Maharashtra govt passes bill allowing SRA to recover pending transit dues
The amendment bill seeks to treat unpaid rent to slum dwellers as arrears of land revenue, thereby empowering the SRA to initiate recovery proceedings under the Maharashtra Land Revenue Code (MLRC).
As per the proposed amendment, if a defaulting builder lacks sufficient company assets to clear the dues, the liability can extend to the personal property of its directors or partners. Currently, the SRA can issue stop-work notices or deny new permissions to a defaulting developer.
The bill also seeks to reduce the window for dissenting slum dwellers to join the SRA schemes - from 120 days to 60 days - once a majority (over 50 per cent) has consented to a redevelopment plan.
After 60 days, those who do not join the scheme risk losing their claim to on-site rehabilitation and may only be considered for relocation elsewhere, subject to availability.
Another provision of the bill allows land under slum redevelopment to be handed over to government agencies like MMRDA, MHADA, MSRDC, and CIDCO within 30 days of issuing a letter of intent, enabling a faster execution of public sector-led projects.

NEW DELHI: A Delhi court on Saturday granted arms dealer Sanjay Bhandari time to explore legal remedies against the July 5 order that declared him a fugitive economic offender under the Fugitive Economic Offenders (FEO) Act. Special Judge Sanjay Jindal of the Rouse Avenue Court allowed Bhandari's counsel time until August 2 to file an appeal before the High Court. The court also deferred proceedings on the Enforcement Directorate's (ED) plea seeking confiscation of Bhandari's properties, including assets in India, Dubai, and the UK. During the hearing, Bhandari's counsel requested an adjournment, stating that the FEO Act provides a statutory 30-day window to file an appeal. 'Let me exhaust my statutory remedy,' the counsel submitted, adding that the properties listed for confiscation had already been attached by the agency. Special Counsel Zoheb Hossain, appearing for the ED along with Special Public Prosecutor Naveen Kumar Matta and Mohd Faizan, opposed the adjournment, arguing that the pendency of an appeal could not stall confiscation proceedings. He also contended that Bhandari's counsel could not represent other noticees, who had been given a chance to respond independently. Hossain detailed the properties the ED seeks to confiscate, including real estate in Vasant Vihar, Panchsheel Shopping Complex, and Shahpur Jat, as well as alleged benami properties in Noida and Gurugram. The list also includes jewellery, cash, bank accounts in the names of Bhandari and his wife, and foreign assets. Bhandari was declared a fugitive economic offender on July 5 by Judge Sanjeev Aggarwal in connection with a money laundering case linked to undisclosed foreign holdings. The ED claimed he had evaded Indian authorities and held assets exceeding `100 crore. Bhandari's counsel, senior advocate Maninder Singh, argued that his client's presence in the UK was legal and protected by a London High Court ruling. The matter will be heard after the statutory appeal period ends.

Release salary, benefits to paralysed engineer from 2018: HC to govt
1 2 Jaipur: The Rajasthan High Court has ordered the agriculture department to pay regular monthly salary and service benefits, along with 6% interest since 2018, to an assistant engineer who became paralysed following a brain hemorrhage in 2017. In a broader directive, the court instructed the state's chief secretary to issue orders to all govt departments to identify similarly disabled employees and provide them benefits under Section 20(4) of the Rights of the Persons with Disabilities Act, 2016. Justice Mahender Kumar Goyal's single bench issued the orders on July 9 while disposing of a petition filed by Sunil Kumar Gupta. The order copy was uploaded online Saturday. "The petitioner was appointed as a junior engineer in the agriculture department in 1994 and was promoted as an assistant engineer. On Nov 16, 2017, he suffered a brain haemorrhage resulting in paralysis on the right side of his body. Since then, he is bedridden. His salary was stopped from April 12, 2018, to June 30, 2018, and from Jan 19 till date," said CP Sharma, counsel for the petitioner. After hearing the arguments, Justice Goyal asked the authorities to release the petitioner's salary and other benefits on a monthly basis with an interest of 6% since it was stopped. The court also directed the authorities to comply with its directions in four weeks after receiving the order copy and stated that if they fail, they will have to pay the same benefits with an interest of 9%. A compliance hearing is scheduled for Sept 11.

Home buyers left in the dark as MahaRERA blocks details of project under abeyance
Mumbai: Home buyers and advocates are unable to view details of projects kept on abeyance on the MahaRERA website. When some attempted to view details of a project on the website, a message is displayed stating the project is kept in abeyance and the bank account is frozen. However, all vital details, such as completion date, occupancy certificate, approval status, and past orders, are inaccessible to home buyers. Lawyers claim that without public access to essential details, such as Form 4, project approvals, and prior MahaRERA or appellate orders, home buyers will be prevented from availing legal remedy. However, MahaRERA officials have said that the home buyer can write to the regulator seeking details of their project, and the same would be mailed to them. "A home buyer approached seeking to register a complaint regarding a project since there was a delay in the handover of the flat with OC to my client. When I was trying to access all details of the project, including the orders passed by MahaRERA regarding the project, which would enable me to cite the orders in my complaint, a message on the website said that the project is kept in abeyance. All orders regarding a project are normally displayed on the website, which is for the benefit of the home buyers," said Advocate Godfrey Pimenta. Pimenta has written to the state housing department highlighting the issue and pointed out that Section 4(2)(l) of the Real Estate (Regulation and Development) Act, 2016 (RERA) mandates the developer and the regulator to make available all project-related information to the public. Pimenta stated that MahaRERA froze the project but failed to preserve access for prospective complainants. "Details of only those projects, which have been kept on abeyance, are not available on the website. We can provide the same if a home buyer writes to us. Projects are kept in abeyance when the project becomes non-compliant, including not updating progress and status of the project. After a notice is issued, sufficient time is given. Thereafter, the registration is temporarily suspended, and their website is blocked, besides their bank accounts too are frozen. We also ensure no registration of units is carried out in the project. We are not providing any details of the project kept in abeyance in the interest of the home buyers," said a MahaRERA official. The Watchdog Foundation demanded that the MahaRERA portal should resume public access to all non-sensitive details of the project while retaining any regulatory freeze.
