Survivors of deadly UPSI bus crash plan legal action against driver and company

KUALA LUMPUR, June 28 — A group of Universiti Pendidikan Sultan Idris (UPSI) students involved in the fatal bus crash along Jalan Jeli-Gerik, Perak, on June 9 plan to take legal action against the bus driver and the company operating the vehicle.
In an interview with Harian Metro, published today, one of the survivors, Abdul Wafiy Kamarudin, 23, said the move was aimed at securing appropriate compensation and justice.
He said the lawsuit would also serve as a reminder for all drivers to act responsibly on the roads.
'The claim involves compensation for injuries and the loss of personal belongings during the incident.
'It will be filed once all documentation with the relevant agencies is completed,' he reportedly said.
According to him, more victims are being gathered to join the suit.
'So far, most of my friends have agreed to proceed with the legal action with support from our lawyers.
'A capable legal team is ready to take the case to court,' he said, following discussions with lawyer Mahmud Jumaat.
Mahmud said he and his team would provide legal assistance to the families involved, in line with the law, to ensure they receive due justice.
He added that many of the victims' families, including that of Nor Erika Elysha Mohd Zaidi, 21 — who suffered serious injuries — had entrusted his team to proceed with the lawsuit.
'What's most concerning is the reported involvement of third parties — brokers posing as lawyers — offering false promises to victims.
'In return, these individuals expect commissions from the law firms they refer.
'What matters now is ensuring these families receive the support and justice they deserve after such a heartbreaking tragedy,' he said.
The June 9 crash, which occurred along the Gerik-Jeli East West Highway near Tasik Banding, involved a bus carrying UPSI students and a car.
A total of 48 individuals were involved in the incident, with 13 pronounced dead at the scene and two more succumbing to injuries in hospital, bringing the death toll to 15.
On June 20, Road Transport Department (JPJ) director-general Datuk Aedy Fadly Ramli said the agency was in the final stages of completing its investigation papers.
These would be handed over to the deputy public prosecutor to consider potential legal action against the bus company and its operator.

He emphasised that shared residences with members of the public could compromise student safety, especially for female students, and urged universities to allocate dedicated blocks or areas exclusively for them. 'In short, universities must dedicate a block or area for students only, especially female ones,' he was quoted telling The Star. 'If an apartment or condominium used as an off-campus hostel also houses tenants who are members of the public, security will not be at an optimum level.' He said universities must also install sufficient security infrastructure, including CCTV cameras, guards and access card systems, at student lodgings. 'It will greatly assist in security monitoring and ensuring the safety of students,' he said. Police will also work with the management staff of universities to highlight the importance of these security measures, he added. Hussein said student safety must always be prioritised, and must not be taken for granted. His remark came after the murder of Maniishapriet Kaur Akhara, a Bachelor of Physiotherapy student from Kuching, at University of Cyberjaya. She was found unconscious in her off-campus accommodation on Tuesday morning, and was pronounced dead shortly after police arrived at the scene. Sepang police said there were no signs of forced entry or sexual assault but reported that the victim had suffered head injuries consistent with blunt force trauma. Three suspects have since been remanded for one week starting Friday, to assist in the investigation under Section 302 of the Penal Code for murder.

GEORGE TOWN, June 29 — A 62-year-old retired airline programme manager recently lost RM436,000 of her life savings after falling victim to an online investment scam involving fake initial public offering (IPO). Penang Deputy Police Chief Datuk Mohd Alwi Zainal Abidin said the woman lodged a report with the Timur Laut Commercial Crime Investigation Division after discovering she had been deceived by a fraudulent scheme. The scam was promoted through a WhatsApp group called 'enspire capital', which promised high-returns through IPO investments. The victim was instructed to download an app named 'freeman plus' as the investment platform. 'Between May 12 and June 2, she made 56 fund transfers to four different company accounts. Despite the promises, she received no returns. Instead, the suspects kept requesting additional payments,' he said in a statement last night. Investigations found the victim used her personal and Employees Provident Fund (EPF) savings to finance the so-called investments. Mohd Alwi said efforts are ongoing to identify and track down the syndicate responsible. The case is being investigated under Section 420 of the Penal Code for cheating. — Bernama

KUALA LUMPUR, June 29 — Police received three police reports about an incident that occurred during a rally held in the capital yesterday afternoon, including a scuffle that resulted in minor injuries to a police personnel. Dang Wangi district police chief ACP Sulizmie Affendy Sulaiman said the rally, which was joined by about 100 people, began at 3.02 pm outside a shopping mall along Jalan Tuanku Abdul Rahman before it proceeded to Dataran Merdeka, Jalan Raja. A participant lit a flare at about 4.30 pm, causing thick smoke that could have threatened the safety and health of other participants, security personnel and the public in the vicinity. 'The police took preventive measures to control the situation but there was a scuffle between participants and personnel till a police personnel suffered minor injuries,' he said in a statement today. An investigation paper was opened under Section 353 of the Penal Code, as well as Section 3(5) and 14 of the Minor Offences Act 1955. He also advised the public not to speculate as it could disrupt investigations and to channel related information to the Kuala Lumpur police hotline at 03-2115 9999 or the Dang Wangi police headquarters control centre at 03-2600 2222. — Bernama
