Federal Court sets Oct 29 to hear appeal against Isa Samad's acquittal
Mohd Isa, 75, was acquitted of all nine corruption charges involving RM3mil in connection with the purchase of Merdeka Palace Hotel & Suites in Kuching, Sarawak.
Deputy public prosecutor Afzainizam Abdul Aziz said the hearing date was set by deputy registrar Wan Fatimah Zaharah Wan Yussof during an online case management proceeding on Friday (July 25).
"All parties are required to file their written submissions two weeks before the appeal hearing,' Afzainizam said when contacted.
Meanwhile, Mohd Isa's counsel Siti Sarah Khalil said the court has directed parties to file their submissions on or before Oct 14, with the next case management fixed for Oct 15.
The prosecution filed its notice of appeal on March 7, 2024, and petition of appeal on June 26, advancing 24 grounds to support its contention that the Court of Appeal erred in law and fact when it acquitted Mohd Isa of all charges.
On March 6, 2024, a three-member Court of Appeal panel comprising Justice Datuk Vazeer Alam Mydin Meera (now a Federal Court judge), Datuk Ahmad Zaidi Ibrahim and Datuk S.M. Komathy Suppiah set aside Mohd Isa's conviction and six-year sentence, as well as the RM15.45mil fine imposed by the High Court on Feb 3, 2021.
The former Negeri Sembilan mentri besar was charged in 2018 with nine counts of receiving RM3,090,000 in bribes from Ikhwan Zaidel, a director of Gegasan Abadi Properties Sdn Bhd, through his former special political officer, Muhammad Zahid Md Arip, as an inducement for facilitating Felda Investment Corporation Sdn Bhd's approval to purchase the Merdeka Palace Hotel & Suites for RM160mil.
The offences were alleged to have taken place at Level 49, Menara Felda, Platinum Park, No. 11, Persiaran KLCC, Kuala Lumpur, between July 21, 2014, and Dec 11, 2015.
He was charged under Section 16(a)(A) of the Malaysian Anti-Corruption Commission (MACC) Act 2009, which provides for a maximum sentence of 20 years' imprisonment and a fine of not less than five times the value of the bribe or RM10,000, whichever is higher, upon conviction. - Bernama

Ex-university admission manager fined RM35,000 for forging recruitment documents
IPOH: A former private university admission manager was fined RM35,000, in default of four months' imprisonment, by the Sessions Court here today for forging student recruitment documents six years ago. Mohd Khalid Ka'ab, 42, pleaded guilty before Judge Meor Sulaiman Ahmad Tarmizi. According to the charge sheet, the accused had dishonestly used a document as genuine, namely, a Student Recruitment Agreement between Institut Teknologi Petronas Sdn Bhd (ITPSB) and Profedge Sdn Bhd, dated August 1, 2019. As an agency company appointed to provide promotional services for Universiti Teknologi Petronas (UTP) programmes and to recruit students from the Federal Territory, Selangor, and other locations for admission into the university, the accused had reason to believe that the document was false. The offence was allegedly committed at the UTP Registrar's Office in Seri Iskandar in June 2019. The charge was framed under Section 471 of the Penal Code, punishable under Section 465, which provides for a maximum of two years' imprisonment, a fine, or both upon conviction. Prosecuting officer Shahrul Azuan Ghazali from the Malaysian Anti-Corruption Commission (MACC) handled the case, while Mohamad Izwan Abd Rahman appeared for the accused. In pleading for leniency, Izwan told the court that his client had admitted guilt at the earliest opportunity, which saved valuable court time. However, Shahrul Azuan urged the court to impose a commensurate sentence as a deterrent to prevent similar offences in the future. According to the facts of the case, the accused used a document titled Student Recruitment Agreement between ITPSB and Profedge Sdn Bhd to support an official payment made in the name of Profedge Sdn Bhd. The company was claimed to be an appointed agency tasked with providing promotional services for UTP programmes and recruiting students from other locations for admission into UTP. However, the services were never actually carried out, and the payment amounted to RM323,650. During an Executive Management Committee meeting held on July 15, 2020, by the university, it was confirmed that the agreement under the name of Profedge Sdn Bhd had never been reviewed. On Sept 15, 2021, a report was filed with the MACC and investigations revealed that the accused had forged the agreement between ITPSB and Profedge Sdn Bhd. The forged document was used to facilitate payments by UTP through six invoices issued to Profedge Sdn Bhd, despite the fact that the students listed in the invoices had not been recruited through the agency.

Police bust online gambling call centre in KL, 13 arrested
KUALA LUMPUR: Police raided a call centre, suspected of promoting online gambling, concealed as an office on the 23rd floor of a building on Jalan Kia Peng, yesterday.
