I-Team: Judge rules on dismissal of Browns lawsuit

CLEVELAND (WJW) — The FOX 8 I-Team has learned a Cuyahoga County judge has denied the Cleveland Browns' motion to dismiss a case filed against them by the city of Cleveland and also declined a request to put the case on hold.
Judge Lauren Moore ruled on the Browns case on Friday morning.

The city of Cleveland sued the Browns in January, saying the team is restricted from moving due to the 'Modell Law.' However, last month, the state legislature reworked the Modell Law saying teams can move as long as they do not leave the state of Ohio.
The Browns asked to wait until the federal case is resolved. But since that case is on hold indefinitely, the judge dismissed that request as moot.
The Browns also argued the case was 'unripe,' meaning the city had not yet been negatively impacted by the Browns' move. But the judge ruled the Browns' plan to move out of Cleveland to Brook Park is already a done deal.

The ruling reads in part:
The Browns have made it clear that they will not fulfill their contractual duties with the city. The Browns have given notice to the city that they intend to move, they have finalized the purchase of 167 acres of land in the city of Brook Park, they have given formal notice to the city that they are leaving, they have engaged in frequent strategy and planning meeting with the mayor of Brook Park, they have entered into a partnership with a contractor for the purpose of constructing a new stadium and they are procuring financing. The reality is that the move is not a 'contingent future event.' The Browns have unequivocally announced that it is their intention to leave the Huntington Bank [Field] and they are moving forward with plans to depart from Cleveland to Brook Park. The issue of the Browns leaving the city of Cleveland is [no] longer hypothetical.

Following the ruling, Cleveland Law Director Mark Griffin issued a statement to the I-Team that read: 'We appreciate Judge Moore's diligence in thoughtfully applying the law and look forward to further addressing the merits of our case in her court.'

A spokesperson for the Browns said in a statement the organization is complying with the obligations of its downtown stadium lease, which expires in 2029, and that it remains focused on building the new 'world-class' enclosed stadium in Brook Park.
'We are as confident as ever in our legal position and look forward to a prompt resolution of the city's meritless claims,' the statement reads.

The I-Team has also learned Brook Park has applied for about $80 million in state money for road projects around the dome site.
Cuyahoga County Executive Chris Ronayne said he predicts major traffic headaches around the airport once the Browns start playing in Brook Park.

So, we used three of the four picks on offense, but took a chance at No. 1 overall. First round - S Caleb Downs - Ohio State The Browns spent more than a decade playing four games a year against the combo of Troy Polamalu and Ed Reed so they understand the impact a truly elite safety can have. A safety has never gone No. 1 overall, and that might continue, but no one should be shocked if a player of Downs' caliber ends up there. First round - WR Jordyn Tyson - Arizona State The best route runner in the draft and a complete receiver who can take over a game. The Browns have cobbled together a very average group of receivers this season and can't expect to compete with this combination of talent. Second round - DE LT Overton - Alabama A defense line Cleveland's can never have enough big bodies up front who can rush the passer and stuff the run and Overton is a budding star. Third round - WR Eric Singleton Jr. - Auburn We go back to wide receiver here because Singleton is just such an explosive playmaker and a perfect player to pair up with Tyson no matter who is the starting quarterback.

'Not Smart' - Shedeur Sanders Officially Called Out By Browns

The Cleveland Browns selected Shedeur Sanders in the fifth round of this year's NFL Draft, giving the former Colorado quarterback an opportunity after his slide through the first several rounds. Sanders is set to compete with three other quarterbacks for the starting job in training camp and the preseason, but he raised eyebrows during the offseason for the wrong reasons. The rookie quarterback was cited for two separate speeding tickets this offseason, issues that caused some to question his maturity - and perhaps to justify why he was selected in the fifth round of the draft. The Browns are standing by Sanders despite the controversy, but general manager Andrew Berry acknowledged the issue on Thursday at the team's practice facility. "Not smart. Just not smart," Berry said while speaking to reporters. "It's something that we've addressed with him. Look, he understands the implications, he understands the consequences. It's not just about yourself. It's not just about having a joyride, but that you could injure other people...a deer or something cuts out in front of you, your reaction time. It's just dangerous." Sanders was officially cited twice for speeding in June. The first incident took place on June 5, when he was pulled over by the Ohio State Patrol, who said the quarterback was driving at 91 MPH in a 65 mph zone. The second citation came in the middle of the month, and police records indicate that Sanders was driving at 101 MPH in a 60 mph zone. Following his speeding violations, Sanders has been active in the Cleveland community. He organized a community event after a devastating fire that displaced more than 40 residents from an apartment complex in the city. The "Garden Valley Fun Fest" included free food, games haircuts and more for local residents. "I just wanted a day for everybody to get out here and have some type of enjoyment, excitement, bring just the family atmosphere back," Sanders said, speaking to News 5 Cleveland. The rookie attended the event with his teammate Mike Hall Jr., a former standout for the Ohio State Buckeyes. We'll see how Sanders' rookie season goes as he embarks on his NFL journey.
