town. — The Borneo Post
