
Indigenous DNA in wastewater is vulnerable to exploitation, Guelph, Ont., researchers say
At the University of Guelph in southern Ontario, researchers are working to protect that data.
Melissa Perreault is part of the research team focused on developing a policy to better protect Indigenous people from research exploitation, specifically through wastewater sampling.
"I want to start by saying how valuable wastewater research is ... but there are other things in wastewater besides [COVID-19]," Perreault told CBC News.
During the COVID-19 pandemic, public health departments used wastewater sampling to keep track of the spread of the virus across Canada.
The sensitive data found in wastewater — including human DNA and prescribed or illicit drugs — can also give researchers more information about the general health of the community.
"With Indigenous communities, this becomes a problem because they live in isolated communities for the most part.... There's a risk of exploitation of using that human DNA for things other than what the researchers originally intended to do," Perreault said.
She said consent can become complicated if researchers decide to hold on to DNA samples for a long time.
"Wastewater samples are community samples, so there are potentially hundreds [or] thousands of people who have contributed to that DNA in those samples. So the question becomes: 'Who gives consent for that?'" Perreault said.
"If it's community leaders, what happens if the community leaders change? Can one person in a community say no? These are all questions that add on to the complexity of wastewater samples."
The work is being funded through a two-year grant by Genome Canada. The non-profit group works to "use genomics-based technologies to improve the lives of Canadians," according to its website.
The two-year timeline to finish the work is a rough estimate and could change, Perreault said. Some of the preliminary efforts will focus on understanding which Indigenous communities they would like to work with and obtaining consent.
Lack of Indigenous DNA a challenge for researchers
Precision medicine refers to the use of genomic data to predict which drug will work best for each person.
But precision medicine cannot serve Indigenous Peoples if their reference data is missing, and an information gap for Indigenous groups exists around the world, including in Canada.
"Indigenous DNA is highly coveted by researchers," Perreault said.
"First Nations people mostly live on reserves, so they're very tight-knit communities, for the most part, more isolated than other communities for millennia.... The risk of exploitation of Indigenous Peoples by researchers is higher," she said.
The lack of representation of Indigenous genomes in large databases reflects a general wariness in that group caused, in part, by historical cases of genetic research gone wrong.
One study considered by leading geneticists as a game-changer involved the Nuu-chah-nulth First Nations on Vancouver Island.
The Nuu-chah-nulth have a high frequency of rheumatoid arthritis. The research team collected DNA samples from approximately half of the First Nations members to study the genetic basis for the disorder.
The genetic determinants of rheumatoid arthritis weren't found, but that wasn't the big problem. Researchers sent the DNA samples to external facilities for genetic ancestry studies without the knowledge or consent of the participants.

Nuu-chah-nulth want their blood back
Krystal Tsosie, a geneticist and bioethicist at Vanderbilt University in Nashville, said the gathering of genetic samples and data from underrepresented populations, including Indigenous Peoples, is colonialism.
"If we really want to talk about justice and genomic justice, then we really have to talk about data equity, and also empowering data decisions from Indigenous communities like ours," she said.
Another case study: Arizona's Havasupai community
Perreault said there are several examples in recent history of Indigenous DNA being used in research without permission.
She said one of the most infamous case studies is of the Havasupai community in Arizona.
Between 1990 and 1994, researchers from Arizona State University went to that community to take blood samples to be used in a diabetes project, with the goal of determining how genetics play a role in Type 2 diabetes.
It was later discovered their biological samples were used to challenge the community's origin story and test the link between schizophrenia and inbreeding — terms not agreed to by the Havasupai.
The community sued Arizona State University on the grounds they did not consent to how their blood samples were used and it was a violation of medical confidentiality. The community settled out of court for $700,000.
"[The Havasupai community] is probably one of the more famous samples," Perreault said.
"But this is not something that is only happening historically. Exploitation of Indigenous communities is actually happening now."
