'Trusted' uncle who livestreamed sexual assault of sleeping 12-year-old nephew pleads guilty

The Journal10-07-2025
A 'TRUSTED' UNCLE was babysitting when he livestreamed a web chat to a random man online as he sexually assaulted his sleeping 12-year-old nephew, a court has heard.
The child's mother, who was away, received a 1.45 am phone message from her distraught son saying: 'Mam, I need to tell you something'.
The Midlands man in his forties also secretly filmed a friend's daughter using the toilet, and pleaded guilty to sexual assault, possession and production of child pornography on dates in 2021 and will be sentenced in November. Child sexual abuse material is referred to as 'child pornography' in law.
The man is not being identified to protect the victims' right to anonymity.
At Mullingar Circuit Criminal Court, Judge Keenan Johnson berated the accused for his exploitation of vulnerable children through these horrific crimes.
Revoking his bail and ordering psychiatric and probation reports, Judge Johnson emphasised that this type of offence carried a significant penalty because of the unprecedented damage and hurt caused to the victims and the wider family involved.
Detective Garda David Mead from the Divisional Protective Services Unit outlined how the boy detailed what happened in a specialist interview.
He fell asleep on a couch but woke to find the accused rubbing his penis with the palm of his hand under his clothes.
He revealed that he awoke because of the glow of his uncle 'shining his phone in his face' and saw 'a random guy'. It was an adult, in the web chat on the screen, 'touching himself as well'.
The terrified boy ran to his room and hurriedly sent a Snapchat message to his mother.
He told gardaí, 'I felt like puking, really scared'.
The court heard his mother returned and asked what had happened, and he told her everything was okay.
However, her concerns resurfaced when she later learned that her brother had befriended another young boy and allowed him to take showers in his workplace.
The victim's parents broached the subject again, and this time their son disclosed the abuse.
In a raw victim statement, the boy's mother, holding back tears, turned to face her brother, saying her son had 'trusted and loved you so much, and you took advantage of him.

She spoke out, saying the boy has been devastated and left confused.
'I have lost my brother, and best friend that I truly loved. I am so angry,' adding, 'you have ripped our family apart'
Concluding her impact statement, she highlighted how he denied it and dragged out the case for three years, and told him, 'You caused the heartbreak that comes with that; today is the day I get justice'.
Gardaí searched a property he used and found his phone also had two covert video recordings of a girl aged 10-12 using the toilet and showing her vagina. His voice could be heard in the background of the videos, which lasted about 46 seconds.
The girl's mother was shocked when gardaí contacted her. She had known him through work and found him immature, and noticed he had been texting and inviting her son to come over.
The mother of the girl he covertly recorded told him he stole her daughter's innocence, and she no longer feels safe, suffers distress and anxiety.
The man sat with his head bowed and was in tears, but he did not address the court.
During his garda interview, he attempted to convince investigators that the phone's rear camera had activated when the flashlight was turned on, which was later found to be impossible.
He told gardaí that he was homosexual and not interested in girls.
He also had software to wipe his computer and had attempted to delete the Tor browser and another app for anonymous internet use.
However, gardaí recovered a two-minute video of one of his web chats where he spoke to a child, initially thinking it was a girl, but said 'even better' on hearing it was a boy.
He encouraged that child to expose himself and masturbate. He did not show his face in the video chat, but the background matched his room.
The court heard that he was using an online platform for random web chats with individuals.
The charges can carry maximum sentences of five, ten, and 14 years.
He had prior convictions for public order, criminal damage, driving offences, and failing to appear in court.
The defence said the accused had a difficult childhood and had been referred to a psychiatrist, but was still on a waiting list.

