
To avoid paying alimony and child support, man claimed he was unemployed. Then, his wife filed an RTI
The man had earlier allegedly submitted an affidavit saying that he was unemployed.
The petitioner woman approached the High Court in 2023 against the Rs 12-lakh one-time alimony awarded to her by a family court.
According to the petitioner, within a couple of years of marriage, she allegedly faced cruelty and domestic abuse, along with demands for dowry, including cash and an SUV. In 2012, the couple had a son, who was later diagnosed with autism. She alleged that her husband cut off communication and refused to support her or the child.
In 2014, the woman lodged an online complaint with the National Commission for Women, citing domestic violence and abandonment. Despite an attempt at reconciliation in 2015 at a Bhopal police station, no resolution was reached.
Advocate Rakesh Kumar Gupta, the petitioner's counsel, told The Indian Express that in 2016, she had approached the family court in Ranchi, seeking divorce on the grounds of cruelty and desertion. 'After this, the court had granted a one-time alimony of Rs 12 lakh and Rs 8,000 a month for the son's maintenance,' he said.
Dissatisfied with the amount, especially in light of her son's special needs and therapy expenses, she appealed in the Jharkhand High Court.
While the husband had claimed during family court proceedings that he was unemployed, the appellant produced an RTI response from the Income Tax Department showing that he was employed with an IT company in Mumbai and earned a gross annual income of Rs 27 lakh in FY 2022–23 (approximately Rs 2.3 lakh per month after deductions).
'Despite the husband's false affidavit claiming no income, the RTI reply showed he was earning Rs 2.31 lakh per month. Based on this, we moved the High Court, which modified the earlier district court order and granted a total monthly maintenance of Rs 90,000 — Rs 50,000 to the wife and Rs 40,000 to the autistic child,' the advocate said.
The High Court took this on record and expressed concern that the family court had accepted the husband's claim that he was unemployed without further verification. The High Court also observed that while the wife was a guest teacher in Ranchi, this could not be seen as regular employment, especially given her full-time caregiving duties for a child with autism.
A Division Bench of Justice Sujit Narayan Prasad and Justice Rajesh Kumar noted that the minor child, who has 75% intellectual disability, requires long-term specialised care and medical attention. The court took serious note of the father's alleged failure to take active interest in the child's welfare and remarked that 'desertion of wife is one thing, but desertion of an autistic child is not only a moral failure but a legal default'.
The court also considered the estimated cost of around Rs 53,000 per month, submitted by the petitioner, which includes a child requiring continuous occupational and speech therapy, special schooling, and a structured diet and medical care.
Gupta called the High Court's order a milestone. 'This case is not just about alimony. It's about acknowledging the long-term and unique challenges a single mother faces while raising a child with autism… It's a socially important ruling,' he said.

Man arrested for stealing Rs 10 lakh & motorcycle from employer in Nashik
Nashik: Officials of the crime branch unit 1 of the city police commissionerate arrested Jagatpal Lallar, a resident of Rajasthan, on charges of stealing Rs 10 lakh from his employer. Lallar and his associate, Sushil Bhatt, were caught by police on Monday evening. On June 11, Lallar, who worked as a driver for the complainant, stole Rs 10 lakh and the employer's motorcycle in the Nashik Road area before fleeing the city. Following the complaint, police registered a case under section 306 of the BNS for theft, which was investigated by crime branch unit 1. During the investigation, the police attempted to locate the suspects along the Rajasthan, Haryana, and Punjab borders but were unsuccessful. They then expanded their search to Maharashtra, where they received a tip-off that Lallar and his associate were approaching Nashik from Chalisgaon on the stolen motorcycle. Senior inspector Madhukar Kurd, of the crime branch, set a trap at Mangalur Phata in Chandwad, leading to the arrest of the duo. The suspects, Jagatpal Lallar, 24, and Sushil Rao, 22, both reside in Shivaji Nagar, Takli Road area in Nashik city. They confessed to the crime, and the police recovered the Rs 10 lakh and the stolen motorcycle from them. Katigorah gang attack: 1 gets 8 years in jail, 8 others get 3-month terms
Silchar: A Cachar court sentenced a man to eight years in prison and awarded three-month jail terms to eight others in the Katigorah gang attack case that led to the death of one person and left several others injured sixteen years ago. The verdict was delivered by the fast-track court of additional district and sessions judge Bankim Sharma on Monday in connection with the incident that took place on Aug 26, 2009, at Nij Katigorah in Cachar. According to the prosecution, Sharif Uddin Barbhuiya (52) and eight others stormed the residence of their neighbour Sahir Ahmed Barbhuiya and attacked Sahir's family with weapons and sticks. Three members of the family — Mokbul Ahmed, Mamon Ahmed, and Faruk Ahmed — sustained serious injuries in the attack. Neighbours Nur Ahmed, Abdul Kuddus, and Abdul Salam, who tried to intervene, were also assaulted. In his FIR, Sahir alleged that the attackers looted Rs 20,000 in cash and gold ornaments from the house during the assault. One of the injured, Abdul Kuddus, later succumbed to his injuries. TN cracker factory explosion: Six killed, 5 critically injured
Chennai, July 1 (UNI) Six people, including a woman, were charred to death and five others critically injured in a major explosion at a fireworks manufacturing factory at Chinnakamanpatti near Sattur town in Virudhunagar district, about 540-km south of city, today. Police and Revenue officials identified the deceased as R Mahalingam (55), C Sellapandiyan, Lakshmi Karupasamy, R Ramamurthy (38), K Ramajayam (27) and G Vairamani (32). The injured, including a woman, have been admitted to the Sivakasi Government Hospital and the Madurai Rajaji Government Hospital. According to sources, the deceased as well as the injured were engaged in cracker manufacturing works in the morning when the explosion occurred at the private fireworks factory. Four concrete roofed rooms of the factory were heavily damaged, and smoke engulfed the surrounding area. On receiving information of the incident, Fire and Rescue Service Personnel rushed to the spot and put out the fire and retrieved the bodies of the victims and rescued the injured stuck under the debris. The Sattur Town police have registered a case and have arrested the foreman of the factory for further investigation. Expressing shock and grief over the tragic deaths in the explosion, Chief Minister M K Stalin has offered his condolences to the bereaved. He also announced a solatium of Rs four lakh each to families of the deceased and Rs one lakh each to the injured.
