Madurai Bench of Madras HC stays G.O. allowing shop licence renewal
A bench of justices SM Subramaniam and AD Maria Clete passed the interim order on a Public Interest Litigation petition filed by C Sivaraj of Sivaganga.
The petitioner claimed that Para 3 Clause VI of the G.O. says local body shall refix the rent within six months before the expiry of the lease period. If the existing lessees agree to the refixed rent, the licence may be renewed, he said.
The above clause empowers municipal corporations to renew licences perpetually to the same lessees, the petitioner alleged, adding that this is in violation of Rule 316 of the Tamil Nadu Urban Local Bodies Rules, 2023, that prohibits grant of extension or renewal of licence to same lessee.

Chennai shops below 500 sq feet can self-certify, get licence same day
CHENNAI: Trades and businesses falling under the schedule II category (except food retail and storage of goods) may now be granted trade licence through self certification on the same day if the shops measure less than 500 square feet. This follows a G.O. dated June 16, which simplifies the trade licence process for schedule II businesses less than 500 square feet, also stating that no licence shall be refused without giving an opportunity 'of being heard' to the applicant. 'Earlier the process (of obtaining trade licence) for this particular category of businesses would take up to 15-30 days. Now they can get it on the same day,' City Revenue Officer KP Bhanuchandran said. While earlier, businesses were able to apply for licence online, the zonal level assistant revenue officers (ARO) would carry out a field verification and submit the application before the trade licence committee. It will be chaired by the respective zonal officers, who will take the final call. The schedule II category covers industries manufacturing and dealing with commercial items which includes manufacturers of furniture, automobile parts, electrical goods, three and four-wheeler sales, export garments, tiles and soaps.

Tamil Nadu approves rates for land acquisition in Parandur
CHENNAI: The Tamil Nadu government has approved land acquisition rates for the second Chennai airport proposed at Parandur in Kancheepuram district. The rates have been fixed from Rs 35 lakh to Rs 2.57 crore per acre based on the Guideline Value (GLV), sale value and private negotiations held at the district- and state-levels to arrive at a 'fair' price. A Government Order was issued by V Arun Roy, secretary of the Industries, Investment Promotion and Commerce Department, on June 25. However, residents protesting against the project — since July 2022 — alleged that the state government, in its G.O., has 'misleadingly' shown the GLV and sale value to be the same in a majority of cases in order to 'deceive people'. Women getting pensions under four schemes can avail KMUT The G.O. stated that eligible female family members of women receiving monthly pensions under four other schemes — the Indira Gandhi National Widow Pension Scheme, Destitute Widow Pension Scheme, Destitute/Deserted Wives Pension Scheme and the Pension Scheme for Unmarried Poor Incapacitated Women Aged 50 and Above — will also be allowed to apply for the KMUT scheme. 'Only after receiving the applications will we know how many female family members of beneficiaries under the four social security schemes will benefit from these relaxations. The beneficiaries themselves are not eligible to apply for KMUT,' said an official from the revenue department.

T.N. set to begin land acquisition process for Parandur airport project
The Tamil Nadu government is all set to begin the land acquisition process for the city's second airport at Parandur. The State issued a Government Order (G.O.) on June 25, giving a direction to begin land acquisition under the Tamil Nadu Acquisition of Land for Industrial Purposes Act, 1997. Several villages, including Parandur, Valathur, Ciruvallur, Gunakarapakkam, Akkamapuram, Magadevi Mangalam, Eganapuram, Podavur, Nelvoy, Thandalam and Thodur, will be affected by this project. According to the G.O., based on the proposal of the Commissioner of Land Administration, the government has fixed a flat rate of ₹35 lakh to ₹60 lakh per acre, inclusive of all components for 1,960.63 acres of lands whose guideline value range from ₹5 lakh to ₹17 lakh per acre in Kancheepuram and Sriperumbudur taluks. The Kancheepuram Collector can also fix compensation through private negotiation for 374.53 acres of land (in Akkamapuram, Nelvoy and Thandalam) whose guideline value ranges from ₹5 lakh to ₹17 lakh per acre. In villages including Parandur, Maduramangalam, Singilipadi, Gunakarapakkam, Edayarpakkam, Akkamapuram, Magadevi Mangalam, Eganapuram, and Koothirambakkam, which measure 996.09 acres of land in total, as the guideline value is over ₹17 lakh per acre, the owners will also get compensation based on private negotiation. In some locations, the compensation through private negotiations could be as much as ₹60 lakh to even ₹2.57 crore per acre. In cases wherein the land owners are unwilling to accept the compensation rates, the government has directed the officers to pursue the land acquisition process by adhering to statutory steps under the Tamil Nadu Acquisition of Land for Industrial Purposes Act, 1997, and determine the compensation accordingly. In 2023, the State government issued administrative sanction for acquisition of 1,527.32 hectares of patta lands, and alienation of 798.12 hectares of government lands in Sriperumbudur and Kancheepuram taluks for this project.
