SHC suspends Moonis Alvi's removal in harassment case

The Sindh High Court (SHC) on Friday suspended the decision of the Provincial Ombudsperson that had ordered the removal of K-Electric Chief Executive Officer Moonis Alvi over allegations of workplace harassment.
The interim relief came during a hearing before a two-member bench headed by Justice Faisal Kamal Alam and comprising Justice Hassan Akbar. The court was hearing a petition filed by Alvi, challenging the ombudsperson's verdict delivered a day earlier.
Barrister Abid Zuberi, counsel for the petitioner, submitted that the provincial ombudsperson lacked jurisdiction in the matter, arguing that KE is an interprovincial entity and, therefore, falls under the purview of federal legislation.

The court inquired about the legal flaws in the ombudsperson's ruling. Zuberi contended that the order to remove Alvi and impose a penalty of Rs2.5 million was issued without jurisdiction and in contravention of the relevant laws.
'The ombudsperson's office is not authorised to adjudicate such matters. In similar cases, jurisdiction has been found with the National Industrial Relations Commission (NIRC) or labour courts,' he argued.
He further pointed out that KE supplies electricity to areas beyond Sindh, including Lasbela and Hub, which categorises it as an interprovincial company. Therefore, the case should be dealt with by the Federal Ombudsperson.
The court, after hearing the arguments, suspended the removal order until the next hearing, scheduled for August 8. It directed Alvi to deposit the Rs2.5 million fine with the Nazir of the SHC. A request by the petitioner's counsel to reduce the amount was declined by the bench.

Mahreen Aziz Khan, a former consultant at KE and the company's first female CxO, had filed a complaint under the Protection Against Harassment of Women at the Workplace Act, 2010, accusing CEO Moonis Alvi of harassment and creating a hostile work environment.
In his verdict, Sindh Ombudsman Justice (retd) Shahnawaz Tariq stated that Alvi had committed harassment, created a hostile environment, and caused mental agony at the workplace to the complainant and her team.
The ombudsman had ordered Alvi's removal from service under Section 4(ii)(d) of the Act and directed him to pay a fine of Rs2.5 million within one month.

During the interaction, the SHC CJ apprised the CJP Afridi regarding the proposed construction of a state-of-the-art Judicial Complex in Karachi, comprising 125 fully equipped courts along with all requisite amenities. The project is intended to address the growing needs of the judicial system in the port city and is expected to commence shortly. The CJP welcomed the initiative and underscored the importance of sustainable, scalable, and forward-looking infrastructure planning. He stressed that future forecasting must be integrated into the design to ensure the long-term viability of the complex. In this regard, he recommended that structured consultations be held with all relevant stakeholders—including judges and members of the district bar—to gather practical input keeping in view the technicalities so that a refined proposal may be placed before the government for timely execution. ISLAMABAD: Addressing concerns of business community, the Federal Board of Revenue (FBR) on Monday announced that the warrant of arrest from judge would only be obtained in the sales tax fraud cases of fake and flying invoices. According to a sales tax explanatory circular issued by the FBR on Monday, the FBR clarified arrest related provisions of the Sales Tax Act 1990. One of the major demands of the business community was to limit the arrest powers to the issues of fake/ flying invoices. The FBR has clarified to the business community that the warrant of arrest from judge under subsection (9) of Section 37A of the Sales Tax Act may be obtained primarily in the sales tax frauds which are heinous or material including fake and flying invoices. Under this subsection, the following pre-conditions shall also apply as is the case of arrest under subsection (8) of section 37A: (i) The accused may tamper with documents. (ii) The accused may abscond. (iii) The accused does not help investigations despite three served notices. In addition to that the board will separately notify the detailed procedure, preconditions and restrictions through an sales tax general order (STGO) for the smooth operation of subsections (8) and (9) of Section 37A of the Sales Tax Act, FBR added. The FBR has also separated criminal and civil liability to differentiate between non-compliance and fraudulent activities. Sub-section (1) of section 11E has been substituted where by non-payment of tax through collusion or deliberate act are excluded from its scope, because the provisions of law already exist in this Act under section 37A for initiation of criminal proceedings in such non-payments. Similarly, the provisions of section 11E shall not be applicable to the extent where proceedings have been initiated under section 37A. This differential between proceedings under section 11E and section 37A is important as the former deals with non-compliance where as latter deals with the fraudulent activities. PHOTO: EXPRESS Multiple thefts occurred in a single night at Hyderabad's renowned Nishat Glass Bangles Market, where unidentified culprits broke into eight shops, escaping with gold plating solution, raw and finished stock, cash, and other valuables worth estimated to be over Rs2.5 million. The incident came to light early morning when a shopkeeper arrived and found the shutter raised and his shop looted. As others reached the market, it was revealed that eight shops had been targeted. In protest, the traders suspended business operations, closed their shops, and held a demonstration, accusing the perpetrators of having intimate knowledge of the bangles trade and the value of its materials. Among the stolen items was a high-value gold plating solution used in polishing bangles, made from 24-karat gold and stored in delicate three-inch glass bottles. Six such bottles were reported stolen - four from Majid Qureshi's shop and two from Nazim Qureshi's. Victimized shopkeepers included Majid Qureshi, Shah Rukh, Haris Siddiqui, Nazim, Shakeel, and Qasim. Despite the presence of two night guards employed for years at the market and on duty during the incident, the burglars gained entry. According to police sources, some shop locks were broken, while others were accessed by lifting shutters with a jack. Market sources said the area around the bangle market has become a hub for drug addicts, with complaints about drug use and sales during nighttime hours. Traders claimed that despite several written and verbal complaints, the police failed to conduct regular patrols or take preventative action. Following the thefts, the Glass Bangles Dealers Association held an emergency meeting attended by President Yamin Siddiqui, General Secretary Haji Nadeem Siddiqui, Joint Secretary Asghar, and others. It was decided that all shops would remain closed on Sunday in protest. During the demonstration, traders demanded the SSP Hyderabad take immediate notice, apprehend the culprits, and recover the stolen goods. They also urged the government to compensate for their losses and provide permanent security. In a statement posted on social media, association leaders said, "The bangle industry, once considered a cornerstone of Pakistan's economy, is now abandoned. Crushed by heavy taxation, weather damages, and now thefts, traders are being pushed to the wall."
