Court battle looms as SAPOA contests Cape Town's controversial budget

While the City of Cape Town (CoCT) is proudly touting its amended Hope Budget for 2025/26, the South African Property Owners Association (SAPOA) is taking legal action over the city's decision to link certain fixed charges to property values.
Even before being adopted in council, the city's budget has faced considerable criticism over its fixed charges, over which SAPOA will now be challenging in the Western Cape High Court.
In his founding affidavit, SAPOA CEO Nilesh 'Neil' Gopal said that the board resolved to take legal action seeking to challenge three items in the budget, namely the Cleaning Tariff, the Fixed Water Charge, and the Fixed Sanitation Charge.
They are hoping to have the budget declared unconstitutional and invalid.
'They contravene the applicable constitutional and national legislative framework applicable to the imposition of rates and the levying of tariffs for municipal services. Because they are linked to property values, the three items of the budget are in fact property rates imposed outside of the legislation which governs the imposition of such rates,' he said in papers.
Gopal argued that the three items are inconsistent with the Constitution.
SAPOA's membership currently comprises more than 90% of the country's commercial and retail property industry, including some of the largest property-owning companies in South Africa.
The properties owned by their membership include the V&A Waterfront (co-owned by Growthpoint), Canal Walk Shopping Centre (owned by Hyprop), Cape Gate Shopping Centre (owned by Hyprop), Table Bay Mall (owned by Hyprop), Tyger Valley Shopping Centre (co-owned by Pareto), Blue Route Mall (owned by Redefine), Gugulethu Square (owned by Vukile), Atlantis City Shopping Centre (owned by Vukile), Sable Square Shopping Centre (owned by Spear), and Cavendish Square (owned by Old Mutual).
In the court papers, they added that litigation was a last resort.
Gopal added that while they acknowledge the city's rebates that they offer, it mostly is to aid pensioners and isn't sufficient to offset the impact the tariffs will have on them.
'These reductions and rebates do not detract from the fact that the three items are unlawful and should not have been introduced in the first place: A reduction or a rebate cannot save a charge which was unlawfully imposed,' he said in his founding affidavit.
Gopal added that the continued rise in municipal costs has a significant detrimental effect on the costs of occupancy faced by tenants in commercial/retail properties.
'My point is that the systems of exemptions, reductions, and rebates established by the City under the Cleaning Tariff (as well as the Fixed Water Charge and the Fixed Sanitation Charge) are different from the Rates Act. It relies, however, on the General Valuation Roll ("GV Roll') established under the Rates Act. It is an impermissible parallel system of rates.
'For all these reasons, the Cleaning Tariff, while purporting to be a service, is a rate, but an unlawful one, because it does not comply, or even follow the scheme let alone the letter of the Rates Act,' he added.
The relief SAPOA is seeking is to have the budget declared invalid.
However, the order of invalidity should be suspended for two months to allow the city to deal with the revenue shortfall that will result from the invalidity of the three items.
Mayor Geordin Hill-Lewis said the city cannot agree that wealthy property owners should be charged the same as lower-income or middle-class households.
'This would be regressive, would place a disproportionate burden on ordinary families, and would be patently unfair.
'The city's budget protects homes under R2,5m and extends rates relief to many more middle-class homes, all while preserving the city's critical infrastructure and service investments. In contrast, this court application by the richest of the rich property portfolio holders seeks to go back to a system of regressive taxation which hits ordinary families, and the poor, the hardest,' said Hill-Lewis.
He added that if SAPOA were to succeed in their argument, the effect would be 'to have ordinary families effectively subsidising the wealthiest property owners'.
'Fixed charges linked to property value are a lawful, fairer, and equitable way for Capetonians to contribute within their means to our city's infrastructure programme and fixed service costs. Cross-subsidising – where the better off among us help to fund services for the less fortunate – is the only sustainable way to ensure a working city of hope for all,' said Hill-Lewis.
Meanwhile, the Cape Town Collective Ratepayers' Association (CTCRA), an association with 56 ratepayer associations and civic organisations from across Cape Town, has commended SAPOA.
'This case is not just of importance to the ratepayers of Cape Town. If left unchallenged, there is a realistic possibility that other municipalities in South Africa will adopt CoCT's methods. It is critical that the rule of law, fairness in service delivery, and constitutional accountability are upheld – not just for our city, but for the nation.'

