Public ownership of water in England and Wales is best way to improve industry, people's commission finds

Public ownership of the water industry in England and Wales is the best way to cut bills, improve pollution and invest in repairing infrastructure, according to a wide-ranging people's commission into the industry.
Set up by four academics with expertise in economics, water governance and the law to 'fill the gaps' of the government-appointed Cunliffe commission, the inquiry will on Monday present its findings to MPs.
Ewen McGaughey, a professor of law at King's College London who is one of the academics involved, said: 'We all want clean water, and in the latest YouGov poll 82% of the British public said that we should bring our water into public ownership.
'Our recommendations are that the British public is right, the evidence supports them, and we should move to a new modern, public water system because this is the best way to cut bills, stop pollution, invest in repairs and give everyone a voice. We can have clean water, or privatised water, but we can't have both.'
The Cunliffe inquiry into the water sector is due to report this month, but it was prevented from considering public ownership by the remit imposed by ministers. Its interim report was criticised last month for failing to recommend clear actions to end the crisis in the water industry.
McGaughey believes ministers could bring water companies into public ownership for minimal cost through the special administration process, which is built into the 1991 Water Industry Act. It can be triggered if a company cannot pay its debts or is not performing its statutory requirements, which include treating wastewater rather than dumping it into the environment.
Shareholders and creditors such as bondholders would be given 'appropriate value' for their stakes, which McGaughey argues would, in effect, be nothing.
In its findings, the people's commission report said a shift to public ownership would provide transparency, reduce costs, improve democratic participation, remove the focus on shareholder profit to wholly focus on the public interest and improve cooperation and collaboration between water companies.
Evidence suggests that the top performing utilities internationally – in Sweden, Denmark and Japan – are in public ownership, the report said. It provides evidence that the costs of water company plans for the next five years have been inflated by the privatised companies and that the privatisation model makes capital investment hugely expensive.
McGaughey criticises the figure of £99bn commonly cited as the cost of taking over the industry in England, because it is based on an estimate from a thinktank that was funded by water companies.
When debt levels of water companies are taken into account, the appropriate value of a water company in law can be close to zero. ; Thames Water, for example, is about £20bn in debt.
Once a water is under special administration, rather than transfer it to another private company it could be kept under public ownership.
The commission said public ownership was not the same as nationalisation. Public ownership meant a company that was run to service the public and the environment and had public ownership of water infrastructure but could include some private sector involvement via not-for-profit companies.
The reports authors – McGaughey, Dr Kate Bayliss, an academic who has investigated the opaque structure of the privatised water industry, Prof Becky Malby of Ilkley Clean River Group and Frances Cleaver, a professor of political ecology at Lancaster University, said there was a once in a lifetime chance for major reform of the water industry which must not be missed.
'There is a better future for the water sector in England and Wales, and it is vital that we have the ambition and the courage to reach for it,' the report said.
'Getting there requires political will to unravel the complicated web of interests. Drawing on the evidence we present here and the UK's vast experience in reforming vital services, we show that it is possible to conserve and protect water now and for the future.'

Ms Morgan admitted "we've got a lot of work to do to get voters back" ahead of the May 2026 Senedd (Welsh parliament) elections - something backed up by exclusive polling that reveals Reform is beating Welsh Labour, who have been in power in the Senedd since 1999. A More in Common poll for Sky News found 28% of people in Wales would vote for Reform if an election for the Senedd was called tomorrow. That was followed closely by nationalist party Plaid Cymru on 26%, Labour with 23%, the Conservatives on 10%, Lib Dems with 7%, the Green Party with 4% and 2% for other parties or independent candidates. Of those who voted for Labour at last year's general election, less than half (48%) would vote for them again, while 15% would go to Plaid Cymru and 11% to Reform - although 13% were undecided. A total of 883 people representative of the Welsh population were asked from 18 June to 3 July. Last month, Mr Farage told an event in the steel town of Port Talbot, he would reopen Welsh coal mines to provide fuel for blast furnaces. Ms Morgan said she will not be "chasing Reform down a path... because those aren't my values". "What we'll be doing is offering a very clear alternative, which is about bringing communities together," she said. "I think it's really important that we're authentic and we're clear with people about what we stand for. "I think we've got to lead with our values so we're about bringing communities together not dividing them and I do think that's what reform is interested in is dividing people and people do need to make choices on things like that." She admitted "there is a possibility" Reform could be the largest party in the Senedd "and that is really concerning". However, she said the way voting in Wales works means it would be "difficult for them to rule by themselves". Would she go into coalition with Reform?

In their 106-page legal application, Hamas claimed that proscription was incompatible with the European Convention on Human Rights because it unlawfully restricts freedom of speech and that it was disproportionate as Hamas 'does not pose any threat to Britain or British citizens'. The Home Office is expected to announce its ruling on Hamas's application on July 9. De-proscription is very rare, with only four groups having been taken off the list of banned terror groups since the system was introduced under the Terrorism Act 2000. The Campaign Against Antisemitism warned that a successful application would 'open the way for funding to be channelled through the UK to Hamas' and said that 'it is particularly perverse and revolting that they are invoking human rights in order to do so'. The King will refer to the "complex threats" facing the UK and France - stressing "these challenges know no borders" - as he delivers a speech to welcome President Emmanuel Macron to his first state visit. It's understood that the monarch will be referring to issues around defence, artificial intelligence and the climate crisis when he speaks during tonight's glittering state banquet in Windsor. But with political discussions in the run up to this dominated by the issue of immigration and small boats crossing from France, the King's use of the word "borders" will be seen by some as particularly interesting. King Charles will say: "Our two countries face a multitude of complex threats, emanating from multiple directions. As friends and as allies, we face them together. "These challenges know no borders: no fortress can protect us against them this time." Emphasising how the UK and France can lead the way in confronting them, he will add: "Our two nations share not only values, but also the tireless determination to act on them in the world." King Charles and the Queen are set to welcome the French leader and his wife Brigitte to Windsor Castle. It is the first state visit to take place in Windsor in more than 10 years, and marks the first state visit to the UK by an EU leader since Brexit. With the closeness between the two men, and the huge interest in the royals generally in France, journalist Maud Garmy from Pont de Vue magazine told us this trip will certainly attract more attention than your average political visit. "I have to admit, for French media, one of the main things about this visit is going to be the images from Windsor - because of the glamour, because of the pomp, because of the pageantry," she said. "There will be more images on French television about President Macron meeting the King in Windsor rather than him being in London for speeches with the prime minister because those images are much more glamorous, there will be a strong friendship shown, and for the media that's just pure gold." It will be the welcome from their royal hosts that will make the visit particularly special for the president and his wife Brigitte. The Prince and Princess of Wales will travel to RAF Northolt to meet the Macrons before travelling with them to Windsor, where the King and Queen will be waiting to accompany them on a carriage procession to Windsor Castle. The King and Queen paid a state visit to France in September 2023 and enjoy a warm rapport with the Macrons, who will stay in the castle during their trip.
