The timing to resolve the FDA Warning Letter is uncertain. Since the April notice of disapproval of its IDE application, UHP has engaged with the FDA's IDE review team (which functions separately from the group that issued the Warning Letter) to seek a path to timely approval of a new IDE and commencement of the clinical study irrespective of the Warning Letter status. UHP has retained a regulatory attorney to support its efforts in this regard and is discussing with the FDA various solutions including, among other options, identifying an alternative sponsor acceptable to the FDA to oversee the new clinical study on the Company's behalf. In such an arrangement, UHP would retain full and exclusive rights to the data and analysis contained in a Clinical Trial Report and incorporate these into a revised PMA application. The Company will make further announcements as FDA discussions progress.

Texas Roadhouse hit with civil rights complaint alleging DEI discrimination in hiring practices
A conservative legal group has launched a civil rights complaint against the Texas Roadhouse restaurant chain, alleging it illegally discriminates by using Diversity, Equity and Inclusion (DEI), gender and racial demographic criteria in its hiring practices. The complaint, filed with the Equal Employment Opportunity Commission by America First Legal (AFL), accused Texas Roadhouse of using race and gender as factors in determining who should be appointed to its Board of Directors, tracking employees' race, gender and ethnicity, as well as running 'reputational risk' to its business due to its DEI policies. AFL is alleging that Texas Roadhouse is in violation of the Civil Rights Act of 1964. 'The evidence demonstrates that the Company's hiring, promotion, and recruitment practices violate state and federal law. Over 64,000 pounds of butter recalled over undeclared milk, FDA says
More than 64,000 pounds of butter have been recalled due to potential undeclared milk allergens, according to the U.S. Food and Drug Administration. Food ingredient company Bunge North America recalled 1,800 cases of its NH European Style Butter Blend that were distributed at 12 centers located across the United States and one in Dominican Republic, a July 14 FDA alert reported.
