
Grounds of arrest to accused: We want to strike balance, says SC
A bench of Justices B R Gavai and Augustine George Masih was dealing with questions, including whether it would be necessary to furnish grounds of arrest to an accused either before arrest or forthwith after arrest in every case, including even those arising out of offences under the erstwhile Indian Penal Code.
"We want to strike a balance. On the one hand, we don't want the machineries to misuse their power. On the other hand, we also don't want that the accused take advantage of some of our observations and get free," Justice Gavai observed during the hearing.
The apex court said the other question that arose was if the arrest would be vitiated if in exceptional cases, on account of certain exigencies, it would not be possible to furnish grounds of arrest to an accused either before or immediately after the arrest.
The bench reserved its verdict on these legal questions.
In February this year, the apex court, in a separate judgement, said the requirement of informing grounds of arrest to an accused was not a "formality but a mandatory constitutional requirement".
A non-compliance by the police, it said, would amount to violation of fundamental right under Article 22 of the Constitution.
In May last year, the top court had declared as "invalid" the arrest of NewsClick founder Prabir Purkayastha and ordered his release. Purkayastha was arrested in a case lodged under the Unlawful Activities Act .
In its judgement, the apex court said any person arrested over allegations of commission of offences under the UA or other offences has a fundamental and a statutory right to be informed about the grounds of arrest in writing.
On Tuesday, the bench said the question was whether an accused, who was caught red-handed, should be permitted to get the benefit of the court's observations on furnishing grounds of arrest.
"Should we forget all the ground realities?" the bench asked.
Some of its verdicts were misused also, it pointed out further.
The counsel appearing for one of the petitioners said that furnishing the grounds of arrest to an accused was of vital importance as there was a presumption of innocence until proved guilty by a court of law.
The bench was dealing with three separate pleas arising out of the orders of the Bombay High Court.
One of the pleas was filed by an accused in a BMW hit-and-run case of July 2024 in which a woman had lost her life in Mumbai.
He challenged the high court's November 2024 order which rejected his plea seeking to declare his arrest as illegal.
Before the high court, the accused raised the issue of alleged non-furnishing of the grounds of arrest before remanding him to custody.
Another petition in the apex court was filed by a woman, the mother of a juvenile who was allegedly involved in the May last year Porsche car crash incident in Pune in which two persons had died.
The woman was accused of allegedly switching of the juvenile's blood samples so as to establish that he was not drunk when the accident took place.
She challenged in the apex court an order of the high court which referred a batch of pleas raising the issue concerning grounds of arrest for consideration by a larger bench.
The third petition in the top court also raised the issue over the high court's order referring the batch of pleas for consideration by a larger bench.

Raigarh and Navi Mumbai reported 128 and 131 fatalities, respectively.'Addressing a recent train incident in the Mumbai suburban area, the minister confirmed that a committee has been constituted to investigate the cause of the incident near Mumbra also highlighted passenger safety initiatives undertaken by the railways, saying the introduction of AC local trains equipped with automatic doors in Mumbai. He described this as a welcome initiative to enhance commuters safety and reduce incidents related to overcrowding."The automatic doors prevent passengers from hanging on footboards or boarding moving trains which is a major cause of fatal accidents," Vaishnaw said. "These doors remain closed while the train is in motion and open only at stations when the train is stationary, thereby significantly reducing the risk of falls."He further added that increasing the frequency of train services, including suburban train services, is an ongoing process for Indian Railways, subject to operational feasibility, traffic justification, and availability of resources.

Delhi HC grants anticipatory bail to NewsClick founder in two separate cases, including one on foreign funding
The Delhi High Court on Wednesday (July 23, 2025) granted anticipatory bail to NewsClick founder and editor-in-chief Prabir Purkayastha in two separate cases, including one filed by the Delhi Police over alleged foreign funding. Justice Neena Bansal Krishna also extended the relief to Mr. Purkayastha in a money laundering case being investigated by the Directorate of Enforcement (ED). The court also granted anticipatory bail to NewsClick director Pranjal Pandey in a case registered by the Delhi Police's Economic Offences Wing. The Delhi Police's First Information Report (FIR) in the case alleged that PPK Newsclick Studio Private Limited received foreign direct investment (FDI) of ₹9.59 crore from Worldwide Media Holdings LLC, U.S, during the financial year 2018-19. The FIR claimed that the investment was made by greatly overvaluing the shares of the petitioner company to avoid the alleged cap of 26% FDI in a digital news website. It further alleged that over 45% of this investment was diverted or siphoned off towards the payment of salary/consultancy fees, rent, and other expenses, which are alleged to have been made for ulterior motives. The ED initiated its probe on the basis of the Delhi Police's FIR, and conducted searches on the premises of NewsClick and several other places in connection with money allegedly received from overseas. In 2021, the court had extended interim protection from arrest to both Mr. Purkayastha and Mr. Pandey in connection with the cases. Separately, Mr. Purkayastha was arrested on October 3, 2023 by the Special Cell of the Delhi Police in a different case under the Unlawful Activities (Prevention) Act. However, on May 24, 2024 the Supreme Court declared Mr. Purkayastha's arrest illegal and ordered his release.

Left parties hold rally in Kolkata against harassment of Bengalis in BJP-ruled state
Kolkata: Left parties in West Bengal, led by CPI(M), on Wednesday, took out a protest march in Kolkata to condemn the alleged harassment of Bengali-speaking people in BJP-ruled states. However, from the same rally, the Left leaders accused West Bengal Chief Minister of dichotomy, which had prompted her to exploit the issue to suit her political agenda. The rally was led by the CPI(M) politburo member and the party's state secretary in West Bengal, Md. Salim. The rally began from the base of the Lenin Statue in the Esplanade area in central Kolkata and ended at Ramlila Park near Moulali, also in central Kolkata. Addressing party workers who took part in the protest march, Salim alleged that the BJP was targeting the Bengali-speaking people as part of its divisive politics. "Elections in Bihar are scheduled soon. Next year, Assembly polls will be held in West Bengal as well. Across the country, Bengalis are being targeted. We have no words to condemn such harassment and attack as it is being done as part of the party's divisive politics," said Salim. He also accused different BJP-ruled state governments of allegedly harassing the Bengali-speaking people after branding them as illegal Bangladeshi infiltrators first. "At the same time, an attempt is going on to brand them as doubtful voters in the pretext of conducting a special revision of the voters' list by the Election Commission of India," Salim said. According to him, people coming from a weaker economic background, such as migrant labourers, are suffering the most in this process. 'The Constitution allows Indian citizens to travel, work, and live across the country. This is internal migration, and the central government must provide them with social security," said Salim. He also slammed Mamata Banerjee for turning the plight of the Bengali-speaking into a poll issue, given the 2026 West Bengal Assembly election. "She is politicising the matter because the election is just around the corner. Mamata Banerjee also wants to divide the people by instilling a sense of fear among them. If people get divided, then both Mamata Banerjee and the BJP would benefit from it," he said.
