SC halts IAF's move to release woman officer denied permanent commission

NEW DELHI: Coming to the rescue of an Indian Air Force woman officer who was denied permanent commission, the Supreme Court on Monday, in its interim order, directed the Centre and the IAF not to release her from service until further hearing on August 6.
A two-judge vacation bench of the top court, headed by Justice Ujjal Bhuyan and Justice Manmohan, referred to the May 22 order of the court in which similar directions were issued to the Centre and the IAF.
The apex court passed the order after hearing a plea filed by Wing Commander Niketa Pandey and said the same directions would apply in the case of Wing Commander Kavita Bhati.
Stressing that it was 'without prejudice to the rights of the parties or equity in favour of the officer', the bench posted the matter for further hearing on August 6 before a regular bench, when a batch of petitions related to the IAF would be taken up.
The petitioner, Pandey — who was part of Operation Balakot and Operation Sindoor — claimed that she was denied permanent commission. 'I am unfairly treated and discriminated [against] on the issue of being granted permanent commission,' Pandey further alleged.

The Allahabad High Court on Thursday dismissed a petition that sought to replace the term 'Shahi Idgah Masjid' with 'disputed structure' in all future court proceedings in the ongoing cases related to the Krishna Janmabhoomi-Shahi Idgah dispute. The plea filed with prayer to direct the stenographer concerned to use the word 'disputed structure' in place of 'Shahi Idgah Mosque' in all further proceedings of the original suit and other related cases was supported with the affidavit of advocate Mahendra Pratap Singh who is plaintiff number 5. The prayer was opposed by the Muslim side, the court noted. 'A bare perusal of the pleading of the parties in the suit reveals that there is dispute between the parties with regard to the site where Shahi Masjid Idgah is existing. Parties have claimed their respective title over suit property. Therefore, it may be termed as property in dispute 15. In pleadings of the parties also, the structure in question is referred as Shahi Masjid Idgah and at this stage where hearing of the suits is yet to commence and even issues have not been framed, it is neither desirable nor expedient to issue any direction to stenographer, as prayed by the applicants, to refer Shahi Masjid Idgah in judgments and orders as 'disputed structure',' stated the bench of Justice Ram Manohar Narayan Mishra, in its order. 'There is no dispute with regard to identity of property in suit, therefore, the prayer made in the application A-44 cannot be granted at this stage. The Court in its direction may refer to the property in dispute by appropriate words in further proceedings. application A- 44 is dismissed with above observations,' the bench added. The court also said the applicant (plaintiff number 5) had submitted that the Shahi Idgah mosque was constructed on the exact site historically recognised as the original birthplace of Lord Krishna, one of the most revered deities in Hinduism. The defendants, on the other hand, maintained that there is no provision that allows the plaintiff to dictate a stenographer of the court to refer Shahi Masjid Idgah as a 'disputed property', especially when such words are an attempt to retract from admission made by him and could also amount to an adverse inference against the defence in the suit. The application has been filed with an intent to abuse the process of law, they alleged, adding that the mosque has existed for over 400 years, a fact which has been sought to be undermined by the petition. Allowing the present application amounts to 'pre-determination' at an early stage in the suit that the Shahi Idgah Masjid is not a mosque, the court said. It is also cited the defendant's contention that the plaintiff is trying to introduce a new case 'through backdoor' to negate the admitted fact that Shahi Masjid Idgah is a mosque. Even the existence of the mosque is admitted by plaintiff number 5 in his affidavit and at this stage he will not be permitted to convert the existing mosque into a 'disputed structure' for an ulterior motive, it added. '…A decree of mandatory injunction has also been sought in present suit, with a prayer to get so called structure Shahi Masjid Idgah demolished within period prescribed by the Court and control thereof be handed over to authority prescribed by the Court. A decree of prohibitory injunction has also been sought against defendant no. 1 and 2 with regard to suit property of Katra Keshav Dev. The defendants have controverted plaint's allegations in the written statement and had admitted that Shahi Masjid Idgah was constructed in the year 1669 but denied the allegation that this is an unauthorized construction. The compromise dated 12.10.1968 was rightly filed by the parties in O.S. 43 of 1967 (Shri Krishan Janamsthan Seva Sangh vs. Shahi Masjid Idgah and others). The Shahi Masjid Idgah is a waqf property and has existed in the same state for 400-500 years. The suit is barred by the Places of Worship (Special Provision) Act ,1991, Section 92 C.P.C, under Order VII Rule 3 C.P.C and Order VII Rule 11 C.P.C,' the court said in its order. The bench fixed July 18 as the next date of hearing In January last year, the court had consolidated 15 suits related to the dispute on an application filed by the Hindu plaintiffs. The petitions seek removal of the mosque from the 13.37-acre complex, which it shares with the Katra Keshav Dev temple. Later, an application was moved to recall the order that consolidated all 15 suits filed by the Hindu petitioners. In October last year, the court rejected the application and said the cases have been consolidated 'in the interest of justice'.

