Pavement parking ban helps Prestwick store overturn council decision

The Keystore in Adamton Road North, Prestwick, argued that there is no need for bollards to stop pavement parking now that new law is in place.
The new ban on pavement parking in South Ayrshire has resulted in an unanticipated change of heart from councillors.
Last year, South Ayrshire Council's Local Review Body approved a plan for a Prestwick store to introduce a hot food takeaway to its premises.

The application for the Keystore in Adamton Road had originally been refused by planners, with the issue of traffic and increased usage of the shop among the reasons given.

That was overturned on the condition, recommended by Ayrshire Roads Alliance, that the shop owners agreed mitigation measures to prevent pavement parking, including the installation of bollards.
However, that promise was never met and the owners took the decision to appeal the outcome of the appeal.
Part of their argument for removing the condition around parking was the introduction of the pavement parking ban and the irony that mitigations, such as bollards, would narrow the pavement, causing access issues to the public, particularly wheelchair users and the visually impaired – one of the reasons for bringing in the ban in the first place.
Planning officer James Hall told the Local Review Body that the owners had pointed out that the hot food element only made up five per cent of the goods sold, there was little community objection or evidence of problems, and that it would impact accessibility to a neighbouring hairdresser.
They also said that they felt the cost of implementing mitigation measures, such as bollards, would be too high for them and that the requirement could become a precedent for other small retailers.
Some councillors took the issue of the pavement parking ban one step further, questioning why, having introduced a ban, the council would be putting the onus on a business to deter the practice.

Conservative councillor Martin Kilbride said: 'I do understand a year ago why there was talk of bollards, because it was to make sure that the cars weren't parking on the footpath, to allow access for pedestrians to safely get from A to B.
'We've now got a pavement parking ban in place.'
He said there was evidence that the ban was being adhered to, putting a further question to the need for the condition.

'So, the pavement parking ban has worked. The reason for the bollards was to keep the footpath open for people in wheelchairs and with disabilities.'
He was backed by Conservative colleague Lee Lyons, who said: 'What we are effectively doing is taking an already narrow path and making it narrower to prevent someone potentially parking on the pavement, when we have just brought in a new pavement parking ban.
'So we are effectively got a policy that you can't park on the pavement, but we are asking someone to put in bollards to basically enforce a law.

'I don't see why we're doing both. Either the law in itself is sufficient and should be policed or it's not and we have to build a fence by the side of the road.'
He called on the committee to approve the request to scrap the condition as a result.
Other councillors took issue with the fact that Ayrshire Roads Alliance had maintained their stance despite the change in the law, did not attend Tuesday's hearing to answer councillors' questions and had simply not answered when asked for comment ahead of the meeting.

Councillor Mark Dixon wanted to defer a decision in order to get answers from ARA, after the summer recess and was backed by Labour member Ian Cavana.
The motion to approve the request to remove the condition was agreed by three votes to two.

Planners at East Renfrewshire Council had recommended Westpoint Homes' proposal for the former Mearns Primary School site was given the go ahead. But the planning committee rejected the scheme amid concerns over the access road and the suitability of the site. The decision came after over 20 objections, many from residents in nearby Scholars Court, which raised a number of issues including overlooking, over-development and the height of the buildings. The overflow car park sits behind a Marks & Spencer foodhall and beside a Royal Mail sorting office and Mearns library. M&S had concerns about the impact on delivery and servicing access to its store while Royal Mail was worried about 'potential noise complaints' from new residents. Westpoint wanted to build two blocks of flats, each with a private balcony or terrace, to be marketed to over-55s due to pressure on school places in East Renfrewshire. A council report stated the owners of the site had monitored the demand for parking and confirmed the car park is 'surplus to requirements and that sufficient car parking within the remainder of the site can accommodate demand'. Planners added the site is 'considered to be a highly sustainable location for residential development' and the scheme was 'considered to be of a design, scale, height, massing and density that is in keeping with the buildings in the locality'. 'Any potential adverse overlooking has been addressed by means of privacy screens.' They also reported the proposal would not be 'considered to give rise to significant additional overlooking' and the council's road service had no objection to the plan, subject to conditions which would have been attached to the planning permission. However, Cllr Andrew Morrison, Conservative, said he was 'still quite concerned about vehicle access to this, because the existing road is single track in parts'. He said while there was a proposal to widen the road, it is 'essentially going to be a shared space with a significant number of HGVs'. A council planner said there was an 'expectation' that the road would be widened. He highlighted there was no objection from the council's roads team. However, Cllr Morrison moved the application was rejected as he believed it would result in 'significant loss of character and amenity to the surrounding area' and wasn't 'appropriate to the location'. He added it did not provide safe access. 'There are complaints from residents already with respect to HGV movements in the goods yard which is from the residents of Scholars' Court and this application will be even closer to said yard.' His motion was seconded by Cllr Paul Edlin and permission was refused. Provost Mary Montague had been in favour of approving the application.

