A Bench comprising Chief Justice Vibhu Bakhru and Justice C.M. Joshi passed the interim order on an appeal filed by the BBMP challenging the single judge's verdict, which had set aside amendments to the BBMP Act to levy these fees based on the 'guidance value.'

However, the Bench made it clear that the BBMP will have to refund the fees that it collects during the pendency of the proceedings if the final judgement on the appeal goes against the BBMP.
The single judge had said that services related to the sanction of plan for building construction rendered by the BBMP had nothing to do with the market value of the property.
He had said there was no logic in linking rates with the guidance value of the properties in different areas, notified by the government under the Karnataka Stamp Act for the collection of stamp duty, while emphasising that at best, a uniform rate can be levied depending upon the size of the plot and the extent of constructions.

Telangana high court relief for NRSC in GST dispute
Hyderabad: The Telangana high court granted relief to the National Remote Sensing Centre (NRSC) in a pending tax liability dispute. While directing the tax authorities not to take any coercive steps against the institution, a division bench of chief justice Aparesh Kumar Singh and Justice P Sam Koshy directed the NRSC to deposit 10% of the assessed tax liability. NRSC, based in Hyderabad, works under the dept of space, govt of India, and is responsible for remote sensing satellite data acquisition and processing, among its many other vital operations. In its petition, NRSC requested the court to declare the tax order issued by the authorities as arbitrary, illegal, and in violation of constitutional rights. NRSC further urged the court to set aside the tax demand and suspend its implementation while the matter is under judicial consideration. During the hearing, counsels from all parties, including the Central govt and the Central Board of Indirect Taxes and Customs, reached a consensus to dispose of the matter in line with an earlier high court order in a similar matter. Accordingly, the court gave interim relief to the agency and allowed it to approach the relevant tribunal within three months from the date of its constitution. The high court further ordered that no coercive action be taken against the agency until the tribunal decides the second appeal and disposed of the matter.

Karnataka high court tells govt to file status reporton pending Sakala applications
Bengaluru: The Karnataka high court has directed the state govt to file a status report on the number of pending applications under the Sakala Services Act. The date on which such applications were filed and the estimated time required for their disposal also need to be indicated in the report, which should be filed in four weeks, a division bench comprising Chief Justice Vibhu Bakhru and Justice CM Joshi observed in their order. The next hearing will take place on Oct 29. The court was hearing a PIL filed by S Gowri Shankar, a resident of Bengaluru. The petitioner requested the court to pass an order to the effect that interest or penalties levied on property owners due to delays by BBMP should be returned to the taxpayers or adjusted against future taxes. However, the court declined to accept this request. In the event any particular taxpayer is aggrieved by the imposition of interest despite delays on the part of the authorities, he would be entitled to seek appropriate remedies," the bench observed. In his petition filed in 2022, Gowri Shankar also said the process to claim a refund should be formulated and communicated to eligible property owners. He sought that all pending Sakala appeals should be immediately disposed of, along with the disbursal of compensation to eligible applicants and actions initiated against wilful defaulters.

HC junks Turkiye aviation company's plea

NEW DELHI: Delhi high court bench of Justice Tejas Karia on Thursday dismissed a plea by the Turkish-owned company Celebi Ground Handling India Pvt Ltd against government's decision to revoke its security clearance. A copy of the detailed order is awaited. Earlier this month, a different bench had dismissed petitions by Turkish firms Celebi Airport Services India Pvt Ltd and Celebi Delhi Cargo Terminal Management India Pvt Ltd challenging the revocation of their security clearance by the Bureau of Civil Aviation Safety (BCAS), saying there were "compelling national security considerations" involved. In May, BCAS had revoked the security clearance after Turkiye backed Pakistan and condemned India's strikes on terror camps in the neighbouring country. The court on July 7 underlined the necessity to eliminate the possibility of espionage or dual use of logistics capabilities, which would be highly detrimental to the security of the country, especially in the event of an external conflict. In its detailed ruling on the earlier petitions, the high court had upheld the govt's reasoning and decision.
