Fifty MAF retirees appeal to Federal Court over pension adjustment ruling
Lawyer Mohamed Hanif Khatri Abdulla, representing the retirees, confirmed that the notice of motion was filed today and said the Federal Court has fixed August 4 for case management.
In their application, the applicants are seeking the Apex court's determination on two questions of law concerning the pension adjustment issue.
On June 4, the appellate court three-man bench overturned the High Court's earlier ruling which held that MAF retirees who retired before January 1, 2013 were entitled to have their pensions adjusted to the rates and methods applied to the retirees who retired after Jan 1, 2013.
The Court of Appeal held that the MAF retirees failed to prove that the government, the prime minister, the senior defence minister and the Malaysian Armed Forces Council had breached the provisions under the Federal Constitution.
Fifty MAF personnel of various ranks, including major, lieutenant, staff sergeant and private, filed an originating summons in the High Court on November 17, 2022, seeking a declaration that the government had violated the provisions in the Federal Constitution read together with Section 187 of the Malaysian Armed Forces Act 1972 for their respective failures to implement a new pension adjustment for the MAF retirees who retired before January 1, 2013.
They claimed the government had failed to implement new pension adjustments for all MAF retirees who retired before January 1, 2013, causing a significant pension gap between the MAF retirees who retired before January 1, 2013 and those who retired after January 1, 2013. — Bernama

Hasnah Hashim, by virtue of her appointment as acting chief justice, is the current Judicial Appointments Commission chairman. PETALING JAYA : Acting Chief Justice Hasnah Hashim has summoned an urgent meeting of the Judicial Appointments Commission (JAC), the body that proposes judges for appointment and elevation, according to sources. The sources said the meeting is scheduled for 3pm today, although Section 13(2) of the JAC Act 2009 stipulated that 10 days' written notice be given to commission members. Hasnah, who took office yesterday, is the commission's chairman by virtue of her position as the nation's top judge. 'The purpose for meeting on an urgent basis is unclear,' one source told FMT. Sections 13(4) and (5) state that the quorum for the meeting is seven, but in the event of the disqualification of members, the quorum shall be reduced to a minimum of five members. Currently, only seven members remain on the JAC following the mandatory retirement of former chief justice Tengku Maimun Tuan Mat, and Court of Appeal President Abang Iskandar Abang Hashim earlier this week. Hasnah, in her capacity as chief judge of Malaya, and Abdul Rahman Sebli as chief judge of Sabah and Sarawak, are JAC members by virtue of their positions in the judiciary. Former attorney-general Idrus Harun, retired Federal Court judge Zainun Ali, former Sarawak attorney-general Talat Mahmood Abdul Rashid and UiTM legal adviser Hartini Saripan were appointed last year as eminent persons by Prime Minister Anwar Ibrahim. Federal Court judge Zabariah Yusof was appointed to the JAC in March by the prime minister. The JAC is tasked with selecting suitable candidates to sit as judges in the superior courts – the Federal Court, the Court of Appeal, and the High Courts. Sources said a list of candidates for the posts of chief justice, Court of Appeal president, chief judge of Malaya, and chief judge of Sabah and Sarawak have previously been submitted to the Prime Minister's Office during the tenure of Tengku Maimun. Article 122B(1) of the Federal Constitution provides that the appointments are made by the Yang di-Pertuan Agong, acting on the advice of the prime minister, and after consulting the Conference of Rulers. The next conference is scheduled in two weeks.

Sept 10 set for decision on Rosmah's appeal over recusal of trial judge in solar case
PUTRAJAYA: The Court of Appeal has fixed Sept 10 to deliver its decision on Datin Seri Rosmah Mansor's appeal to recuse a High Court judge who presided over her corruption trial involving the RM1.25 billion solar hybrid project in Sarawak. Court of Appeal deputy registrar Muhammad Noor Firdaus Rosli set the date during the case management today. On June 25, the Court of Appeal three-member bench comprising Justices Datuk Ahmad Zaidi Ibrahim, Datuk Azman Abdullah and Datuk Noorin Badaruddin reserved their judgment after hearing submissions from both the prosecution and defence. Rosmah's lawyer, Datuk Akberdin Abdul Kader, confirmed the date when contacted by Bernama. The wife of former Prime Minister Datuk Seri Najib Razak is appealing against the decision by the then High Court judge, Mohamed Zaini Mazlan, who has since been elevated to the Court of Appeal, dismissing her application for his recusal from presiding over her case. Rosmah filed the recusal application at the eleventh hour before Judge Mohamed Zaini was slated to deliver his decision on Sept 1, 2022. The application was based on allegations that a draft judgment in her case, purportedly prepared by a third party, had been leaked before its official delivery. On the same day, Judge Mohamed Zaini found Rosmah, 73, guilty of three corruption charges linked to the hybrid solar project, and sentenced her to 10 years in prison and a RM970 million fine, in default 30 years in prison. However, she was granted a stay of execution on both the custodial sentence and the fine, pending the disposal of her appeal before the Court of Appeal. Rosmah was charged with one count of soliciting RM187.5 million and two counts of receiving RM6.5 million in bribes from former Jepak Holdings Sdn Bhd managing director, Saidi Abang Samsudin. — Bernama

BUKIT MERTAJAM, July 4 — Bukit Mertajam MP Steven Sim Chee Keong has accused a PAS leader of attempting to politicise his absence from his service centre yesterday, claiming it was a deliberate move to paint the centre as non-operational. Sim said there was already a notice saying the centre was closed for the whole day yesterday — which he explained due to the passing of his grandfather, whose funeral was held that day and attended by his staff. 'While my family was grieving the loss of our beloved grandfather, this PAS leader saw fit to exploit the situation for political gain,' he posted on Facebook, referring to Sungai Buloh PAS chief Zaharudin Muhammad. Sim said otherwise his doors are always open to the constituency regardless of the racial, religious or political background — with even PAS members coming to seek assistance. 'We had already put up a notice informing the public that the service centre would be closed on July 3. The notice even included four contact numbers in case of emergencies. 'So, either the PAS leader couldn't read Malay, or he was deliberately attempting to create a malicious perception,' he suggested. Zaharudin, who is the son-in-law of PAS president Tan Sri Abdul Hadi Awang, said yesterday that he had attempted to serve a letter of demand to Sim for alleged defamation. Zaharudin is reportedly seeking RM1.5 million in damages over Sim's remark against him over the promotion of a Chinese officer in the Malaysian Armed Forces. Sim said that regardless, no such letter was found at his office even this morning, and welcomed Zaharudin to settle the matter in court, attaching a Malay pantun as a response. Last week, Sim had stood firm on his accusations against Zaharudin, whom he had called racist for a remark on Malaysian Armed Forces lieutenant-general Datuk Johnny Lim Eng Seng. Lim's promotion had marked a historic milestone, as he became the first ethnic Chinese officer to be promoted to the rank of lieutenant-general in the armed forces. In response, Zaharudin had speculated that Malaysia's 50th prime minister in 2058 could be a Chinese individual, framing the scenario as a possible outcome of Lim's promotion. The post, which also compared the Malaysia's immigration policies to the Zionist settlement of Palestine, was then deleted. Islamist party PAS has since said it does not support the social media post by one of its leaders on the promotion, saying it was the personal opinion of the individual involved and 'entirely contrary' to PAS' policies and values.
