The Western Cape High Court has dismissed the EFF's urgent bid to block a controversial fuel levy hike—just as fuel prices dip. From midnight, levies rise by 16c (petrol) and 15c (diesel), despite constitutional questions. It's a pump paradox: taxpayers pay more, but pump prices briefly fall.
In a ruling handed down yesterday, Judge Nathan Erasmus found that the EFF's application lacked urgency and did not meet the legal threshold for interim relief. The court did not engage with the broader constitutional challenge itself, which the EFF had previously framed in its initial filing as a possible Part B of its legal strategy.
A tax fight rooted in Budget 3.0
The levy increase was announced in Finance Minister Enoch Godongwana's revised Budget 3.0, tabled in May following the political fallout and eventual withdrawal of VAT hikes in earlier budget versions. Treasury estimates the fuel levy will raise about R4-billion in the 2025/26 fiscal year.
The EFF has argued that the use of Section 48(1) of the Customs and Excise Act to implement the fuel levy increase amounts to an unconstitutional bypassing of Parliament. Section 77 of the Constitution requires that all new taxes be passed via a money Bill through the National Assembly.
Arguments on constitutional compliance
Representing the EFF, Advocate Mfesane Ka-Siboto told the court: 'The fact that this has happened before does not make it lawful. Past practice is not a substitute for constitutional compliance.' He described the move as a case of 'taxation without representation.'
The Treasury, represented by Advocate Kameel Premhid, countered that Section 48(1) had long been used lawfully to adjust fuel levy schedules. He argued the measure was an administrative amendment within an existing framework, not the introduction of a new tax requiring legislative approval.
What this means for you
For consumers, the fuel levy increase translates into higher petrol and diesel prices at the pump, effective immediately.
This could lead to broader knock-on effects on transport costs, food prices and inflation, particularly for lower-income households who spend a greater share of their income on fuel-linked expenses. Treasury maintains the hike is necessary to address fiscal gaps left by the abandoned VAT proposal.
The fuel levy increase will be offset by a decrease in fuel prices – which also kicks in on Wednesday, 4 June. The Department of Minerals and Petroleum Resources (DMPR) announced the following price decreases yesterday:
Petrol 93 (ULP & LRP): ⬇️5cents/litre.
Petrol 95 (ULP & LRP): ⬇️5 cents/litre.
Diesel (0.05% sulphur): ⬇️ 36.9 cents/litre.
Diesel (0.005% sulphur): ⬇️36.9 cents/litre.
Commenting on the changes, the DMPR noted that over the last month, there has been a decrease in the average Brent Crude oil price from US$66.40 to US$63.95, largely on the back of continued global trade uncertainty,
Parliament distances itself from the damage
Parliament, which was cited in the court papers, but not the target of any relief, issued a brief statement after the judgment: 'Although cited in the application, no relief was sought against Parliament. Parliament's position throughout the proceedings was to abide by the outcome of the court process. Accordingly, Parliament will comply with the court's ruling.'
Oversight loophole or legal mechanism?
In its legal representations, Treasury has argued that Section 48(6) of the Act ensures Parliamentary oversight by requiring the amended tariff to be tabled after the fact. The EFF, however, contends this form of post-implementation tabling falls short of the constitutional threshold for public finance legislation.
EFF's Part B remains unclear
In a short statement on X after the ruling, the EFF said: 'We are committed to fighting the fuel levy increase in court and in Parliament.' However, the party did not explicitly confirm that it would pursue the Part B constitutional review.
Whether the EFF returns to court or not, the broader legal and political debate over fiscal authority, oversight and the democratic control of taxation is likely to persist. DM

The City of Johannesburg received the lion's share of the allocation with just under R4.6bn, eThekwini got about R3.9bn, and Cape Town was allocated R2.85bn in 2024/25, according to a notice published by Godongwana last week. Ekurhuleni's share is almost R1.8bn and the City of Tshwane received about R1.67bn. The Act states that the allocation to which metropolitan municipalities are entitled is fixed at 23%. Godongwana may annually revise the percentage and must publish the revised percentage by notice in the government gazette. Additionally, he must, for each financial year, determine an equitable allocation to be made to each metropolitan municipality. During the Budget speech in May, Godongwana announced an inflation-linked increase to the general fuel levy over a period of three years. As a result, last month the fuel levy increased by 16 cents per litre for petrol and 15 cents per litre for diesel. The increase sparked widespread opposition, with the EFF unsuccessfully approaching the Western Cape High Court to suspend Godongwana's increase in the general fuel levy and interdicting the minister from giving effect to the impugned decision pending the finalisation of part B of its application. In part B, the EFF wants the high court to review and set aside the increase of the general fuel levy. The fuel levy was initially set aside for road maintenance and infrastructure upgrades, and there have been calls for it to be ring-fenced for allocation to the SA National Roads Agency Limited. EFF treasurer-general Omphile Maotwe did not respond to questions on when part B of the party's application would be heard by the high court.

