Ensure panel formed to curb unauthorised constructions meets once a month: HC

The Hindu6 days ago

The Madurai Bench of the Madras High Court has directed the Chief Secretary to ensure that the High-Level Monitoring Committee constituted to curb unauthorised constructions meets once a month and submits monthly reports to the government.
A Division Bench of Justices S.M. Subramaniam and A.D. Maria Clete observed that the committee's functions must be periodically monitored by the government and any inaction must result in an appropriate action against the authority who failed to implement the G.O. and committed dereliction of duty. The efficient functioning of the committee was not made clear by the authorities, the court observed.
It further observed that a holistic reading of the Act and the Rules covering urban and panchayat areas with regard to unauthorised constructions would be sufficient to form an opinion that building constructions must be undertaken only after obtaining building plan permission from the competent authorities as stipulated in the applicable provisions of the Act and the Rules.
Regularisation, condonation or otherwise were only enabling provisions and must be granted exceptionally in deserving cases where an injustice had been caused. However, regularisation could not be claimed as an absolute right. The unauthorised and illegal constructions could not be regularised in a routine manner by the authorities, the court said.
Unauthorised constructions posed a danger to the public and caused environmental damages. Greedy men were emboldened to construct buildings unauthorisedly in urban areas and rural areas, thereby causing inconvenience to neighbours and road-users. They converted fertile lands into a concrete jungle and deprived others of a peaceful living. Authorities failing in their duty to deal with unauthorised constructions must be subjected to departmental disciplinary proceedings, the court observed.
The authorities were not expected to wait for complaints from anyone. They were duty bound to monitor construction activities. Field-level officials must ensure that buildings were constructed in accordance with the building plan permission and violations were to be dealt with in accordance with law swiftly. Violations must be identified at the initial stage of construction, which would prevent financial and other loss to all concerned.
The court was hearing the petition filed by M. Daniel Simiyon Sudan, seeking a direction to the authorities to remove unauthorised construction/rice mill in Srirangam in Tiruchi district. The court directed the authorities to initiate enforcement action and demolish the constructions, if any identified, in eight weeks. The matter was posted for reporting compliance to August 7.

T.N. set to begin land acquisition process for Parandur airport project

The Tamil Nadu government is all set to begin the land acquisition process for the city's second airport at Parandur. The State issued a Government Order (G.O.) on June 25, giving a direction to begin land acquisition under the Tamil Nadu Acquisition of Land for Industrial Purposes Act, 1997. Several villages, including Parandur, Valathur, Ciruvallur, Gunakarapakkam, Akkamapuram, Magadevi Mangalam, Eganapuram, Podavur, Nelvoy, Thandalam and Thodur, will be affected by this project. According to the G.O., based on the proposal of the Commissioner of Land Administration, the government has fixed a flat rate of ₹35 lakh to ₹60 lakh per acre, inclusive of all components for 1,960.63 acres of lands whose guideline value range from ₹5 lakh to ₹17 lakh per acre in Kancheepuram and Sriperumbudur taluks. The Kancheepuram Collector can also fix compensation through private negotiation for 374.53 acres of land (in Akkamapuram, Nelvoy and Thandalam) whose guideline value ranges from ₹5 lakh to ₹17 lakh per acre. In villages including Parandur, Maduramangalam, Singilipadi, Gunakarapakkam, Edayarpakkam, Akkamapuram, Magadevi Mangalam, Eganapuram, and Koothirambakkam, which measure 996.09 acres of land in total, as the guideline value is over ₹17 lakh per acre, the owners will also get compensation based on private negotiation. In some locations, the compensation through private negotiations could be as much as ₹60 lakh to even ₹2.57 crore per acre. In cases wherein the land owners are unwilling to accept the compensation rates, the government has directed the officers to pursue the land acquisition process by adhering to statutory steps under the Tamil Nadu Acquisition of Land for Industrial Purposes Act, 1997, and determine the compensation accordingly. In 2023, the State government issued administrative sanction for acquisition of 1,527.32 hectares of patta lands, and alienation of 798.12 hectares of government lands in Sriperumbudur and Kancheepuram taluks for this project.

52 villages adjoining LAC, LoC in Leh, Kargil districts declared reserved areas

Fifty-two villages along the Actual Line of Control (ALC) have been declared reserved by the administration of the Union Territory of Ladakh to enable residents of these identified areas to avail reservation benefits in recruitment and other sectors, a notification issued on Sunday said. The Ladakh administration has achieved yet another milestone with the issuance of an official notification declaring specific areas as adjoining the Actual Line of Control under the provisions of the Jammu and Kashmir Reservation Act, 2004, as amended by the Ladakh Reservation (Amendment) Regulation, 2025, an official spokesperson said. As per the notification, this includes 18 revenue villages in Leh district situated along the Line of Control (LoC) and Line of Actual Control (LAC), and 34 revenue villages in Kargil district situated along the LoC. This declaration will enable residents of these identified areas to avail reservation benefits as specified in the amended Ladakh Reservation Rules, it said. The declaration follows a structured process initiated by the administration through a one-member Commission under the chairmanship of Justice Bansi Lal Bhat, a former judge of the High Court of Jammu and Kashmir and Ladakh. The Commission was tasked with identifying areas, villages and hamlets adjoining the ALC in Ladakh for reservation benefits under the Act, the spokesperson said. The Commission submitted its final report to the administration in December 2024. An internal committee constituted to examine the Commission's findings reviewed and recommended acceptance of the identified areas listed in the schedule to the report, he said. Based on these recommendations, the administration has officially accepted and declared the areas, villages and hamlets listed in the report as areas along the ALC for the purpose of reservation under the Act.

Himachal Pradesh government takes strict action against drug related activities among employees and launches anti drug campaign

Shimla: Himachal Pradesh chief minister Sukhvinder Singh Sukhu on Sunday sounded the alarm over the growing nexus between drug traffickers and govt staff, revealing that more than 80 state employees — including police officers — face legal proceedings for drug-related offences. S peaking at the 12th HP Police Half Marathon in Shimla, Sukhu said the state govt was preparing a large-scale anti-drug operation, including the possible amendment of the police manual to enhance accountability within the force. "Even those expected to uphold the law are falling prey to the drug menace," the CM said. "We are mapping the problem down to the panchayat ward level to carry out targeted interventions." Sukhu announced that the state will raise a special task force to intensify the crackdown, with recruitment in progress already. As part of the effort, 500 new police posts will be created to bolster enforcement. He also underscored a dual strategy combining strict law enforcement with a compassionate approach towards drug victims. The govt has invoked the PIT-NDPS Act — which Sukhu claimed had remained dormant under the previous BJP govt — to detain habitual offenders. Of the 40 preventive detention orders approved under the Act, 36 were issued this year. In a further sign of zero-tolerance, the state has demolished properties of seven convicted drug peddlers and is pursuing similar action against others. During the event, the CM also felicitated winners across various categories of the half marathon, including men's, women's, and senior citizens aged 75 and above. MSID:: 122143816 413 |