Buthelezi said the court had upheld the decision to place the municipality under administration in terms of Section 139(1)(b) of the Constitution. Buthelezi welcomed the ruling, describing it as a victory for the rule of law, saying the judgment reaffirms the authority of Ndwandwe as the administrator. He further urged the Mayor to ensure the gates of the municipality were opened so that the Administrator could assume his duties and restore normal operations. Speaking on Monday, Ndwandwe confirmed resuming his duties, adding he had arranged a meeting with the municipal manager to handover the payroll to him so that he can start processing the salaries of the workers. "I am in Umkhuze right now and I will have a meeting with the municipal manager to hand over the payroll to me as we have agreed. I will need to pay workers today,' said Ndwandwe. The municipality said that the court's order dealt specifically with an application by the South African Municipal Workers Union (SAMWU) to compel the payment of salaries and not the intervention. The municipality's day-to-day operations were thrown into turmoil following the municipality and the ANC's defiance of the provincial cabinet's decision to place the municipality under administration. In terms of the decision, the administrator was expected to take over the control of the finances from the municipal manager but the municipality resisted and went to court to challenge the cabinet decision, calling it a political ploy by the IFP-led Cogta to strip the ANC-led municipality of its constitutional powers to run the municipality ahead of next year's elections. Two weeks ago, Buthelezi was prevented from entering the premises to officially introduce the administrator. The problem led to the delay in processing salaries as the municipal manager was no longer able to access the municipality's finances. In its response last week, the IFP dismissed the ANC's claims, saying the municipality's finances were in shambles and this is why the provincial cabinet intervened.

New EFF bill aims to tighten control over South Africa's foreign loans

According to party MP Sinawo Tambo, the proposal is already being processed through the Bills Office and is 'at an advanced stage.' The legislation seeks to ensure that all foreign loan agreements receive prior approval from Parliament and are fully disclosed to the public. The party wrote to the National Assembly Speaker Thoko Didiza in June, notifying her of their intention to table the Public Finance Management Amendment Bill, 2025. "It aims to strengthen democratic oversight and ensure that all foreign loan agreements undergo prior parliamentary approval and are subject to full public disclosure before conclusion. The policy rationale and urgency for this amendment are outlined in the attached policy proposal and consultation documents. The party said in the letter to Didiza. "The Bill is premised on the constitutional principles of transparency, accountability, and sound financial governance, as provided for in Sections 215 and 216 of the Constitution." The proposal comes amid growing concerns over the country's escalating debt levels. South Africa's debt-to-GDP ratio has grown from 23.6% in 2008/09 to a projected 74.7% in 2024/25. Image: AFP International Relations Minister Ronald Lamola said he does not believe South Africa's current lack of an ambassador in Washington has affected the country's ability to negotiate an agreement following the United States' decision to impose steep 30% tariffs on imports. Speaking at a joint media briefing on Monday at the Germiston Civic Centre in Ekurhuleni, alongside Trade, Industry and Competition Minister Parks Tau, Lamola addressed the diplomatic fallout after former South African ambassador to the US Ebrahim Rasool was expelled in March. 'We had an ambassador in the US and that ambassador was expelled,' said Lamola. 'President (Cyril) Ramaphosa has always prioritised the US in terms of ambassadorial responsibility.' Lamola said the expulsion has complicated the process of appointing a new ambassador. 'The fact that our ambassador was expelled means that the new process to appoint the ambassador will not be as easy as it would have been when an ambassador had not been expelled,' he said. 'We have to take all careful consideration, all due diligence, and I can confirm that that process is at an advanced stage. The President, at the right time, will announce who will become the ambassador of South Africa to the US.' While other African countries, such as Lesotho and Zimbabw,e will face a 15% tariff, South Africa has been singled out for a significantly steeper duty. Lamola, however, dismissed suggestions that the absence of an ambassador had weakened South Africa's negotiating position. 'Ambassadors do not negotiate any trade deals,' he said. 'The trade deal is being negotiated under the leadership of the Department of Trade, Industry and Competition (DTIC), with coordination and support from the Department of International Relations and Cooperation (DIRCO).' Lamola confirmed that South Africa currently has a chargé d'affaires (a diplomat) in Washington who engages with key stakeholders but does not lead negotiations. 'There are countries that do have ambassadors in Washington. They don't have a trade deal. So, the trade deal is negotiated by the relevant line function department. In this instance, it is the DTIC, which we are supporting, including our chargé d'affaires in the US, who does from time to time point to the relevant people,' he said. He further rejected claims that the absence of an ambassador directly caused South Africa's failure to secure a tariff exemption. 'If that were the case, all countries with ambassadors in Washington wouldn't be having the same challenges we're facing,' said Lamola. 'This is a global phenomenon, not a South African problem.' Rasool, who previously served as ambassador to the US from 2010 to 2015 during the Barack Obama administration, was reappointed in January 2025 under the Joe Biden and later Trump administrations. Rasool was dismissed in March after the remarks he made during a webinar hosted by the Mapungubwe Institute for Strategic Reflection (Mistra), under the theme 'Implications of Changes in US Administrations for SA and Africa'. During the event, Rasool urged South Africans to familiarise themselves with the country's national interest framework, calling it a critical guide amid shifting global dynamics.
