In his presentation titled 'Role of Alternative Dispute Resolution Methods in Managing Project Claims, Leading to Sustainable Outcomes,' Engr. Mokhtar delved into the complexities of construction projects, where the involvement of multiple stakeholders and high stakes often leads to disputes.
He emphasized that prompt and effective dispute resolution through methods like mediation, arbitration, conciliation, expert determination, and adjudication is essential to avoiding the lengthy and costly process of litigation.
In drafting contracts, Engr. Mokhtar reminded the industry professionals that they should include well-drafted arbitration clauses to avoid legal complications.
'If you are a professional or a contract engineer, or the one preparing a contract or a purchase order, as a technical person, don't think only about the technical aspect or the engineering aspect in that agreement that you are creating, but also consider the legal consequences that can help later on, when the dispute happened,' Engr. Mokhtar said.
He then urged the Filipino professionals in the engineering and architecture industry to decrease the legal knowledge gap by getting the appropriate certifications to effectively practice alternative dispute resolution methods.
The presentation concluded with a call for increased awareness of ADR methods among industry professionals, emphasizing that these approaches are essential for creating sustainable outcomes in large-scale projects.

PH eyes local ammunition production as part of stronger defense strategy with US
The Philippines is considering the establishment of an ammunition production facility in partnership with the United States. Philippine Ambassador to the US Jose Manuel 'Babe' Romualdez said the government is open to hosting such a facility, describing it as a strategic move that aligns both with national security goals and economic development. 'Obviously, we're open to that one, because it's a good way of being able to help a combination of both defense and economic cooperation between the Philippines and the United States,' Romualdez told members of the Philippine media delegation. 'So, setting up a production facility in the Philippines, would obviously be beneficial for us economically also because it will create a job, and it will obviously be a good hub for them to be able to produce what it requires for our defense,' he added. He added that several Filipino companies are already showing interest in joining a potential consortium should the plan move forward. The idea gained traction after the US House Committee on Appropriations, in a June 16 report, tasked the US Department of Defense to assess the viability of setting up a joint ammunition manufacturing and storage facility in Subic Bay. The facility would allow for forward deployment of munitions and critical materials like nitrocellulose and nitroglycerin.

PH, Micronesia strengthen labor ties with pact ensuring rights and protections for OFWs
The Philippines and the Federated States of Micronesia have signed a joint declaration of intent (JDI) to strengthen labor cooperation and ensure the protection and welfare of overseas Filipino workers (OFWs) in the Oceanian region. The agreement was signed by Department of Migrant Workers (DMW) Secretary Hans Leo Cacdac and Micronesia's Justice Secretary and Attorney General Leonito Bacalando Jr. According to the DMW, the JDI highlights both countries' commitment to fair, ethical, and sustainable labor practices. It guarantees labor rights and social protection for OFWs, including equal access to employment benefits and social security systems similar to those received by local workers in Micronesia. 'This is a great step forward, the signing. Filipino contributions are valuable to our nation's development,' said Bacalando. The agreement also paves the way for the deployment of more Filipino workers in Micronesia's key sectors such as construction, healthcare, education, and services. Skills certification and job matching will be facilitated through a partnership with the Technical Education and Skills Development Authority (TESDA). A total of 1,891 OFWs were deployed to Micronesia between 2015 and 2024. The declaration also includes provisions to strengthen cooperation in addressing irregular migration. Both countries committed to enhanced measures to combat illegal recruitment, human trafficking, migrant smuggling, and document fraud. 'We will continue working towards a full memorandum of understanding (MOU) that guarantees safe and fair employment for our OFWs,' Cacdac said in a statement.
