2020 Delhi Riots: No evidence that accused Shifa ur-Rehman part of conspiracy

New Delhi [India], July 7 (ANI): The Karkardooma Court on Monday heard arguments on behalf of the 2020 Delhi riots larger conspiracy case accused Shifa ur-Rehman.
The court heard arguments on the framing of charges in the 2020 Delhi riots case in which ur-Rehman, a former president of the alumni association of the Jamia Millia Islamia, and other activists and student leaders face prosecution under the Unlawful Activities (Prevention) Act (UAPA)
It is alleged that the 2020 riots were the results of a larger conspiracy allegedly hatched by all the accused persons including Ur-Rehman.
As per Delhi police, ur-Rehman was a member of Jamia Coordination Committee (JCC) and the WhatsApp group of JMI Coordination Committee and JCC JMI.
Senior counsel Salman Khurshid on behalf of the accused addressed allegations that ur-Rehman provided financial aid during the anti-CAA protests outside Jamia Millia Islamia.
Khurshid submitted that the accused was not a member of any such WhatsApp groups in which any objectionable activity under the law was found and that there is no evidence to show that he gave money to protestors during the anti-CAA protests outside Jamia.
After hearing the arguments, Additional Sessions Judge (ASJ) Sameer Bajpai listed the matter for further hearing on July 11.
The court has directed that the written submissions be filed in the case.
Special Public Prosecutor (SPP) Amit Prasad appeared for Delhi Police in the case.
Senior advocate Salman Khurshid submitted that accused is an old student of Jamia Millia Islamia.
Khurshid on behalf of ur-Rehman argued that even if the accused had given money 'to buy food or rain covers for protesters, these are normal actions during a protest and cannot be equated with conspiracy.'
To establish conspiracy requires a meeting of minds, and in this case there is no meeting of minds, Khurshid argued.
The senior advocate submitted that no evidence was shown by the investigation agency on whether the accused had given the money or not.
He argued that the standard of 'grave suspicion,' not mere suspicion, is essential for framing charges.
Eighteen accused persons, including Umar Khalid, Shakeel Imam, Tahir Husain, Natasha Narwal, Devangana Kalita and others, are facing allegations of 'larger conspiracy' in the 2020 North East Delhi riots.
Delhi Police have filed charge sheet and supplementary charge sheets against accused persons who are booked under UAPA and sections of the IPC for allegedly masterminding the riots that broke out in the national capital.
It is alleged that during the riots in February 2020, around 53 people died and hundreds were injured. (ANI)

She also said that India no longer waits for an actor to break silence on an issue and say 'Bharat Mata ki Jai'. "The country has been made aware of these realities," she asserted. Her interview came ahead of her return to television screens again after years in the reboot of popular show 'Kyunki Saas Bhi Kabhi Bahu Thi', in which she will be playing the character of Tulsi Virani. Smriti Irani's remarks came over two months after India and Pakistan got engaged in a military conflict, triggered by Pakistan's targeting of air bases in India. The Indian armed forces said that Pakistan incurred heavy losses, with significant damage to its military infrastructure, including land and air assets. While some actors did heap praise on Operation Sindoor, there was chatter online that Bollywood remained largely silent on the issue, or gave a delayed reaction.

The authority found that the firm collected 9 lakh from complainant Madikonda Mallesh without any legal ownership or authorisation over the property in question. Mallesh, a 40-year-old govt employee from Mallapur, filed the complaint after discovering that the plot he agreed to purchase in the venture 'Kaasvi E-City' did not belong to the respondent. TGRERA Orders Refund with Interest and Seeks Probe into Project Promoters TGRERA, in its findings, observed that the respondent had no legal title or authority over the land and that his conduct constituted a violation of Sections 11(4)(a) and 12 of the Real Estate (Regulation and Development) Act, 2016. In addition to the penalty under Section 61, the authority directed the respondent to refund the 9 lakh received from the complainant with 11% annual interest, calculated from the date of each payment until the amount is realised. Executive board and limit There is a limit to the number of members in the executive committee as well. The Bill says, 'an Executive Committee shall consist of not more than fifteen members.' The National Sports Development Code and multiple sports ministry directives had also limited the EC (12) but no NSFs followed them in toto. The Bill also speaks about 'at least two shall be sportspersons of outstanding merit (in the EC); two shall be from the Athletes Committee to be elected from amongst themselves… Provided that at least four members shall be women (in the EC).' Even the sports code and various Delhi High Court orders had spoken about athletes' representation for the last 35 years or more but most NSFs did not follow the directives. Hopefully, this time they will. The Bill is silent on districts' sports administration this time. In the draft Bill in 2024, it had spoken about district sports associations. Interestingly, as highlighted by this newspaper, sports is a state subject and infringing on districts could be tricky. It also needs be seen how much jurisdiction National Sports Board would have in states. Earlier, the draft bill had spoken about how long each of the sports bodies would get to implement the provisions of the bill (one year at least) after it becomes an act, but the one tabled in the Parliament doesn't. It needs to be seen what happens after the Bill is notified in the Gazette of India. As far as recognition of sports bodies are concerned, all sports bodies enjoying government recognition 'before the commencement of this Act, shall be deemed to have Board recognition under this Act and the provisions of this Act shall, mutatis mutandis, apply to such organisation.' Restrictive clause The provision that was later included and was not mentioned earlier was the restrictive clause – the same clause the minister had objected during the IOA case in the Supreme Court. However, the Bill says, 'such person is a sportsperson of outstanding merit or, has previously served as a member of the Executive Committee for at least two full terms, if such person is contesting election for the position of the President or the Secretary General or the Treasurer.' Basically, there is exception for sportspersons. One must not forget what happened in the IOA where majority of the members are sportspersons. If ministry wanted to stop paradropping, they should have made it mandatory to serve in the EC to be eligible to contest for the post of president, secretary and treasurer. The last three years have shown that all great sportspersons don't make great administrators. The bill also speaks about the powers of international charters and statutes of the NSFs and that they will also should be consulted by the dispute redressal committee or NSB. Even now, like in the case of the wrestling federation, taekwando and now boxing have been ducking behind IF (international federation) backing and avoiding elections or ministry sanction. The sports board would be the strongest arm of the sports ministry. It will exercise powers that both the ministry and the Sports Authority of India were dispensing. The Board shall exercise and perform the following powers and functions to carry out the provisions of this Act, namely: 'the grant of Board recognition to sports organisations and registration of affiliate units and to suspend or cancel such recognition or registration… to constitute an ad hoc administrative body or to direct the concerned National Sports Body or their affiliate units… to issue guidelines for formulation of the Code of Ethics by the National Sports Bodies.'
