HC Pulls Up Spl Secy (Power) for flouting tariff incentive order
Shimla, Aug 4(UNI) Himachal Pradesh High Court has come down heavily on the Special Secretary (Power), Arindam Chaudhary, for willfully disobeying a previous court order in the matter of M/s Kundlas Loh Udyog vs. Arindam Chaudhary (COPC No. 600 of 2025). Justice Sandeep Sharma, presiding over the contempt petition, observed that the respondent had attempted to 'overreach the judgment' and failed to comply with the court's specific direction to issue a notification granting industrial tariff incentives as per Clause 16(A) of the 2019 Industrial Policy. In its earlier judgment, the Division Bench of the High Court had ordered the Department of MPP & Power to issue an enabling notification granting power tariff incentives to the petitioner, a metal-based industrial unit, from the date of its commercial production. The department was given a four-week deadline. However, even after more than three months, no action had been taken. The Court noted that the reply submitted by the Special Secretary claimed that retrospective revision of tariff falls under the domain of the Himachal Pradesh Electricity Regulatory Commission (HPERC) and not the Power Department. Justice Sharma, however, found this argument untenable, stating that this line of reasoning had not been presented before the Division Bench earlier, where the government had instead admitted to issuing the notification. The Court further cited the 2016 Supreme Court ruling in Manuelsons Hotels Pvt. Ltd. vs. State of Kerala, which held that an enabling notification is a ministerial act, and where policy promises exist, the notification is deemed to have been issued. Taking strong exception to the change in stance, Justice Sharma held that the respondent was prima facie in contempt of court. However, on the request of the Additional Advocate General, the Court granted a final one-week extension to comply with the directive. The matter would now be listed on August 6, and the respondent has been directed to remain present in court to explain why he should not be punished for intentionally and willfully disobeying the Court's order. This is another case in the state which highlights a broader issue of delay and bureaucratic reluctance in implementing industrial policy benefits already adjudicated by the judiciary. Rajasthan BJP to observe Aug 14 as 'Horror of Partition Day'
Jaipur, Aug 3 (UNI) The Rajasthan unit of BJP has decided to observe August 14 as Horror of Partition Day (Vibhajan Vibhishika Smriti Divas) to condemn the catastrophe of the partition, the party state president Madan Rathore said on Sunday. The move of partition that was enforced on August 14, 1947, caused traumatic sufferings to numerous citizens as it unsettled lakhs of the people, Rathore said. "Many citizens lost everything they owned and forced to live like refugees. Many people even lost their lives in violent clashes that had broken in aftermath of the partition", he said. "Recalling the suffering - sacrifices of those numerous Indians, we will pay rich tributes to all of those patriots and will also reaffirm our resolve for working to keep intact the national unity and integrity and strengthen (communal) harmony and brotherhood", Rathore, a sitting Rajya Sabha MP said. "For next day the Independence Day August 15, our workers will try to provide the tricolour to all households so that every family can hoist the national flag for making success our "Har Ghar Tiranga" campaign," he added. "The BJP workers would reach out to people of all sects and strata irrespective of their faith, ideology or the party allegiance, for providing the flags to them and appeal to them to unfurl the tricolour rising above party-lines," the BJP state chief minister said. Farmers' leader takes out silent march demanding Mahadevi elephant be brought back
Kolhapur, Aug 3 (UNI) Swabhimani Shetkari Sanghatana (SSS) national president and former MP Raju Shetty today took out a 45 KM long 'Atmaclesh' (masochist) Yatra silent March from Nandani to Kolhapur district collector office, demanding Madhuri alias the Mahadevi elephant be brought back. The pachyderm has shifted to Radhe Krishna Temple Elephant Welfare Trust Jamnagar (Vantara sanctuary). Thousands of peoples along with women from all parts of the district, gathered at Sri Chakreshwar temple in Nadani village of this district in the early morning at 0500 hours and began their Silent March (Muk Morcha) towards Kolhapur city, which will reached around at 1600 hours this evening with taking boards in hands with slogans as 'Aamchi Madhuri Parat Dhya"(Return our Madhuri). Shetty, while talking with reporters in March, said that Vantara sanctuary misguided supreme court with submitting false report on the health of Mahadevi elephant. Even supreme court directed to shift the elephant to Jamnagar, it was not final and president of India has a right to change this judgement. A delegation comprising women, will meet district collector Amol Yedge to hand over a memorandum demanding to bring back Mahadevi elephant and also a letter addressed to president Droupadi Murmu to interfere and changed supreme court's direction.
