N.W.T. appeal court denies former Denesoline CEO's challenge of ruling against him

The N.W.T. Court of Appeal has dismissed an application from former Denesoline CEO Ron Barlas.
Barlas had sought to appeal an N.W.T. Supreme Court ruling against him, which ordered, among other things, his removal as CEO of Łutsel K'e Dene First Nation's (LKDFN) business arm, Denesoline Corporation. Supreme Court Justice Karan Shaner found Barlas had used his authority improperly to enrich himself and his family.
In a decision Friday, Court of Appeal justices Jack Watson, Jolaine Antonio and Karen Wenkebach wrote that neither of the grounds Barlas cited for appeal — whether Shaner had given him and his wife Zeba a fair hearing, and whether the remedies granted to LKDFN were justified — had merit.
The decision comes as the latest development in the wide-ranging civil lawsuit LKDFN filed against Barlas, who for years ran Denesoline Corporation. The First Nation accused him of diverting nearly $12 million from its companies for his own gain.
The decision states Barlas objected to the fact Shaner's decision relied on affidavits, questioning, documents and lawyers' oral presentations, and felt she should have ordered a trial.
"Barlas ... disputes various findings by [Shaner] about discreditable conduct that she found was revealed by his own words and the documentary record," the decision noted.
The Court of Appeal found Shaner canvassed similar cases from other jurisdictions of Canada to help her come to a decision. The court wrote that the suggestion that Shaner's decision to not order a trial led to unfairness is "not an accurate way of looking at what happened here."
It cited case law where a judge observed that the ultimate question in a fairness test isn't whether a decision was "the" fair one, but rather "a" fair one.
"The appellants have no basis to claim that they did not have fair notice or opportunity to present evidence and argument," the court wrote.
The Court of Appeal wrote that Shaner's findings, including her characterization of Barlas' actions and attitude, were "amply supported by the evidence."

The rap mogul's former girlfriend, Virginia "Gina" Huynh, who identified herself as the previously unnamed 'Victim 3' in his sex trafficking and racketeering conspiracy trial, penned a letter to New York Judge Arun Subramanian supporting Combs' request for bail ahead of his Oct. 3 sentencing. In Huynh's letter—submitted to the courts Aug. 3 and obtained by E! News—she detailed knowing Combs for 'many years in both a personal and professional capacity,' and that she will use her knowledge of him 'a father, a family man and a businessman' to share 'observations about his character and to respectfully request that the Court permit his release on bond while the case proceeds.' While describing her relationship with Combs as 'not always perfect,' she wrote that the rapper 'was willing to acknowledge his mistakes and make better decisions in the future.' More from E! 'By the time our relationship ended, he embodied an energy of love, patience and gentleness that was markedly different from his past behavior. To my knowledge, he has not been violent for many years, and he has been committed to being a father first.' She also pointed to the trial being Combs' first criminal case and that 'throughout the investigation and proceedings he has been cooperative, respectful and compliant.' She added she does not view the 55-year-old—who is dad to seven children—as a danger to either herself 'or the community,' noting, 'He has substantial ties to his family and community, including children who depend on him for emotional and financial support.' She added that she believes Combs would adhere 'to all conditions imposed and will not jeopardize his freedom or the well-being of his family,' and that allowing him to be at home would 'support the healing process for all involved.' E! News has reached out to Combs' legal team as well as reps for Huynh for comment but has not yet heard back. While Huynh was originally supposed to be called as a witness in Combs' trial, in the days before it began the prosecution shared it was having trouble to get in touch with Victim 3 or her attorneys. She ultimately didn't testify. At the conclusion of the seven-week trial, a New York jury found the rapper guilty of transportation to engage in prostitution but acquitted him on sex trafficking and racketeering charges. He could face up to 20 years in prison for the convictions, though his counsel is seeking 21 to 27 months while prosecutors are asking for 51 to 63 months (approximately four to five years), per NBC News. On July 2, Judge Subramanian confirmed Combs would remain behind bars until his October sentencing hearing, though Combs' legal team submitted another request for bail on July 29—one opposed by the prosecution. In his July 2 ruling, Subramanian cited Combs' "years-long pattern of violence" as a reason for him to remain behind bars, adding that he "continues to be a danger to others and unable to follow the law." Quebec environment ministry fines Northvolt for polluted run-off water

MONTREAL — Quebec's Environment Department has fined Northvolt for allegedly releasing wastewater with high levels of aluminum and chromium at its Montérégie region site. Provincial officials issued the $10,000 penalty in June, saying the wastewater allegedly exceeded legal limits of the metals. The department says the North American branch of the Swedish battery manufacturer had released the run-off water at its site in December. The future of the proposed electric vehicle battery plant on the site is up in the air, after its parent company filed for bankruptcy in Sweden. This is the third time the Quebec ministry has penalized the company. It previously fined Northvolt for allegedly clearing a marsh without authorization and for allegedly failing to install barriers needed to protect a nearby wetland. Police arrest man wanted on Canada-wide warrant after deadly Pickering house fire

PICKERING — Police say a man wanted for murder on a Canada-wide warrant after a house fire in Pickering, Ont., nearly two months ago has been arrested. Durham police responded to the fire on June 11 at around 2:20 p.m. and found a 69-year-old woman dead inside the home. Investigators ruled the death a homicide a week later and identified two suspects. Police say they arrested a 34-year-old man on Friday and he has been charged with second-degree murder. They also arrested a 34-year-old woman in June and charged her with accessory after the fact to murder. Police say a bail hearing has already been held for the man.
