In a first of its kind lawsuit involving children, a Honduran mother and her two young children have sued the US government over their arrest outside a Texas courthouse, alleging violations of constitutional rights.
The family, who legally entered the US using the CBP One app, is detained at the Dilley immigration processing center and is fighting for release, according to the news agency AP.
Filed in Texas, the lawsuit argues that their arrest violated the Fourth Amendment's protection against unlawful searches and seizures and the Fifth Amendment's guarantee of due process. According to their legal team, led by Columbia Law School professor Elora Mukherjee, the family complied fully with immigration procedures before being taken into custody.
The mother and her children fled Honduras in October 2024 following death threats. After being paroled into the US by the department of homeland security, they were scheduled to appear before an immigration court in Los Angeles on May 29. But immediately after the judge dismissed their case, ICE agents allegedly arrested them outside the courtroom, placing them in expedited removal, a fast-track deportation process.

Their lawyers argue the arrest was traumatic, especially for the 6-year-old boy, a leukemia patient who missed a vital check-up due to the detention.
"He's pale, bruising, and suffering bone pain,' Mukherjee said, adding that the boy urinated on himself in fear after an officer exposed a firearm.
Though their appeal is pending, the family could be deported any day. Advocates say the case highlights growing concerns about the Trump administration's continuation of aggressive immigration enforcement, particularly at courthouses.
"This family followed every rule," said attorney Kate Gibson Kumar of the Texas civil rights project. 'With young children involved, there must be protections.'
The department of homeland security has not commented. The government has until July 1 to respond to the lawsuit.

What's in latest version of Trump's big bill now before Senate

AP At some 940-pages, the legislation is a sprawling collection of tax breaks, spending cuts and other Republican priorities, including new money for national defense and it's up to Congress to decide whether President Donald Trump's signature's domestic policy package will become law. Trump told Republicans, who hold majority power in the House and Senate, to skip their holiday vacations and deliver the bill by July 4. Senators were working through the weekend to pass the bill and send it back to the House for a final vote. Democrats are united against the latest on what's in the bill. There could be changes as lawmakers negotiate. Tax cuts are priority Republicans say the bill is crucial because there would be a massive tax increase after December when tax breaks from Trump's first term expire. The legislation contains roughly USD 3.8 trillion in tax existing tax rates and brackets would become permanent under the bill. It temporarily would add new tax breaks that Trump campaigned on: no taxes on tips, overtime pay or some automotive loans, along with a bigger USD 6,000 deduction in the Senate draft for older adults who earn no more than USD 75,000 a would boost the USD 2,000 child tax credit to USD 2,200 under the Senate proposal. Families at lower income levels would not see the full amount.A cap on state and local deductions, called SALT, would quadruple to USD 40,000 for five years. It's a provision important to New York and other high tax states, though the House wanted it to last for 10 are scores of business-related tax wealthiest households would see a USD 12,000 increase from the legislation, which would cost the poorest people USD 1,600 a year, according to the nonpartisan Congressional Budget Office analysis of the House's taxpayers would see a tax break of USD 500 to USD 1,500, the CBO said. Cuts to Medicaid and other programmes To help partly offset the lost tax revenue and new spending, Republicans aim to cut back some long-running government programmes: Medicaid, food stamps, green energy incentives and others. 'Big beautiful bill': US Senate clears Donald Trump's ambitious bill for debate with 51-49 vote; Republicans rush to clear it by July 4

Donald Trump. (AP) Senate Republicans in the United States took a key step on Saturday (local time) towards passing President Donald Trump's proposed economic package, which includes tax cuts, spending reductions, and increased funding for deportation efforts. However, the final fate of the bill remains uncertain as more hurdles lie ahead. In a closely watched vote late Saturday night, the Senate passed a procedural motion 51-49, allowing the chamber to begin debating the bill. US vice president JD Vance was present in case his vote was needed to break a tie. Two Republican senators joined all Democrats in voting against the motion. President Trump , who has referred to the legislation as his "big, beautiful bill," wants it passed before July 4. He spent the day at his golf course in Virginia, while some Republican senators posted photos with him on social media. The bill, nearly 940 pages long, was released late Friday night. Debate is expected to continue through the weekend, with multiple amendments and votes ahead. If the Senate passes the bill, it would return to the House of Representatives for a final vote before reaching Trump's desk at White House. Republicans, who currently hold a majority in both chambers, are pushing forward despite opposition from Democrats and some within their own party. by Taboola by Taboola Sponsored Links Sponsored Links Promoted Links Promoted Links You May Like Explore Home Solar Installation Careers and Training Options LocalPlan Search Now Undo Some GOP lawmakers have raised concerns about proposed cuts to programs such as Medicaid and food stamps, which are aimed at offsetting the costs of extending tax breaks worth around $3.8 trillion. Earlier, the White House issued a statement saying it 'strongly supports passage' of the bill, calling it important for achieving the president's goals. 'It's time to get this legislation across the finish line,' said Senate Majority Leader John Thune. Meanwhile, Elon Musk, a former Trump adviser, criticised the bill. "The latest Senate draft bill will destroy millions of jobs in America and cause immense strategic harm to our country!' Musk said in a post, calling the package "utterly insane and destructive."
