Bengaluru: Karnataka high court has ruled that the insurance company must cover compensation for an accident involving a relief or spare vehicle used following the breakdown of a scheduled bus.
The court stated that such use doesn't constitute a fundamental breach of permit conditions exempting the insurer from liability.
The court's decision came after it allowed appeals filed by two victims and the bus owner in connection with an accident that occurred on Jan 21, 2014. At approximately 11.45am, Ganesh and Basavaraj were travelling on a motorcycle from Mudur to Haveri. Near the sugar factory in Sangur village, a high-speed private bus collided with the motorcycle, causing both riders to fall and sustain grievous injuries.
The duo subsequently filed petitions seeking compensation.
On Jan 24, 2017, the motor accident claims tribunal in Haveri awarded compensation, placing liability on the bus owner, KM Altaf Hussain, on the grounds that the bus had deviated from its permitted route, violating permit conditions. Ganesh received Rs 3,71,030, and Basavaraj was awarded Rs 1,27,250.
The claimants appealed for increased compensation, while Altaf appealed, arguing that the insurance company should settle the compensation.

He contended that although the bus had a permit only from Shivamogga to Hangal, it travelled beyond Hangal to Haveri and was being used as a relief vehicle when the accident occurred.
Justice Hanchate Sanjeevkumar, after reviewing the materials on record, noted that the vehicle was employed as a relief vehicle under compelling circumstances, which did not amount to a fundamental breach of conditions. He determined that the tribunal had erred by not exempting the case as per Rule 57 of the Karnataka Motor Vehicles Rules 1989, given the route deviation was under compelling circumstances.
Allowing the claimants' appeals, the judge also increased the compensation payable to Ganesh to Rs 7,15,550, considering the severity of his injuries. It awarded Basavaraj Rs 2,24,810. The compensation must be paid by United Insurance Company Limited, the insurer of the vehicle.

Nashik: Officials of the crime branch unit 1 of the city police commissionerate arrested Jagatpal Lallar, a resident of Rajasthan, on charges of stealing Rs 10 lakh from his employer. On June 11, Lallar, who worked as a driver for the complainant, stole Rs 10 lakh and the employer's motorcycle in the Nashik Road area before fleeing the city. Following the complaint, police registered a case under section 306 of the BNS for theft, which was investigated by crime branch unit 1. During the investigation, the police attempted to locate the suspects along the Rajasthan, Haryana, and Punjab borders but were unsuccessful. They then expanded their search to Maharashtra, where they received a tip-off that Lallar and his associate were approaching Nashik from Chalisgaon on the stolen motorcycle. Senior inspector Madhukar Kurd, of the crime branch, set a trap at Mangalur Phata in Chandwad, leading to the arrest of the duo. The suspects, Jagatpal Lallar, 24, and Sushil Rao, 22, both reside in Shivaji Nagar, Takli Road area in Nashik city. They confessed to the crime, and the police recovered the Rs 10 lakh and the stolen motorcycle from them. Silchar: A Cachar court sentenced a man to eight years in prison and awarded three-month jail terms to eight others in the Katigorah gang attack case that led to the death of one person and left several others injured sixteen years ago. The verdict was delivered by the fast-track court of additional district and sessions judge Bankim Sharma on Monday in connection with the incident that took place on Aug 26, 2009, at Nij Katigorah in Cachar. According to the prosecution, Sharif Uddin Barbhuiya (52) and eight others stormed the residence of their neighbour Sahir Ahmed Barbhuiya and attacked Sahir's family with weapons and sticks. Three members of the family — Mokbul Ahmed, Mamon Ahmed, and Faruk Ahmed — sustained serious injuries in the attack. Neighbours Nur Ahmed, Abdul Kuddus, and Abdul Salam, who tried to intervene, were also assaulted. In his FIR, Sahir alleged that the attackers looted Rs 20,000 in cash and gold ornaments from the house during the assault. One of the injured, Abdul Kuddus, later succumbed to his injuries. Chennai, July 1 (UNI) Six people, including a woman, were charred to death and five others critically injured in a major explosion at a fireworks manufacturing factory at Chinnakamanpatti near Sattur town in Virudhunagar district, about 540-km south of city, today. Police and Revenue officials identified the deceased as R Mahalingam (55), C Sellapandiyan, Lakshmi Karupasamy, R Ramamurthy (38), K Ramajayam (27) and G Vairamani (32). The injured, including a woman, have been admitted to the Sivakasi Government Hospital and the Madurai Rajaji Government Hospital. According to sources, the deceased as well as the injured were engaged in cracker manufacturing works in the morning when the explosion occurred at the private fireworks factory. Four concrete roofed rooms of the factory were heavily damaged, and smoke engulfed the surrounding area. On receiving information of the incident, Fire and Rescue Service Personnel rushed to the spot and put out the fire and retrieved the bodies of the victims and rescued the injured stuck under the debris. The Sattur Town police have registered a case and have arrested the foreman of the factory for further investigation. Expressing shock and grief over the tragic deaths in the explosion, Chief Minister M K Stalin has offered his condolences to the bereaved. He also announced a solatium of Rs four lakh each to families of the deceased and Rs one lakh each to the injured. The Virudhunagar district, a backward rain-shadow region, in southern Tamil Nadu is a hub of fireworks manufacturing units and frequent mishaps claim a heavy toll on human lives.
