Kerala HC expresses concern over non-publication of SSLC exam results of students accused in Shahbas murder
The Kerala High Court on Tuesday orally asked why the SSLC examination results of the students accused in the murder of 15-year-old Shahbas have not been published.
When the bail petitions of the students came up for hearing, Justice Bechu Kurian Thomas wondered how could the authorities delay publishing their results. Why the students had to move the Kerala State Commission for Protection of Child Rights to get their results published. Publishing the results had nothing to do with the offence committed by them. If they had written the examination, the results had to be published, the court orally observed.
The court made the oral observations when the counsel for the students submitted that the results had not been published despite a directive from the child rights commission. However, the court orally observed that since it was an order of the child rights commission, they would have to move the High Court separately challenging the inaction of the authorities.

Although the district collector submitted to the court that the high court's orders could not be implemented as there was no land available to compensate the legal heirs of the petitioner, the high court directed the collector to invoke land acquisition proceedings for the grant of compensation under the Act within six months. Subsequently, the petitioner moved a petition before the high court in 2000, and the court in 2009 ruled in his favour. Alleging non-compliance with the high court order, the petitioner filed a contempt case against the district collector in August 2010, but it was rejected by the registry due to some objections. The petitioner resubmitted the contempt case in February 2011, and it was admitted by the high court in March 2012. A judgement of the Telangana High Court this month that upheld Muslim women's right to invoke khula, the process for a woman to obtain divorce under Islamic law, will go a long way in their fight for justice. The court held that a Muslim wife has an absolute and unconditional right to dissolve her marriage through khula and that the husband's consent is not a prerequisite for its validity. The bench was hearing an appeal by a Muslim man who contested the divorce his wife initiated though he refused consent to a khula. The verdict also stated the clerics have no role in effecting khula and that religious bodies cannot issue valid divorce certificates. The judgement stated that only the courts can grant divorce after ascertaining if the khula is valid. However, the husband has the right to challenge the verdict. The Kerala High Court pronounced a similar judgement in 2022, declaring that unilateral divorce 'is an absolute right, conferred on her by the Koran and is not subject to the acceptance or the will of her husband'. The judgement had placed khula on equal footing with talaq, the unilateral right available to Muslim men to dissolve a marriage, stating that both are unconditional modes of divorce.
