PETALING JAYA : The Malaysian Bar has voiced concern over the legal framework and safeguards surrounding the mobile phone data programme, warning that the directive issued to network operators to hand over metadata to the government may raise questions about consent, accountability and oversight.
In a statement yesterday, Malaysian Bar president Mohamad Ezri Abdul Wahab said the Bar acknowledged the federal government's efforts to improve transparency in the programme and noted the ongoing legislative reforms aimed at strengthening data protection.
However, he stressed that the measures are insufficient to address the growing public unease over the scope and nature of data being collected by the Malaysian Communications and Multimedia Commission (MCMC) and Statistics Department.
'The concerns are whether such collection, in the absence of opt-out options or prior public consultation, is consistent with democratic and constitutional principles.'
The programme, approved by the Cabinet in April 2023 as part of Projek Data Raya Nasional, directs mobile network operators to disclose phone data, including mobile call records from the first quarter of 2025.
The Bar said the directive, issued in April this year, may have also included a warning that non-compliance could result in penalties under the Communications and Multimedia Act (CMA), including a fine of up to RM20,000 or imprisonment.
Meanwhile, the MCMC has insisted that data collected is anonymised and aggregated, but the Bar argues that it falls outside the scope of the Personal Data Protection Act.
'Anonymisation is not infallible. In the absence of a clear opt-out mechanism, and with the possibility of auxiliary data being available,
re-identification risks cannot be dismissed.'
The Bar acknowledged MCMC's explanation that data collection is legal under Section 73 of the CMA, and supported by sections of the Data Sharing Act 2025. However, the Bar argued that legality does not automatically equate to legitimacy in the eyes of the public.
The concerns are compounded by recent history. The Bar cited
high-profile cases in the last three years that had shaken public confidence in the government's ability to protect personal data
'In 2022, it was alleged that personal data from the National Registration Department, which belongs to 22.5 million Malaysians, were extracted and sold online.
'In 2024, another leak reportedly involved 17 million MyKad records being circulated on the dark web, and more recently, cyberattacks targeting Socso and Prasarana Malaysia Berhad allegedly exposed sensitive internal information.
'The pattern of repeated leaks, perceived opaque investigations and the absence of visible enforcement has entrenched public distrust. The programme, launched without prior public consultation, only deepens those fears.'
The Bar stated recommendations to address such trust deficit, one of them being to seek full disclosure and transparency of data-sharing to the public.
'MCMC and the network operators should publicly disclose the specific standards, methodologies and safeguards applied to ensure effective anonymisation and aggregation of mobile phone data.'

KOTA BARU: A former bus ticketing clerk pleaded not guilty in the Sessions Court here to 10 charges of criminal breach of trust (CBT) involving ticket sales of RM114,630.80 at the Lembah Sireh Bus Terminal a decade ago. Bibi Kasiran Mohamad, 50, entered the plea on Sunday (June 29) after the charges were read before Judge Zulkifli Abllah. She is accused of allegedly failing to remit ticket sales proceeds ranging from RM7,000 to over RM18,000 per transaction to a bus company, between January and October 2015. The single mother, who was working at a ticketing counter at the terminal, was charged under Section 408 of the Penal Code, which provides for a prison term of between one and 14 years, with caning, and a fine, upon conviction. Deputy public prosecutor Ahmad Faiz Fitri Mohamad appeared for the prosecution, while counsel Muhammad Khairul Azwan Azhan represented the accused. Earlier, Ahmad Faiz Fitri informed the court that while the prosecution was not offering bail due to the 10 charges against the accused, it proposed RM5,000 per charge if bail were to be considered. However, Muhammad Khairul Azwan pleaded for a lower sum, citing his client's age, the death of her husband in August last year, and her responsibility in caring for her ailing elderly parents. He added that she also suffers from age-related illnesses and a heart condition. "My client works at a kuih stall with a daily income of RM45. This is also her first offence. Therefore, I respectfully request the court to impose a reduced bail amount of RM15,000 for all charges combined," he submitted. The court subsequently allowed bail at RM18,000 for all the charges, with one surety, and fixed Aug 28 for case mention and submission of documents. -Bernama

