First criminal conviction linked to Capture referred to Court of Appeal

The Criminal Cases Review Commission (CCRC) said the case of Patricia Owen, who was found guilty of five counts of theft in June 1998, has been referred on the grounds that it was an abuse of process.
Mrs Owen pleaded not guilty to all five charges after the Broad Oak Post Office branch in Sweechgate, Canterbury, was left with a shortfall of £6,000.
She received a sentence of six months' imprisonment, suspended for two years.
The case is being sent to the Court of Appeal posthumously following an application by Mrs Owen's family after she died in 2003.
Mrs Owen's legal team stood down an independent IT specialist on the day of her trial despite Adrian Montagu's report concluding that 'bugs and errors existed in sufficiently significant numbers and seriousness' and that any evidence relying on the system 'must be regarded as very unsafe'.
The CCRC said in March that it was examining 27 cases to determine whether the Capture accounting software played a part in convictions.
The Capture system pre-dated the now infamous Horizon software – which has been responsible for almost 1,000 wrongful convictions.
An independent report into Capture was commissioned last year after subpostmasters said they had suffered similar problems to those faced by the Horizon victims.
The CCRC said it has sent more than 70 cases associated with the Post Office Horizon scandal to the appeal courts.
Solicitor Neil Hudgell, whose firm Hudgell Solicitors represents more than 100 people affected by the Capture system, said the referral is a 'hugely positive step'.
He said: 'This is another landmark moment in the continuing campaign to ensure all those who were wrongly prosecuted at the hands of the Post Office have their names cleared.
'Those who were affected by Capture have suffered the longest of all.
'It is important to recognise that we await the Post Office's position on this matter, and whether it will offer any evidence against Mrs Owen's conviction being overturned, and then of course the Court of Appeal's decision itself.
'I was always struck by how Mrs Owen protested her innocence throughout, pointing the finger of blame at the system.
'Why compelling IT evidence was not used in court remains a mystery.
'However, this is a hugely positive step, and we hope this is the first of many cases to be referred for consideration.'
In a statement, the Department for Business and Trade said: 'We recognise that postmasters have endured immeasurable suffering, and we are working closely with those affected by Capture software to create a new redress scheme.
'Ensuring postmasters are treated with dignity and respect is our absolute priority, and we will continue to listen to those who have been sharing their stories and work with the CCRC to support them with their review of the Capture system.'

Fans of ITV soap Emmerdale have pointed out some plot holes in the latest part of John Sugden's (Oliver Farnworth) storyline. Last week, John learnt that Cain Dingle (Jeff Hordley) and Tracy Shankley (Amy Walsh) were going to try and work out who killed Nate Robinson (Jurell Carter). Desperate to keep their focus off him, John realised he needed to come up with a plan – and fast. That same day, John was asked to visit Owen Michaels' (Simon Haines) house as part of his work at the surgery. When he arrived, he found Owen – the guy who spiked Robert Sugden (Ryan Hawley) – unconscious on the sofa. John rushed to call an ambulance, but then realise another problem of his would be solved if he just…let Owen die. In the time it took for Owen's life to slip away, John had created a story that made Owen look like he killed Nate. John wrote a note on Owen's laptop that confessed to murdering Nate, as well as revealing why he did it. He then used antibacterial wipes to clean the laptop, the door handle and Owen's neck, to ensure his fingerprints would be removed from the scene. A few days later, Liam Cavanagh (Jonny McPherson) went to check on Owen and found him dead. DS Walsh then arrived, and later told Tracy and Cain that this man killed Nate. It was a twist that left Cain and Tracy stunned. While they have no reason to not believe Walsh, fans of the ITV soap have certainly been struggling, as they noticed multiple plot holes in the scenes that saw John frame Owen, and what followed after. Taking to social media platform X, the point mentioned the most is John's effort to clean his fingerprints from Owen's house. It's possible a post-mortem would've been conducted on Owen after his death, to determine what he had in his system when he died. As a result of this and forensics checking the house, surely they would've noticed someone had cleaned Owen's neck, the laptop, and other areas? And therefore considered that he perhaps did not end his life? 'Did they notice that all the fingerprints on the laptop and Owen's hands had been wiped clean? #Emmerdale', one fan wondered. Another pointed out: 'He didn't seem to have his 'I'm a Medic' over shoulder pack with him that he's usually surgically attached to, just a smaller brown more casual looking bag. Not suss at all that certain areas have been wiped down, whether effective print/DNA wise or not #Emmerdale.' Also on X, audience members noticed that Robert mentioned Owen's confession in the pub…without actually being told about it. 