Man in court charged with communicating with 'girl' aged 13 for sexual purposes

A man has appeared in court charged with trying to communicate with a child for sexual purposes in Co Donegal. The accused man, who is in his 20s, was brought before Letterkenny District Court by detectives. Judge Eiteain Cunningham heard how the man used both Snapchat and Whatsapp to communicate with whom he thought was a 13-year-old child. The accused man, who is a professional and in his 20s, cannot be named for legal reasons. When arrested, the man was found in possession of five condoms while 'other sexual paraphernalia' was found in a property. Messages found on the man's phone allegedly claim how he asked the 'girl' if she was a virgin and if they could have sex in an apartment he had rented. It follows allegations against the accused man, which were widely shared on social media. The man was charged by detectives in Donegal at 4.07pm on Wednesday, July 16. The man was charged that, between July 10 2025 and July 15 2025, both dates inclusive, within the State, did by means of information and communication technology, namely Snapchat and WhatsApp, communicate with another person for the purpose of facilitating the sexual exploitation of a child under the age of 17. The charge is contrary to section 8 (1) of the Criminal Law (Sexual Offences) Act 2017. Sergeant Jim Collins told the court that An Garda Siochana were objecting to bail. He said there was 'quite a lot of strong evidence' in the matter. Sergeant Collins said that detectives had obtained copies of conversations between the accused man and what was described as 'a fictional child', who he believed was 13 years of age on Snapchat and WhatsApp. The man, with an address in the Dublin area, had booked an apartment in Letterkenny for a number of days. Gardai also seized other items and documents from the man's vehicle. Sergeant Collins told the court that there were concerns that the defendant would attempt to flee the jurisdiction and not make himself available to be dealt with by the law. He said there were concerns that, if released on bail, the man could commit further offences of a similar nature. The man has no previous convictions and has never been before the court on other matters. The man's solicitor, Mr Rory O'Brien, told the court that his client has a first class honours degree from an Irish university. Until recently, the man was in active employment, but is now unemployed. The court heard that the accused man would have 'no difficulty' in handing his passport to the authorities. Mr O'Brien told Judge Cunningham that bail could be considered with conditions attached. Sergeant Collins said that evidence has been put to the Director of Public Prosecutions (DPP) in the form of information obtained from the accused's phone and said that 'this is very strong evidence of his communication with what he thought to be a 13-year-old female'. Judge Cunningham said that she had carefully listened to the evidence and submissions. She said that the accused has the presumption of innocence until proven guilty. However, Judge Cunningham found the prosecution to have established a likelihood of the accused trying to evade justice. The man was remanded in custody to appear before a future sitting of Letterkenny District Court. Under new law introduced in 2024, persons charged with such offences are entitled to anonymity until they are convicted or the restriction is otherwise lifted by a Court. Judge Cunningham directed that a publication order should remain at this time. Subscribe to our newsletter for the latest news from the Irish Mirror direct to your inbox: Sign up here.

‘He was in a position of power': Student tells inquiry she realised later that ‘sexual relationship' with teacher made her vulnerable

A Teaching Council inquiry panel has retired to consider allegations of a sexual relationship between a teacher and a student. The complainant has told the Teaching Council that when she was an 18-year-old student a teacher at her school had sexual encounters with her on four to six occasions between March and June 2018. She also alleges she and the teacher sent communications to each other on Snapchat, the social media app, many of which were of a sexually explicit nature, including photos of a penis and nude photos of the complainant. The teacher was not present at the proceedings on Tuesday. READ MORE At the inquiry the complainant gave evidence about six videos that were played to the panel at the inquiry and were recorded by a trusted university friend of the complainant in March 2022 on the friend's phone. The complainant said she began seeing matters from an adult perspective during her first year in college. It was then she came to believe the teacher's conduct breached ethical standards. 'It was quite difficult to recognise that I was in a vulnerable situation. I have a lot of guilt. [The teacher] was in a position of power. He was trained. He could have dealt with the situation differently,' she said. She said she was attending counselling over the interactions and was now scared of seeing the teacher. The complainant further gave evidence that the teacher also followed her on Instagram and 'liked' her posts between 2020 and 2022. She also said a girl in her year in the school sent her a picture from March 2017 of a Tinder profile under the name 'Muinteoir', which the complainant alleges was that of the teacher. She claims it shows both parties had 'matched' with each other. After hearing legal advice, the panel has retired to consider the claims and whether, if proven, these amount to a finding of professional misconduct and/or a breach of the Code of Conduct for Teachers.
