Medicine price display rule to stay

PETALING JAYA: The enforcement of the medicine price display requirement under the Price Control and Anti-Profiteering Act 2011 will continue in stages through a process of education, inspections, and advocacy until Sept 30.
The Health Ministry said in a statement that warning letters may be issued for non-compliance, followed by the issuance of compounds from Oct 1.
Full enforcement is scheduled to begin on Jan 1 next year.
The medicine price display initiative, which applies to private healthcare facilities and community pharmacies, was first implemented on May 1.
'This initiative is a strategic collaboration between the Health Ministry and the Domestic Trade and Cost of Living Ministry.
'An educational enforcement approach was adopted for the first three months, ending July 31.
'During this period, 842 facilities, including medical and dental clinics, private hospitals, and community pharmacies, were inspected, with 57% found to be satisfactorily complying with the price display requirement,' the ministry said yesterday.
Both ministries also acknowledged that a judicial review had been filed in the High Court by seven organisations representing medical and dental practitioners, as well as one private medical practitioner, to challenge the validity of the directive.
However, the ministry clarified that no court order has been issued to suspend the implementation or enforcement of the ruling.
Former Medical Practitioners Coalition Association of Malaysia presi­dent Dr Raj Kumar Maharajah said most clinics are not in favour of the rule but have complied regardless.
He argued that the directive is misplaced, as private clinics do not operate like pharmacies and do not display or sell medicines over the counter.
'Unlike pharmacies that sell medicines, our permits allow us to dispense medication only after consultation, examination and investigations.
'Customers rarely come just to buy medicine and the drugs are not displayed on shelves.
'When we introduce laws, they must make sense.
'This rule seems more like a feel-good measure to reassure the public. But in reality, it serves no purpose,' he said.
On the question of compliance, Dr Raj said clinics are ready for full enforcement and have nothing to hide.
Federation of Private Medical Practitioners' Associations Malay­sia secretary Dr Shanmuganathan Ganeson said the association understands the enforcement is still in its educational phase until the end of September and that compounds are unlikely during this period.
He said members have been advised to cooperate during inspections and continue engaging in good faith.
'We've filed a judicial review, so we'll refrain from making detailed comments while the matter is before the court.
'If any clinic experiences overzealous or premature enforcement, we encourage them to inform the federation's secretariat so we can monitor and respond accordingly,' he said.
The directive, effective from May 1, requires all private healthcare facilities and community pharmacies to display prices of all medicines intended for human use.
This includes prescription and non-prescription drugs, over the counter products, traditional medicines, health supplements, and extemporaneously prepared products.

Health Minister Datuk Seri Dr Dzulkefly Ahmad said social media influencers, or key opinion leaders, can play a crucial role in shaping public behaviour, and the ministry intends to leverage their influence to spread awareness of healthy lifestyles. 'We want our influencers to uphold the most important agenda, which is to promote healthy eating and lifestyles,' he told reporters yesterday, after moderating a dialogue on the National Health and Morbidity Survey (Nutrition) 2024 findings. The report revealed serious deficiencies in the population's dietary habits. Only 12.8% of adolescents and 17.1% of adults meet the minimum recommended intake of fruits and vegetables, while dairy consumption is extremely low, at just 2.9% among adolescents and a mere 0.7% among adults. At the same time, sugar consumption is excessive, with 63.1% of adolescents and 47.0% of adults exceeding the recommended intake, mainly due to sweetened beverages. Fat consumption also surpasses the advised 30% of daily energy intake across all age groups, and 75.9% of adults consume more salt than recommended. Dzulkefly said the government will begin with policies focused on food literacy and nutrition awareness and ­highlighted the importance of addressing supply-side issues to make healthy food more accessible. 'Ultimately, it's about ensuring that food suppliers, particularly manufacturers, help promote the idea that healthy food does not need to be expensive,' he said. Dzulkefly also revealed that the ministry is considering the introduction of a nutri-grade system, which would classify food items by nutritional value. 'When we introduce nutri-grade, we will know the category of food, from A, the best, to B, and so on, including those that cannot be advertised at all,' he said. He also suggested that products deemed unhealthy could be placed in special sections of supermarkets, similar to how non-halal items are currently separated, to increase consumer awareness.

The classification of food nutrition or Nutri-Grade under the Health Ministry's (MOH) initiative will be implemented soon, Health Minister Datuk Seri Dr Dzulkefly Ahmad said. He added that Nutri-Grade will be used to categorise food products sold in supermarkets so that it is easily understood by consumers, and its implementation is aimed at increasing healthy nutrition literacy among Malaysians. 'When we introduce Nutri-Grade, we will find that the category of food begins from Grade A: the best, to Grade D: should not be advertised at all. 'We will categorise which are unhealthy, we box it up in Grade D, which has unhealthy (contents) so people know and avoid it if possible,' he said, Such an approach has to be implemented following National Health and Morbidity Study 2024 findings that show a lack of nutrition among Malaysians. 'The challenge still falls on us as health managers to ensure healthy nutritional practices continue to be implemented, including those related to malnutrition, especially among teenagers and children,' Dr Dzulkefly said, adding that his ministry was open to having engagement sessions with social media influencers to assist in realising the healthy dietary agenda in the country. The study that involved 5,400 households revealed that 78 per cent of teenagers and 74 per cent of adults lack sufficient vitamin A due to a lack of vegetable and fruit intake, and 98 per cent of teenagers and 96 per cent of adults are calcium-deficient due to a lack of intake of dairy products. Meanwhile, two out of three teenagers and one out of two adults' sugar intake exceeded 37.5g (7.5 teaspoons), a day, and three out of four adults consume an average of 7.3g (1.5 teaspoons) of salt a day, exceeding the World Health Organisation's recommended 5g (one teaspoon) daily intake.