'Torness has to close: but we'd welcome a new reactor'

Currently, about 550 full-time EDF employees are based at the nuclear power station, with a further 180 full-time contract partners. That makes the power station among the largest employers in the south-east of Scotland. However, the station will stop generating power in less than five years' time. Already, EDF has confirmed that various career opportunities will be available for those employed at the power station, located off the A1. Councillor Norman Hampshire, leader of East Lothian Council (Image: Contributed) Councillor Norman Hampshire (Labour) has represented the area for more than 30 years and was part of the construction team at the power station when he was first elected in 1988. The East Lothian Council leader said: 'Torness is close to my heart. 'I have two sons-in-law who work in the station and it is really their job; if Torness was not there, they would likely have to travel away from here. 'Both are engineers and I had a grandson who was there as well. 'He is an electrical engineer as well and he has taken a year out and is away living in Australia, but his job is there for him when he comes back. 'The family connection is really strong and Torness is of huge, huge importance to the Dunbar economy but also the East Lothian economy as a whole with people working there.' He described it as 'a huge blow' if the county were to lose the power station and pointed to the increasing demand for electricity across the country. Mr Hampshire said that this would only continue and said nuclear power was able to provide electricity '24 hours a day, seven days a week'. He called for a greater examination of a new nuclear facility, such as a modular reactor, being created on the site. He said: 'We have made that quite clear to EDF when we have been speaking to them. 'We would support a new conventional nuclear power station. 'Rolls Royce have now been appointed by Government to deliver modular reactors in the UK. 'They have got a test site somewhere south of the Border and we would support a modular reactor to be delivered at Torness. 'If it were possible to get a new conventional station, we would support that, but we need the Scottish Government to change its current stance against any new nuclear. 'We have got a real issue that in the future we are going to have a lot of renewable energy but, when we have no wind, then the country will be struggling to keep the lights on, unless we can import power from south of the Border, and that is not the way we should be looking to develop our energy system.' She said: 'You see a line of cars coming out of Dunbar in the morning. 'It is a massive employer. 'I think they really need to look at how they can retain as many people as possible for decommissioning.' Nuclear power stations at Hunterston B and at Sellafield in Cumbria are among the stations to have stopped generating power in recent years. Mrs Collins said: 'It is learning lessons from those decommissioning projects and making sure mistakes are not made here and it is as smooth as possible, any way they can move people to other jobs and they can minimise redundancies.' Finally, Councillor Lyn Jardine (SNP), who also represents the Dunbar and East Linton ward, described Torness as 'a fairly significant employer'. Councillor Lyn Jardine (Image: Contributed) The leader of the opposition on East Lothian Council said: 'Having been there a couple of times and being something of an engineering geek myself, I am aware that the vast majority of jobs are general engineering jobs rather than specific to the nuclear industry. 'I would hope there would be significant opportunities for the workforce to retrain or direct their skillset – and they have a huge skillset – especially if you look at the extent we have got renewable energy coming into the area as well, I would hope there is a bit of a crossover. 'Torness has to decommission, which will happen over a period of several years.' Douglas Alexander (Labour), Lothian East MP, echoed Mr Hampshire's calls for further consideration to be given for new nuclear facilities in Scotland. 'It also supports further jobs and the local economy through its supply chain and use of contract workers. 'As it approaches the end of its lifetime, many staff at Torness will be involved in the process of defuelling and decommissioning the plant, which will take several years. 'EDF has experience of this at other sites, including Hunterston B, and I'm sure it will be working with trade unions and other partners to support staff through the various phases of its closure in the coming years. 'However, I also hope to see a change in the Scottish Government's current block on new nuclear projects in Scotland to allow for the possibility of the Torness site having a longer-term future in providing skilled jobs and generating clean, consistent nuclear power.' He said: 'The SNP think the investment is much better placed in areas of renewable energy, which is cheaper to produce and is also cheaper for consumers. 'I am aware of figures around 450-500 staff being employed at Torness, in addition to contractors. 'In 2021, when I was elected, I set up the East Lothian Energy Forum meeting with renewable energy providers and local companies looking to benefit from the growth of renewables, such as Sunamp and HadFab in East Lothian amongst others who have seen an increase in their employment. 'I meet with Torness station manager Paul Forrest on a regular basis as we move towards 2030. 'Paul managed the process of closing Hunterston, which was managed very well. 'We discuss the role of EDF, enterprise agencies and Scottish Government in that process. 'Torness are also part of the East Lothian Energy Forum. 'EDF also has a renewables division, where with them, EDF and others, we are looking at the opportunities for hydrogen in East Lothian.' A spokesperson for EDF pointed to what happened at Hunterston B in Ayrshire as it approached the end of its life. They said: 'During defueling at Hunterston B, people were trained to take on project management roles, which the station needs more of now. 'People have also been supported to gain additional qualifications in HGV driving or electrical skills which are needed on site during defueling but can also be used to build a career outside of the nuclear industry. 'Now Hunterston B is getting ready to transfer to Nuclear Restoration Services (NRS), there are further opportunities for retraining to take on jobs the station will need during decommissioning like health physicists and waste technicians. 'We expect to see the same kinds of opportunities at Torness when it reaches this stage.'

