KUALA LUMPUR: Mahkamah Tinggi hari ini membuat keputusann yang memihak kepada Ahli Parlimen Segambut Hannah Yeoh, dan mengarahkan pensyarah Universiti Utara Malaysia (UUM) Dr Kamarul Zaman Yusoff, membayar ganti rugi sebanyak RM400,000 berikutan kenyataan fitnah yang dibuatnya lapan tahun lepas.
Keputusan itu dibacakan oleh Hakim Datuk Aliza Sulaiman yang membenarkan tuntutan Hannah selepas menolak hujah defendan bahawa beliau tidak mempunyai locus standi untuk memulakan saman tersebut.
Saman fitnah yang difailkan pada 2022 itu tercetus daripada dua hantaran Facebook oleh Kamarul Zaman antara 10 dan 17 Mei 2017, dengan beliau mendakwa Hannah mempunyai agenda memurtadkan dan menggunakan platform politiknya untuk mempromosikan agama Kristian.
Beliau juga merujuk kepada autobiografi Hannah bertajuk Becoming Hannah: A Personal Journey sebagai bukti kepada agenda Kristian yang didakwa, serta mendakwa Hannah berhasrat untuk menjadikan Malaysia sebagai sebuah negara Kristian.
Dalam penyataan pembelaannya, Kamarul Zaman menafikan bahawa hantaran tersebut adalah fitnah dan menegaskan kenyataannya adalah berasas.
Judge Aliza further held that if the defendant genuinely believed the plaintiff had committed an offence, lodging a police report would have been sufficient. Instead, the defendant chose to publish it on Facebook.
She noted that the publication was not in dispute, and it was evident from both the titles and content that the statements were directed specifically at the plaintiff.
The judge also rejected the defence's contention that the first publication was aimed at DAP as a political party, rather than the plaintiff personally.
'Even the defendant's own pleadings mentioned the plaintiff by name, and the title of the article made the target unmistakable. The defendant's personal understanding of the book is not relevant, as what matters is how an ordinary reader would interpret the statements.
'The readers would reasonably believe that the plaintiff was spreading Christianity unlawfully and, by implication, committing a crime,' she said.
Judge Aliza allowed the plaintiff's claim upon finding that the plaintiff had established her case on a balance of probabilities and that the defendant had acted with malice.
'The court awards RM400,000 as general and aggravated damages to be paid by the defendant to the plaintiff. This means, RM200,000 per publication and RM80,000 in costs,' she said.
The judge, however, dismissed Hannah's application for Kamarul Zaman to issue a public apology, saying that such an apology could be seen as insincere.
She also granted an injunction to restrain the defendant, his servants, or agents from republishing the impugned words or similar statements.
Hannah was present in court today, accompanied by her counsel, Sangeet Kaur Deo, while the defendant, Dr Kamarul Zaman Yusoff, was not in attendance.

They were charged under Section 292 of the Penal Code, which carries a maximum sentence of three years' imprisonment, a fine, or both, upon conviction. Deputy public prosecutors Muhammad Nadzir Abdullah and Nur Haziqah Hassan prosecuted the case, while all three accused were represented by lawyer Samantha Chong Yin Xin. Earlier, Muhammad Nadzir and Nur Haziqah urged the court to impose a sentence that would serve as a deterrent to the public. Samantha, however, pleaded for leniency, requesting the minimum fine as her clients had repented and promised to change. "Mohd Hanafi suffers from a brain condition and underwent head surgery in 2016. He is now dependent on his sister for support. "Muhammad Al Azamuddin is a first-year university student, while Mohamad Syahmi Firas is a final-year polytechnic student. "They have all promised not to repeat this offence. Their families have also vowed to guide them onto the right path from now on," she said. Failure to pay the fine will result in a six-month jail term. It was previously reported that police raided a gathering at a bungalow on Jalan Kemumin, believed to have been attended by nearly 100 men. The raid, conducted based on intelligence and public information, led to the arrest of 20 men and the seizure of hundreds of condoms and HIV medication.

PETALING JAYA: Three individuals, including two students from higher education institutions, have been fined a total of RM11,000 after pleading guilty to having same-sex pornographic content on their phones. Al Azamuddin Al Fadzil, 22, from Setiawan, Perak and Mohamad Syahmi Firas Mohd Jurij, 27, from Bachok, Kelantan were fined RM4,000 each while Mohd Mohd Hanafi Ibrahim, 47, from Kota Baru was fined RM3,000 at the Kota Baru Magistrate's Court, Sinar Harian reported. The trio were charged with possessing the content on their phones in a house on Jalan Kemumin, Kampung Belacang, Kota Baru on June 18. Charges were filed under Section 292 of Penal Code, which brings a maximum jail term of three years, or a fine, or both, if convicted. The trio were released after paying the fines. This comes after police raided a bungalow in Kemumin, Kota Baru, where a "gay sex party" supposedly took place. The raid sparked controversy after several non-governmental organisations and individuals denied that any illicit activities took place. In a joint statement, Suaram, the Women's Aid Organisation, Parti Sosialis Malaysia and Amnesty International Malaysia refuted claims of immoral conduct, stating that "the participants attended to get information and undergo sexual health tests." The Malaysian AIDS Council also confirmed that a field engagement session was conducted on June 17 in Kota Baru under the Different HIV Services for Key Population programme, which is supported by the Health Ministry. Kelantan Deputy Mentri Besar Datuk Dr Mohamed Fadzli Hassan has since called for a fair and thorough investigation into the matter.