'How did Robert know Owen confessed to killing Nate? Tracey and Cain haven't told anyone; John and Liam just walked in. Plot hole klaxon! #Emmerdale', they highlighted. Robert Sugden (Ryan Hawley) has uncovered a huge piece of information that proves Owen Michaels (Simon Haines) did not kill Nate Robinson (Jurell Carter) in Emmerdale. Of course, we know he didn't, but the residents believe he did after DS Walsh found a note on his laptop confirming to the murder. This discovery was made at the same time Walsh and Liam Cavanagh (Jonny McPherson) found Owen dead. It looked as though he had ended his life, but John Sugden (Oliver Farnworth) let him die after finding him unconscious last week. With the so-called developments now village gossip, Robert grew suspicious yesterday when Moira Dingle (Natalie J Robb) mentioned Owen planting Nate's phone in Frankie's playhouse. He though it was unbelievably strange for Owen to do this, and wondered why he'd take such a risk – surely you'd just lay low? With this in his mind, Robert was given another reason to grow curious about his brother in tonight's episode, when Claudette (Flo Wilson) said that John visited Owen before he died. A theory being fuelled, Robert was then seen outside Mill Cottage, watching John in his van. The medic was emptying a very full sharps bin into a cardboard box. Robert couldn't understand why John would have so many medical items in his van – but made a mistake by not following John to the scrapyard. There, John poured the sharps bin contents into a metal container and set fire to it. He was caught by Aaron Dingle (Danny Miller), but managed to create a cover story by saying he needed to dispose of them for the surgery, and cut corners so they could get on the road for their camping trip quicker. While this was happening, Robert was busy making contact with Owen's brother. Outside The Hide, Steve wasn't really in any mood to talk about Owen. Emmerdale viewers were left calling out the show's police force over some obvious signs of a cover-up on the ITV soap, amid John Sugden framing Owen for Nate's murder Viewers of Emmerdale have slammed a new twist that saw newcomer Owen framed for the murder of Nate Robinson this week. ‌ Owen was found dead by the police, and they spotted a suicide note and a murder confession on his laptop. It detailed how he'd murdered Nate, including information on what happened and how he disposed of the body. ‌ Of course viewers know that it was John Sugden who killed Nate and then covered up the crime until Nate's body was found. After various ways of trying to hide his guilt he settled for letting patient Owen die after a suspected overdose, before typing out the confession on his laptop. ‌ He took steps to hide the fact he'd been there, removing fingerprints from Owen's body as well as the laptop and other place. But it was this "error" fans believe could expose Owen was framed, and it left many fans slamming the police force for their quick decision to accept Owen's confession. The missed clue of the suspicious removal of fingerprints surely would have sparked alarm bells if they'd paid attention. Why would there be no fingerprints and a clean keyboard if Owen had just typed out a note before possibly taking his own life? ‌ There's also the fact that his laptop somehow remained opened and accessible, seemingly. Surely during a post-mortem it might be flagged that Owen's death was accidental, plus the fact his arm had been wiped? Maybe not, but some fans were sure John's clean-up would end up giving away he was there. John had claimed he couldn't get into the house, but what if he left some sort of evidence behind that proves he was there? Fans also noted that Owen's decision to type out a murder confession and not write it or text it would also spark concern that this was not his doing. Other viewers claimed points about the confession also did not add up, with Owen being a complete stranger and it apparently being a chance encounter. So how did he just happen to have access to the tools used to cover up the body, and what about a weapon or cause of death? ‌ Taking to social media, one fan said: "So Owen types out a long suicide note, then wipes his laptop clean of prints, front and back. Then kills himself. Makes absolutely zero sense, obviously." A fan replied: "Exactly! John probably thought he was so clever lol." Another viewer commented: "I would have thought that the police would dust it for prints and ask Liam if he touched it rather than showing him the suicide note even before the autopsy." A fourth fan said: "I'm hoping this is what catches John out tbh." ‌ A fifth viewer posted: "That it was typed and not written is a red flag for a cover up and computer screens shut down and locked up after a few minutes." Another fan said: "A roadside killing by some random should be messy with the body just dumped in a ditch somewhere." A final fan questioned: "Supposedly, Owen 'killed' Nate in a road rage incident, if I heard that correctly... but how exactly? Did he hit him with his car? Was there a weapon(s) involved? Owen, while tall, did he look like he could take Nate in a fight??"