ALOR SETAR: A 57-year-old engineer lost RM275,000 after falling for an online investment scam known as 'Moomoo', which was advertised on Facebook in April. Kedah Commercial Crime Investigation Department chief Supt Loi Yew Lik said the victim responded to an investment offer involving Chinese currency on April 20 by clicking a WhatsApp link, which led him to a group called '6 Investment Securuties Internasional'. He later communicated with several individuals using the numbers 019-2007253 and 019-2345678. "The scammers promised a 10% return within days, prompting the victim to transfer RM275,000 in eight transactions between May 27 and June 13 to two company accounts under the names Cisi Infra Solution and Cisi CPT Infra Trading," he said in a statement on Sunday (June 29). When no profits were received, the victim grew suspicious as the scammers continued requesting more money, claiming it was needed to release his returns and initial capital. He eventually lodged a police report at the Baling District Police Headquarters on Saturday after realising he had been cheated. Loi advised the public to verify any investment offers with the police or nearby stations and to use tools such as the Mule Check app, the CCID Facebook page, or contact the National Scam Response Centre at 997. - Bernama

KUALA LUMPUR: The explanation given by Universiti Malaya (UM) Vice-Chancellor Prof Datuk Seri Dr Noor Azuan Abu Osman about the Satu (Open Channel) route for MBBS admissions is inadequate, says Datuk Seri Dr Wee Ka Siong. 'The Vice-Chancellor's response completely sidesteps the key issue — how financial ability seems to override merit in the MBBS admissions under Satu. 'Instead of answering questions, he has raised even more troubling ones,' said the MCA president on Facebook on Sunday (June 29). Dr Wee's criticism follows the VC's June 27 statement dismissing MCA's concerns as 'misleading'. Dr Noor Azuan had said the dual channel approach was a strategic response for growing demand for limited placements in critical programmes such as medicine, dentistry and pharmacy. On the recent fee hikes for students under the Satu channel, he said the adjustments were necessary to reflect the actual cost of providing high-quality medical education, particularly clinical training, and the maintenance of teaching hospital facilities. According to Dr Wee, the university failed to provide any data or evidence to refute MCA's claims, particularly on whether academically qualified students are being turned away under the UPU (centralised) route and then offered MBBS seats through Satu — if they can afford the RM300,000 fee. 'How many academically qualified STPM students were denied under UPU but later admitted via Satu simply because they could pay? He said at end it only benefits those with deep pockets. "This is the crux of the matter and it remains unanswered,' he said. He then called on UM to publicly disclose the number of STPM students accepted into the MBBS programme via UPU and Satu since 2018 and whether the academic entry requirements are truly the same for both routes. Dr Wee also said that UM must also disclose the number of students rejected under UPU who later received Satu offers. Citing one specific case, Dr Wee revealed that a top student with excellent academic results was denied admission under UPU despite appeals but later offered the same MBBS seat via Satu — provided he could pay RM300,000. "This is something out of reach for B40 and M40 families. 'This is not an isolated incident. MCA has evidence of multiple cases. "Such situations show how the system discriminates against students from B40 and M40 families who cannot afford such fees,' said Dr Wee. He further argued that comparing Satu to international models like UCAS in the UK or Australia's university system was misleading. 'Those systems offer financial aid and transparent data. "Malaysia's Satu offers none of these protections. It's just pay — or be excluded. 'MCA never objected to having two admission pathways but we strongly oppose the structural discrimination that effectively excludes deserving students simply because they cannot pay RM300,000. "That's not meritocracy but more of financial means which becomes the deciding factor,' he said. Dr Wee reiterated MCA's call for the 2025/2026 MBBS intake through Satu to be suspended immediately and urged the government to set up a Royal Commission of Inquiry (RCI) to conduct a thorough and transparent review of public university admission systems. 'In short, the Vice-Chancellor failed to counter MCA's core argument and only proved why this issue demands public scrutiny,' he said.