An ethical guide to working with DNA
The First Nations Principles of OCAP (ownership, control, access and possession) gives researchers an ethical guide to working with First Nations that choose to share their data, including DNA.
The OCAP guideline says First Nations alone should have control over how their data is stored, interpreted, used or shared. Perreault and her team are hoping to use OCAP as a foundation to build their policy, which is specific to wastewater management.
Jonathan Dewar is CEO of the First Nations Information Governance Centre, which developed the OCAP principles. He said it's true that Indigenous Peoples are at a greater risk of research exploitation.
"The history is a legacy of abuse, a legacy of extractive research practices, taking from Indigenous communities, not compensating them, not citing them, erasing them," he said.
"Fast forward to 2025 and that hasn't changed.... We have a federal government that uses the language of nation-to-nation relationship. The imbalance between Canada and Indigenous Peoples, and their governments, is still very much the prevailing reality."
After the policy is developed, Perreault and her team will reach out to Dewar and the First Nations Information Governance Centre, as well as the University of Guelph's Research Ethics Board, to see if they can adopt it officially.

Tennessee readies for execution of man with working implanted defibrillator
NASHVILLE, Tenn. (AP) — Tennessee is gearing up for an execution on Tuesday that experts say would likely mark the first time a man has been put to death with a working defibrillator in his chest. Gov. Bill Lee declined Monday to grant a reprieve, clearing the way for Byron Black's execution after a legal battle and ongoing uncertainty about whether the implantable cardioverter-defibrillator will shock his heart when the lethal drug takes effect. The nonprofit Death Penalty Information Center said it's unaware of any other cases in which a person on death row made similar claims to Black's about defibrillators or pacemakers. Black's attorneys said they haven't found a comparable case, either. Lee said the courts have 'universally determined that it is lawful to carry out the jury's sentence of execution given to Mr. Black for the heinous murders of Angela Clay and her daughters Lakeisha, age 6, and Latoya, age 9.' The U.S. Supreme Court on Monday rejected Black's appeals. The execution would be Tennessee's second since May, after a pause for five years, first because of COVID-19 and then because of missteps by state corrections officials. Twenty-seven men have died by court-ordered execution so far this year in the U.S., and nine other people are scheduled to be put to death in seven states during the remainder of 2025. The number of executions this year exceeds the 25 carried out last year and in 2018. It is the highest total since 2015, when 28 people were put to death. Black's condition Black, 69, is in a wheelchair, and he has dementia, brain damage, kidney failure, congestive heart failure and other conditions, his attorneys have said. The implantable cardioverter-defibrillator he has is a small, battery-powered electronic device that is surgically implanted in the chest. It serves as a pacemaker and an emergency defibrillator. Black's attorneys say in order to be sure it's off, a doctor must place a programming device over the implant site, sending it a deactivation command, with no surgery required. In mid-July, a trial court judge agreed with Black's attorneys that officials must have his device deactivated to avert the risk that it could cause unnecessary pain and prolong the execution. But the state Supreme Court intervened July 31 to overturn that decision, saying the other judge lacked the authority to order the change. The state has disputed that the lethal injection would cause Black's defibrillator to shock him. Even if shocks were triggered, Black wouldn't feel them, the state said. Black's attorneys have countered that even if the lethal drug being used, pentobarbital, renders someone unresponsive, they aren't necessarily unaware or unable to feel pain. Kelley Henry, Black's attorney, said the execution could become a 'grotesque spectacle.' The legal case also spurred a reminder that most medical professionals consider participation in executions a violation of health care ethics. Black's case Black was convicted in the 1988 shooting deaths of his girlfriend Angela Clay, 29, and her two daughters. Prosecutors said he was in a jealous rage when he shot the three at their home. At the time, Black was on work-release while serving time for shooting Clay's estranged husband. Linette Bell, whose sister and two nieces were killed, recently told WKRN-TV: 'He didn't have mercy on them, so why should we have mercy on him?' Nashville District Attorney Glenn Funk contended in 2022 that Black is intellectually disabled and deserved a hearing under that 2021 law, but the judge denied it. That is because the 2021 law denies a hearing to people on death row who have already filed a similar request and a court has ruled on it 'on the merits.' In Funk's attempt, he focused on input from an expert for the state in 2004 who determined back then that Black didn't meet the criteria for what was then called 'mental retardation.' But she concluded that Black met the new law's criteria for a diagnosis of intellectual disability. Black also sought a determination by the courts that he is incompetent to be executed.

