Elderly man charged with raping girl, mother claims trial to aiding the act

KUALA LUMPUR: A nasi lemak seller claimed trial at the Ampang Sessions Court today to raping his girlfriend's 12-year-old daughter in mid-last year.
The 61-year-old, who was charged with committing the offence at about 4pm in a house in Taman Seraya last year, entered his plea before judge Norshila Kamaruddin.
"I understand (the charge). I plead not guilty. I did not do it," he said.
Standing in the dock, the accused had several times attempted to explain himself to the court.
He told the judge that although he was accused of rape, no DNA samples were taken from him while in detention.
He was, however, stopped from speaking further by the judge, who said he would have the chance to explain during the trial.
The charge, under Section 375(g) of the Penal Code and punishable under Section 376(1), carries a maximum 20-year jail term and whipping upon conviction.
In the same proceedings, the girl's mother pleaded not guilty to conspiring with the first accused to allow him to rape her daughter.
The 37-year-old security guard allegedly committed the offence at the same time and place.
The charge, under Section 109 of the same code and read with Section 375(g) and punishable under Section 376(1), carries a maximum 20-year jail term and whipping upon conviction.
Both accused did not have legal representation.
Deputy public prosecutor Muhammad Hairuliqram Hairuddin did not offer bail for either accused.
"The first accused has ties with the second accused (the mother), and the victim is her daughter.
"We are not offering any bail as there could be potential harassment against the victim.
"As for the mother, she lives with the victim, and we also worry that she, too, could be harassed.
"Currently, the victim is living with an aunt, separately from her mother," he said.
The judge also asked both accused if there was anyone in court who would bail them out, to which they replied no.
Norshila did not fix bail and told both accused to appoint lawyers. The court set Aug 7 for mention.
On June 29, Ampang police chief Assistant Commissioner Mohd Azam Ismail said an elderly man and his girlfriend were arrested for allegedly raping her daughter, who is now 13.
He had said investigations showed that the man had raped the girl and it was witnessed by the mother.
Azam had said victim had been allegedly raped by the man before and lodged a police report after hearing a conversation which revealed that the boyfriend intended to rape her, and the mother allowed it.
They were subsequently remanded for seven days for investigations.

The case sparked public outrage among the influencer's followers and frustration among rescue personnel, including the Water Rescue Team (PPDA), whose divers carried out more than 10 high-risk dives in the murky river in search of the two men. Kota Kinabalu: Two men were jailed five months by the Magistrate's Court here for stealing from a rented room. Md Shidee Jubri, 35, and Md Yusrain Yusof, 42, pleaded guilty before Magistrate Marilyn Kelvin to stealing one unit of electric fan and two multi-purpose cookers belonging to Nur Ain Lo, at 4pm on July 11, in a unit at Padimas Point, Penampang. The duo was jointly charged under Section 380 of the Penal Code, which carries a jail term of up to 10 years and liability of a fine, on conviction. The facts of the case, as presented by the prosecution, stated that the complainant discovered the door to her rented room wide open on the said day, with her belongings in disarray. Further checks revealed several of her items and documents belonging to her sister were missing. Acting on intelligence, a team from the Penampang District Police Headquarters arrested both Shidee and Yusrain at 1.20pm on July 17 at a car park in front of ITCC Mall, Penampang, in connection with the theft. Investigations confirmed that the duo had broken into the complainant's room and stolen the said items, which were later recovered from their rented room. The duo were ordered to serve the sentence from the date of their arrest. In a separate case, a woman was fined RM1,300 or jailed one month for having gambling paraphernalia. Nur Shahirah Syamin pleaded guilty to buying two unlicensed 'Wah Hui' lottery tickets at 2.35pm on July 9 at Indah Permai, Jalan Sepanggar. The court found from the facts of the case that a police team conducted surveillance at the location and observed suspected illegal lottery activities before approaching a woman and uncovering paraphernalia related to the unlicensed Wah Hui lottery. The woman, later identified as Nur was arrested, and the gambling materials, including RM40 in cash, were seized from her. The court ordered the seized cash money to be forfeited as government revenue.