Gurgaon: Cities in India will be redeveloped through the Centre's Urban Challenge Fund, under which Rs 1 lakh crore will be allocated. The funds will be utilised to improve the infrastructure of the cities, Union minister for power, housing and urban affairs Manohar Lal Khattar said on Friday. The minister also underlined the need for making urban local bodies self-reliant. He said that while these bodies receive a fixed amount of funding from the central and state govts, achieving true self-reliance must go hand-in-hand with "ensuring transparency and accountability in their functioning". Khattar, who was addressing the concluding session of the two-day National ULB Conference in Manesar, said the best practices from leading cities around the world are being adopted to improve urban living conditions. Citing data, he said the urbanisation in India that was at 20% in 1970 has risen to 36% today and is projected to reach 50% by 2047. "A Memorandum of Understanding (MoU) was recently signed with Spain to facilitate the exchange of successful urban development models between the two countries," the Union minister said. He stressed the need for proper workforce training and the efficient use of time and resources to meet future challenges. Vijayawada: With the AP govt agreeing to shoulder land acquisition cost, the Centre has given green signal for a taking up 140 metres wide outer ring road (ORR) for Amaravati. Initially, the Centre agreed to give 70-metre wide ORR for Amaravati while chief minister wanted it to expand to 150 metres. T hough named Amaravati ORR, it also serves the major cities of Vijayawada, Guntur and Tenala in the AP capital region. It will complement the Vijayawada by-pass road on the west side of the city. The Vijayawada east by-pass road was cancelled as the ORR on the eastern side passes very close to the proposed by-pass road. The technical appraisal committee (TAC) of union ministry of road transport and highways (Morth) headed by secretary apprised that a highway with a width of 70 metres is sufficient to take up six-lane road project as ORR for Amaravati. The committee felt that the right of way (RoW) with 70 metres would also be sufficient to expand the proposed six-lane to eight lane along with providing service roads on both sides. However, Naidu during the meeting with Gadkari insisted that Amaravati is being developed as one of the modern town in the country and the RoW with 70 metres for ORR would not be sufficient for the city's requirement in the next 50 years. He explained that they have already attracted huge investments to the capital city and it would become difficult to go for big ORR in future. He wanted the Centre to grant the ORR with 150 metre width with a promise to take the additional cost of land acquisition by the state govt. The Centre had already estimated that it would cost Rs.2665 crore for land acquisition for 70-meter ORR and asked the state govt to take the additional financial burden over and above it for taking up the 150-meter ORR. Naidu wanted to develop the ORR in a prestigious highway with 12-lane along with separate corridors for railway lane, metro corridors. "The ORR going to be the game-changer infrastructure project of Amaravati," said Telugu Desam Parliamentary Party (TDPP) leader Lavu Srikrishnadevarayalu. He said that Centre had also granted several road infrastructure projects connecting Amaravati ORR following the chief minister Chandrababu Naidu's insistence. He explained that Centre had agreed to connect ORR with two spurs to ensure better connectivity with capital city by scrapping the proposal to take up Vijayawada east bypass. The Centre suspended the Vijayawada east bypass as it found to be parallel to the alignment of the proposed ORR. Two separate connecting roads would be developed connecting ORR with the existing NH-16 in Guntur district. While one road would be developed between Chinakakani and Tenali and other would be taken up near Narakoduru on the outskirts of Guntur city.