A push to axe the council's support for a controversial upgrade to a congested city roundabout has been snuffed out by the city's transport boss. Plans to upgrade the busy Sheriffhall Roundabout, the only flat junction on the bypass, have been in the works since 2018, but work has not yet started on the project. At a committee meeting yesterday, the city's Green group made a bid to cut the council's support for the flyover, saying money could be better spent elsewhere. It was rebuffed by the city's transport leader, although he admitted building new infrastructure on the city bypass was not 'ultimately' the solution to increased traffic caused by population growth in the Lothians. While the bypass is Transport Scotland's responsibility, cutting the council's support would have sent a strong message of dissatisfaction with the project to Holyrood. Greens, both at the council and in the Scottish Parliament, have long opposed the flyover on the grounds that it could cause induced demand – the phenomenon by which adding more road infrastructure in an area can cause more people to start driving. They say that money should instead be spent on improving public transport links and building infrastructure to allow for more walking and cycling. Councillor Kayleigh Kinross-O'Neill, the Greens co-leader, said: 'Congestion is a human issue, no matter where and what it is, that unfortunately needs human-led behaviour change. 'We note the issues faced, and think we should be moving away from the conversation of the roads and staying on the path – no pun intended – of priortising walking, wheeling and cycling, and reducing car dependency. 'Totally appreciate that Sheriffhall is above all of us, and we're still awaiting the results of the public local inquiry. However we're all pretty tired of waiting, and we know there are better ways money could be spent across the region.' Cllr Kinross-O'Neill said some possible options could be putting money towards the trams, more park and rides and expanded bus lanes in the capital. She continued to say: 'We request that we withdraw the favour and support of the scheme, [or] any sort of waste of time road improvements that would cause congestion, not tackle it.' The exchange came as part of a debate over a motion by Conservative councillor Neil Cuthbert calling for action on congestion on the city bypass, as well as modelling on what future traffic could look like on the road. Edinburgh's Green group added their request to scrap support for the flyover as an amendment to the motion. Transport and Environment Committee convener Stephen Jenkinson moved no action on Cllr Cuthbert's motion, which also eliminated the Green amendment. He said: 'One of the main reasons that there are times where the bypass does get congested – and it does get congested, from time to time I am stuck on it – It's as much to do with population growth, not only in Edinburgh, but predominantly in East Lothian, which has increased the traffic on the bypass. 'So how do you tackle it? I don't think that building a flyover is ultimately the solution. What you have to do is actually do things to do what you can to remove the traffic, to get it back to norms. 'So public transport solutions, like tram, potentially bus rapid transport links to East Lothian and Midlothian, are the long term solutions in regards to giving the people using the bypass an alternative option.' The debate over the flyover comes amid wider questions over the future of the project. A need for it was identified 17 years ago, and in 2018 it was included in the Edinburgh and South East Scotland city region deal, which put £120 million towards the project. But it has lumbered along slowly through the planning process, with more than 2,700 objections to its construction leading to an inquiry. Though it was submitted in October of 2023, the Scottish Government is still reviewing the inquiry's report. Earlier this month, Transport Secretary Fiona Hyslop told MSPs that she is waiting on advice from senior Scottish Government officials on the next steps for the project.
