Supreme Court
on Tuesday dismissed a petition filed by National Investigation Agency (
NIA
) seeking to cancel bails of four persons who were arrested on allegations of working overground for the banned Communist Party of India (Maoist).
A division bench of the Supreme Court said that they did not find any ground to interfere with the orders of Telangana high court, which granted conditional bail to petitioners P Nageswar Rao, T Arogyam, B Mahender and V Umashankar in March 2024.
The four were arrested by NIA in 2023 on allegations of supplying explosives, drones, and other equipment to the Maoists for attacking security forces. They were initially arrested by the Cherla police of Bhadradri Kothagudem district, following which NIA took over the investigation.

The special court for NIA cases at Nampally dismissed their bail petition in Dec 2023, following which they moved the high court, which granted them conditional bail.
Subsequently, the agency approached high court for dismissing their bail. After hearing arguments from both sides, the Supreme Court dismissed NIA's appeal.

Assam Police Arrest ULFA-I Linkman
The Assam Police has arrested a man for allegedly working as a linkman for the banned militant group ULFA-I, officials said on Wednesday. The accused has been identified as Supritam Kaur and taken into custody by security personnel from Dimapur. Police say the accused had actively provided vital information to ULFA-I and has links with the banned NSCN group. A senior police official said, "Kaur has been actively involved in supplying key information to ULFA-I. He has links with another outlawed group NSCN also. The person has been interrogated to unearth further links with the banned outfits." Recently, the NIA arrested two more accused in connection with the recovery of an IED planted by the ULFA-I terror group at Dispur Last Gate, Guwahati, as part of a conspiracy to carry out multiple blasts in Assam on Independence Day in 2024. Bhargob Gogoi and Sumu Gogoi, both residents of Dibrugarh district of Assam, were involved in the conspiracy orchestrated by the proscribed terrorist organisation to strike terror and threaten the sovereignty, security, and integrity of the nation, said the National Investigation Agency (NIA). With their arrest, the total number of accused arrested in the conspiracy case has gone up to three. The NIA, which took over the investigation into the case from Dispur police in September last year, had last month charge-sheeted three accused in the case under various sections of the BNS, UA(P) Act and the Explosives Substance Act. The three charge-sheeted accused included Paresh Baruah alias Paresh Asom alias Kamruj Zaman Khan alias Nur-uz-Zaman alias Zaman Bhai alias Pradip alias Paban Baruah, chairman and SS Commander-in-Chief of the proscribed terrorist groups ULFA-I. The other two accused named in the charge sheet were Abhijit Gogoi alias Abhijeet Gogoi alias Aishang Asom alias Aishang alias Aishang Axom alias Rumel Asom alias Dhanajoy Moran and Jahnu Boruah alias Arnob Asom alias Huntu. Earlier in the month, ULFA-I claimed that its Eastern headquarters in Myanmar had been targeted by the Indian Army with drones in the early hours – a claim denied by the Army. The proscribed outfit in a press statement claimed that in these cross-border strikes, their 19 cadres were killed and another 19 were injured.

Delhi court grants custody parole to MP Engineer Rashid to attend Parliament
A Delhi court on Tuesday granted custody parole to jailed Lok Sabha MP Engineer Rashid from July 24 to August 4 to attend the Monsoon Session of Parliament. On the other hand, his interim bail plea was rejected. Rashid had argued in court that he should either be granted interim bail or permission to attend Parliament in custody, without payment of travel costs, as he was seeking to attend Parliament as his public duty and not for personal work. Additional Sessions Judge Chander Jit Singh, however, imposed travel costs on him. Rashid's lawyers are likely to challenge the order in Delhi High Court. Rashid had defeated National Conference leader Omar Abdullah in Baramulla by 2 lakh plus votes in the 2024 Lok Sabha polls. He has been lodged in Tihar jail since 2019 in an eight-year-old terror funding case. The National Investigation Agency (NIA) arrested Rashid on August 9, 2019, four days after the abrogation of Article 370 and the removal of Jammu and Kashmir's special status. The NIA's case is that Rashid used various public platforms to 'propagate the ideology of separatism and secessionism', and was closely associated with various terrorist organisations. The agency had also alleged that he wanted to 'legitimise' the United Jihad Council (UJC), a platform of anti-India militant groups in J-K. Charges were framed against Rashid in March 2022 under sections 120B (criminal conspiracy), 121 (waging war against the government), and 124A (sedition) of the Indian Penal Code and for offences relating to terrorist acts and terror funding under the Unlawful Activities (Prevention) Act (UAPA). However, Rashid has maintained that the NIA has only produced an old Facebook post and statements of two protected witnesses to implicate him. He has also argued that he has already been discharged under sections 20, 38, and 39 of the UAPA, which pertain to being part of a terrorist organisation and lending support to it.

SC refuses to hear plea challenging gag order in Dharamsthala case
The Supreme Court on Wednesday declined to hear a petition challenging a sweeping gag order that restrained media houses from reporting on matters related to the brother of Dharamadhikari D Veerendra Heggade of Dharamsthala in Karnataka. The gag order pertained to reports on alleged murder of women in Dharmasthala in the state's Dakshina Kannada district. The plea, filed against an ex parte interim order of a local court, questioned the legality of the directive which directed as many as 390 media houses to remove nearly 9,000 links and stories related to the Dharamsthala burial case. A bench comprising Chief Justice B R Gavai and Justices K Vinod Chandran and Joymalya Bagchi asked the petitioner as to why the high court had not been approached. The gag order was reportedly passed in a defamation suit filed by Harshendra Kumar, Secretary of Sri Manjunathaswamy Temple institutions, who highlighted the spread of allegedly false and defamatory content online, despite there being no specific allegations against him or the temple authorities in any FIR. Recently, Karnataka Home Minister G Parameshwara asserted that a thorough investigation must precede any conclusions regarding the alleged murder of women in Dharmasthala. Prior to this, the state government constituted a Special Investigation Team (SIT) to probe the allegations. The plea in the top court was filed by YouTube channel Third Eye against a Bengaluru court order restraining the publication of any defamatory content against Harshendra Kumar D, brother of Dharmasthala Dharmadhikari Veerendra Heggade, in relation to the Dharmasthala temple burial case.
