SC allows M3M Group plea for substitution of provisionally attached property

A bench of Justices P S Narasimha and R Mahadevan, however, said the substitution of the property would be subject to nine conditions as suggested by ED.
"We have heard Dr Abhishek Manu Singhvi, senior counsel appearing for the petitioner and considered the matter in detail. The petitioners, namely, M/s. M3M India Pvt. Ltd. and M/s. M3M India Infrastructure Pvt. Ltd. have also filed an affidavit agreeing to the conditions. While we allow the substitution of the property as indicated...the same shall be subject to the conditions...." the bench said.
The top court's order came on a plea filed by M3M Group challenging the Punjab & Haryana High Court's order refusing to substitute their provisionally attached property.
One of the conditions submitted by ED before the top court states that M3M Group should establish clear and marketable title along with undisputed ownership of the assets proposed for substitution, supported by verifiable documentary evidence, to the satisfaction of the court.
"The substituted assets must be free from all encumbrances, including mortgages, liens, pledges or any third-party claims or security interests and a certificate to this effect must be submitted by the petitioner. The petitioner must provide a notarised undertaking that the substituted property will not be sold, transferred, or otherwise alienated during the pendency of proceedings," the condition said.

Enforcement Directorate HYDERABAD: The Enforcement Directorate (ED), Hyderabad Unit, on Wednesday conducted searches at multiple locations linked to suspended HMDA official Shiva Balakrishna. The searches follow an ongoing investigation into alleged disproportionate assets unearthed by the Anti-Corruption Bureau (ACB). Shiva Balakrishna, a former planning officer with Hyderabad Metro Rail Limited (HMRL) and in-charge Secretary of Telangana Real Estate Regulatory Authority (RERA), was arrested by the ACB on January 25 in a case involving assets disproportionate to his known sources of income. The ED registered an Enforcement Case Information Report (ECIR) under the Prevention of Money Laundering Act (PMLA) and seized documents during the searches at the residences of Shiva Balakrishna and his brother Naveen Kumar at Rajendranagar and Chaitanyanagar, respectively. The agency is also investigating the alleged quid pro quo deals of Shiva Balakrishna with the top realtors in Hyderabad for granting permission for apartments, villa projects, and layouts. According to sources, top realtors in the city may also be questioned as part of the probe. The ED's action was based on the ACB's FIR, which revealed that Balakrishna had amassed over 200 acres of agricultural land, multiple open plots, and a villa, with the total market value estimated at ₹250 crore. The assets are spread across different districts in the state. During the ACB raid earlier this year, investigators seized key documents from Balakrishna's lavish duplex villa located in Aditya Fort View, Puppalaguda. Lack of ACB documents slows ED's investigation Meanwhile, ED officials have expressed concern over limited cooperation from the ACB in securing essential documents for their probe. Sources within the agency said that despite multiple requests, several relevant documents have not been shared, slowing down the investigation into possible money laundering angles connected to the disproportionate assets. The ED's fresh round of searches is expected to focus on tracing financial transactions, benami holdings, and potential violations under the Prevention of Money Laundering Act (PMLA).

The Enforcement Directorate (ED) on Wednesday said that it has arrested a chartered accountant, Anant Kumar Agarwal, in connection with the ongoing investigation into Rs 6,000-crore loan fraud case involving Concast Steel & Power Ltd (CSPL). Agarwal, who has been booked under the provisions of the Prevention of Money Laundering Act (PMLA), will be in ED's custody until July 5. He was arrested on June 25, the ED said. In a statement, the ED said Agarwal played a key role in laundering the proceeds of crime on behalf of former CMD of UCO Bank Subodh Kumar Goel over an extended period. 'Furthermore, Agarwal knowingly incorporated and operated a web of shell companies to facilitate the layering of illicit funds through fictitious financial transactions such as bogus unsecured loans and share capital in exchange for cash. Agarwal also received payments for these services. He also held key positions in companies which were directly involved in laundering operations and utilised such concerns for conversion of illicit funds. Such illicit funds were brought into the books of accounts as share capital and unsecured loans,' the central agency said. Goel was arrested on May 16 for allegedly 'playing a substantial role' in sanctioning loans of more than Rs 1,460 crore to CSPL, which turned into NPA (non-performing asset). The former CMD of UCO Bank, according to the ED, received illegal gratifications in the form of cash, immovable properties, luxury goods and services for sanctioning loans to CSPL. The ED said that it has conducted searches in the National Capital Region 'to investigate the role of various individuals engaged in extorting money from the persons against whom it had initiated investigation'. During the searches, cash, gold and various incriminating records and digital devices were seized, the ED said, adding further investigation is on.

The Surat Sub-Zonal Office of the Enforcement Directorate (ED) on Wednesday said that it has provisionally attached movable properties worth Rs 10.99 lakh of M/s Mobi Tech & Others, under the Prevention of Money Laundering Act (PMLA). The agency said it had initiated an investigation on the basis of an FIR registered by the CBI and ACB Gandhinagar against Milind Patel, the proprietor of M/s Mobi Tech and Others for alleged corruption and criminal conspiracy. The investigation, ED said, revealed that M/s Mobi Tech had availed loan amounting to Rs 5 crore from the erstwhile State Bank of Bikaner and Jaipur (now merged with State Bank of India) and then allegedly misappropriated these funds by diverting it to various entities, thereby causing a wrongful loss of Rs 3.12 crore to the erstwhile State Bank of Bikaner and Jaipur. 'It has been established during the investigation conducted by ED that M/s Celution Corporation, a partnership firm of Rishit Bharatkumar Shah, received Proceeds of Crime (POC) from M/s Mobi Tech. Accordingly movable property in the form of bank balance to the tune of Rs 10.99 lakh held in the bank account of Rishit Bharatkumar Shah has been attached,' the agency said in a statement. Earlier, a provisional attachment order to the tune of Rs 11 Lakh was also issued in this case. Further investigation is under progress.