B.C. scientists discover new virus in farmed Pacific oysters during mass die-off
Scientists at the University of British Columbia have discovered a previously unknown virus in farmed Pacific oysters during a mass die-off in B.C. in 2020. The paper, published on Monday in the Proceedings of the National Academy of Sciences, said that while mass die-offs have been attributed to various factors, including viruses, in many cases, there is no definitive cause. 'We've recently seen annual mass die-offs in B.C. and elsewhere of Pacific oysters, the most widely farmed shellfish worldwide,' said first author Dr. Kevin Zhong, research associate in the UBC Department of earth, ocean and atmospheric sciences (EOAS). 'Often, we don't know the cause.' The researchers collected 33 oysters from two farms in B.C. during a mass die-off in 2020, as well as 26 wild oysters from 10 nearby sites. Story continues below advertisement RNA analysis revealed the presence of a previously unknown virus, Pacific Oyster Nidovirus 1 (PONV1), in 20 of the dead and dying farmed oysters, according to the research. However, the virus was not found in healthy wild oysters, which suggested the virus was killing the oysters. 'It's important to investigate mass die-offs in oysters to determine what causes disease. Story continues below advertisement It can be found in humans, for example, SARS-CoV-2, a nidovirus, causes COVID-19. The virus, which has one of the largest RNA genomes on record, according to the research, is so genetically different from other nidoviruses that the research team has proposed a new family, Megarnaviridae, or 'large RNA viruses' PONV1, which the team is proposing to name Megarnavirus gigas, or 'large RNA virus giant.' Suttle said these large RNA viruses appear to be specific to oysters, so humans are not at risk of contracting the virus. However, the team said this discovery is a reminder that oyster farmers should use an abundance of caution when moving juvenile oysters as little is known about what causes disease in the bivalve molluscs. 'This research is not a cause for alarm,' Suttle added. 'Rather, this is a meaningful step forward in advancing our understanding of oyster health and supporting the long-term sustainability of shellfish aquaculture.' Pacific oysters are the primary shellfish species grown in B.C., with an estimated value of $16 million in 2023.

Hazy holiday: Air quality drops as wildfire smoke blankets southwestern Ontario
Environment Canada has issued special air quality statements for southwestern Ontario as prairie wildfire smoke sits over swaths of the province. People in the Windsor, Chatham, and Sarnia regions can expect poor air quality and reduced visibility, Environment Canada said Monday morning. "The wildfire smoke may persist into tonight and possibly Tuesday before finally easing." Detroit and Toronto were among the top ten most polluted major cities in the world on Monday afternoon, according to a ranking by Swiss company IQAir. The CBC News Climate Dashboard also showed Windsor and other southwestern Ontario cities had some of the worst air quality in the country. Environment Canada warned of potential health effects, including "mild and common symptoms such as eye, nose and throat irritation, headaches or a mild cough." Wheezing, chest pains, or severe cough are less common but more serious symptoms. Older people, young kids, people with chronic conditions, pregnant people, and those who work outside are at higher risk, Environment Canada said. "If you think you are having a medical emergency, seek immediate medical assistance." The federal weather authority also urged people to limit time outside and consider rescheduling outdoor activities, adding that windows and doors should be kept closed as much as possible. "If you must spend time outdoors, a well-constructed, well-fitting and properly worn respirator type mask (such as a NIOSH-certified N95 or equivalent respirator) can reduce your exposure to the fine particles in the smoke," Environment Canada said.