Image: Jacques Naude / Independent Newspapers A labour law expert, Advocate Bo Dlamini, said President Cyril Ramaphosa's decision to place the embattled Police Minister Senzo Mchunu on paid leave may be unconstitutional and wasteful. The expert was weighing in on a continued public debate on whether the president did not violate the Constitution when giving a minister a leave of absence instead of a suspension. Dlamini said since ministers are not appointed under Public Service Act, it is unclear where the president based his decision to give Mchunu a leave of absence, saying it was even worse that the leave may take up to a year, which is unusual for ministers and it can constitute a wasteful expenditure. He further stated that although ministers' appointments are not regulated by labour laws, the president, in a supervisor-subordinate relationship, could have suspended the minister instead of granting him a leave. 'Ramaphosa was supposed to suspend Mr Mchunu and appoint an independent tribunal to investigate the two violations of the Constitution within three months and make a report with recommendations,' said Dlamini. Advertisement Next Stay Close ✕ He said Mchunu may have violated Section 207 of the Constitution, which deals with roles of the National Commissioners and Provincial Commissioners in controlling and managing the SAPS, adding that this clause clearly forbids Mchunu from disbanding the political task team unit which could have been done by the National Police Commissioner, Lieutenant-General Fannie Masemola. Dlamini further stated that there is another piece of prima facie evidence that Mchunu lied in Parliament by stating that he didn't know Brown Mogotsi, but later on admitted knowing only as a "comrade". On a possible wasteful expenditure, Dlamini said another minister should have been appointed to act in Mchunu's place to protect taxpayers' money instead of appointing a new acting minister, Firoz Cachalia, who will enjoy added benefits while Mchunu enjoys the same perks sitting at home. With the Police Ministry already bloated with two deputy ministers and costing taxpayers millions of rand in salaries and ministerial perks, there has been a public outcry over the president's decision to place Mchunu on a long paid leave and appointing acting Minister outside the Cabinet. This means taxpayers will foot the bill for four political heads of one department. Opposition parties also questioned the president's decision to appoint commissions instead of utilising the existing crime fighting state institutions such as the Special Investigations Unit. Addressing the nation on Sunday, the president defended his decision to appoint a non-Cabinet member to act by quoting Section 91(3)(c) of the Constitution, which allows the president to appoint not more than two ministers outside the National Assembly. However, the same Section is silent on appointing acting minister outside the National Assembly. Deputy ministers could not also be appointed to act since they are not part of the Cabinet.

CAPE TOWN - The uMkhonto weSizwe (MK) Party said it was heading to the Constitutional Court to challenge a decision to appoint an interim police minister. The party said that there was no provision in the Constitution for a minister to be placed on special leave, neither for two ministers to be appointed to the same portfolio at the same time. Making the announcement, the MK Party's parliamentary leader, John Hlophe, said that he'd been given the green light to challenge President Cyril Ramaphosa's Sunday announcement to suspend Police Minister Senzo Mchunu and use his constitutional prerogative to appoint a parliamentary outsider to lead the department in the interim. The party also does not support the establishment of a commission of inquiry to investigate claims of corruption, infiltration and capture of the South African Police Service (SAPS). The MK Party wants Ramaphosa to fire Mchunu, saying there was enough evidence to show he'd misled Parliament and the country on several occasions. Hlophe said that the party had approached Parliament's ethics committee to investigate Mchunu. "We are dealing with a minister who has serious allegations, with a history of lying. I've openly called him a pathological liar. When it comes to lying, he excels." Hlophe said that court papers were already being drafted to approach the country's top court to challenge the appointment of a Firoz Cachalia to head the police ministry while Mchunu was on leave. "The issues are of a serious nature. There is so much at stake. Time is not on our side. We can't go to the high court and waste time." The MK Party said that a commission of inquiry into the police was a waste of time and taxpayers' money, saying that the police commissioner should act on the allegations made against senior officials who were reportedly stalling investigations.
