In India, the law says that anyone under 18 is a child. And if anyone has sex with someone under 18, even if both people agree, it's still a crime. This is part of a law called POCSO, which is meant to protect kids from sexual abuse.
But here's the tricky part: teenagers often have crushes and sometimes even relationships. They might agree to be close to each other. So, is that always abuse? The law doesn't leave any room to understand if both were okay with it or if one was forced.
That's why earlier this year, the Supreme Court said maybe we should think about changing the law a bit – at least when it's two teenagers close in age. But the government disagreed, saying that making exceptions would weaken the law and make it harder to protect kids.
Still, some strange cases are popping up. Like a 40-year-old teacher in Mumbai who had a relationship with her 16-year-old student. The court gave her bail, saying it looked like the student had agreed. But how can we be sure it was real consent when the adult is so much older and in a position of power?
Another case involved a 23-year-old tutor who was in a relationship with her 13-year-old student and even became pregnant. She also got bail. These cases show how confusing the idea of consent can be, especially when there's a big age gap.
In other countries, the age of consent is usually 16. That means people below 16 can't legally agree to sex, no matter what they say. For example, in the UK, a teacher who had a baby with her 15-year-old student was clearly seen as an abuser. In the US, a famous case from the 1990s involved a woman teacher who had children with her 13-year-old student – even though they later married, she still went to jail because it was wrong when it started.
So, should India lower the age of consent to make things clearer? Maybe to 16 like in many other countries? That's the big question. Right now, the line is drawn at 18, and it doesn't matter what the teen thinks or feels. But maybe it should – at least in cases where both people are young and close in age.

Last Updated: The 16-year-old boy was accused of rape and causing abortion 'The good-old-days icon of a truant child seems to get replaced by the modern-day mascot of a violent predator," the Allahabad High Court observed, as it intervened to stop the adult prosecution of a 16-year-old boy accused of rape and causing abortion. Quoting with approval from the Bombay High Court's observations on the psychological fallout of unregulated digital exposure, the court noted that 'television, internet and social media have let the children, especially the adolescents, leapfrog into the adult world… Mostly it is a crash-landing, with disastrous consequences." The remarks came as Justice Siddharth allowed a criminal revision filed by a minor, referred to as Juvenile X, against orders of the Juvenile Justice Board (JJB) and a special POCSO court in Kaushambi that had directed he be tried as an adult for a 'heinous offence". A consensual physical relationship developed between the juvenile and a 14-year-old girl, which led to pregnancy. When the girl was five months pregnant, it was alleged that the boy, with the help of two adults, gave her medicine that caused a miscarriage. He was booked under POCSO, and the JJB conducted a preliminary assessment under Section 15 of the Juvenile Justice Act, concluding he should face an adult trial. However, the High Court found that the process adopted by the Board and the POCSO court was not in conformity with the law. The boy had undergone a psychological evaluation that revealed a mental age of six years and an IQ of 66, indicative of mild intellectual disability. He struggled with academic performance, had poor social interaction, and scored in the borderline to mild clinical range on behavioural tests. Despite these findings, the JJB dismissed the report and based its decision largely on the allegations and the statement of the victim. 'This Court finds that the report of psychologist was in favour of the revisionist… the revisionist with score of 62 comes in borderline category which is even below the category of low/below average," the court said, adding that 'he was not capable nor he took decision to administer the victim medicine alone". Justice Siddharth observed that 'an order under Section 15… not only gives a different legal character to a juvenile… but also takes away the application of the beneficial provisions" under juvenile law. The court stressed that such an order must be the result of 'a crucial judicial examination", and not a routine endorsement of FIR content or assumptions about intent. Criticising what it described as a 'mechanical" application of Section 15, the court said, 'Retributive approach vis-à-vis juveniles needs to be shunned unless there are exceptional circumstances… Let no child be condemned unless his fate is foreordained by his own destructive conduct". Teacher booked for ‘molesting' Class X girl in govt school
Jind: The Kaithal women police have booked a teacher for allegedly sexually harassing a Class X girl in a govt-run school in the district. In her complaint filed with Kaithal police, the survivor alleged, "I was sitting in the school lab, and the accused grabbed my hand and touched me inappropriately. He teaches us English in the school. The incident took place on July 16 in the school's lab." However, the accused school teacher stated that two girl students were watching pornographic content on a mobile phone in the school lab. "I scolded them and warned them not to repeat it in the future. Thereafter, the girls even tendered an apology by visiting the classroom and withdrew their complaint filed with the school management committee. All allegations levelled against me are false. A few teachers teaching in the school are provoking the girls and their parents for further action," he informed media persons. Sources said that a panchayat was also held in this regard, but couldn't reach an agreement. Subsequently, parents lodged a police complaint with the women police, seeking further strict action against the accused teacher. Talking to TOI, the women police SHO confirmed that a case was lodged against the teacher under the Prevention of Children from Sexual Offenses (POCSO), SC/ST, and other relevant sections of the BNS. Pocso accused who escaped from police custody re-arrested
Panchkula: Panchkula police re-arrested an accused in a Pocso case within just 24 hours of his escape from police custody. The accused, originally arrested in a Pocso case registered at Pinjore police station on July 10, 2024, was charged with the sexual assault of a 15-year-old minor. He was first apprehended on July 18 from Kokrajhar, Assam. The accused was remanded to police custody for six days on July 22, 2025, after being produced in court. However, on the morning of July 25, the accused managed to escape from the lock-up at Pinjore Police Station by dodging the on-duty sentry and fleeing via the rooftop. He was brought out from the barrack to attend to a call of nature but escaped. The incident prompted DCP Srishti Gupta to take immediate and strict action, suspending the negligent constable on duty and initiating a departmental inquiry. A show-cause notice was also issued to the station in-charge, and ACP Kalka was assigned to investigate the matter further. Amid the seriousness of the situation, police launched an intensive manhunt. Under DCP Gupta's instructions, Inspector Bachchu Singh, SHO of Pinjore, formed special teams and conducted relentless raids at various locations. Using CCTV footage, confidential sources, and technical surveillance, police managed to trace the accused. The accused was re-arrested early this morning from Tibbi village in the Pinjore region, less than 24 hours after his escape. Mohammad Tausif Alam, 22, hails from Talwadi village in Bihar. Speaking on the matter, DCP Srishti Gupta said, "There was indeed a lapse from our side, and catching the escaped accused became a challenge. However, our team's quick response and commitment helped us apprehend him again within 24 hours."
