
Restaurant owners move Bombay HC against police raids despite earlier court order allowing ‘herbal hookah'
The petitioners claimed that such actions were being taken despite the HC verdict of August 2019 which permitted restaurants to serve herbal hookah and the same was complied with by the owners.
A bench of Justices Shree Chandrashekhar and Manjusha Deshpande was hearing a plea by 12 restaurant owners argued through advocates Rajendra Rathod and Dhruv Jain.
The petitioners include owners/operators of Ustaadi at Crawford Market, The Nest in Bandra, Rustico in Fort, Faham restaurant in Kala Ghoda among others.
The high court granted time to state government lawyer to take instructions to respond to the plea and granted liberty to the petitioners to amend the petition with additional information.
The actions were allegedly being taken based on June 6, 2025 circular of the home department to police which stipulated that if illegal hookah parlours are found at any location, the responsible police officers must be held accountable and strict action should be taken against them.
'These acts of illegally and unlawfully shutting down the service of herbal hookah at the petitioners' restaurants and threatening to shut down the petitioners' restaurants completely, are not only causing huge monetary losses to the petitioners but also directly affecting the earning capacity and livelihood of their employees,' the plea stated.
The petitioners sought direction from the court to the respondent police authorities not to enter their restaurants for any purpose including search without following due procedure under the Cigarettes and Other Tobacco Products Act, 2003 and Bhartiya Nagarik Suraksha Sanhita (BNSS).
The petitioners also sought direction to the authorities to comply with the August 2019 order of the HC enabling them to serve herbal hookah and to stop 'illegal and unlawful raids' and threats to the petitioners' restaurants. The plea also sought no coercive action against petitioners for serving herbal or tobacco-free hookah at their establishments.
The petitioners also sought direction to authorities that the June 6 circular would not be applicable to them as they are serving herbal/tobacco-free hookah. The HC is likely to hear the plea next on August 6.

Rape accused engineer moves Supreme Court over Rajasthan HC's ‘erroneous' travel order
A software engineer, accused of raping a woman on a false pretext of marriage, has moved the Supreme Court challenging an order of the Rajasthan High Court which directed his wife to be present in the country if he wished to travel abroad for a job. The plea, filed by advocate Ashwani Dubey, called the HC order erroneous and a violation of Article 21.(HT_PRINT) The petitioner in his plea said the high court, in a clear violation of the "procedural impropriety" and without hearing or impleading his wife, who is currently employed in the US, and ignoring that she is not a part of the criminal case, directed her to remain in India. The petition, filed through advocate Ashwani Dubey, submitted that the said impugned direction passed by the high court was "erroneous" and violative of the fundamental rights under Article 21 of the Constitution. The matter is listed for hearing on August 8. The counsel argued that the direction suffered from procedural irregularity and legal perversity, having been passed without affording a hearing to the person affected. "He will be going for a specific period and he undertakes a specific oath before this Court that he shall make himself available for trial as and when directed, therefore, there is no question of delay in trial and also there is no question of his absconding," the plea said. The engineer was booked for rape at the Christianganj Police Station of Ajmer. Accused and the woman met online According to the petition, the accused and the woman met on an online matrimonial site and had a close acquaintance for a period of approximately four years. It was alleged that the man entered into an intimate relationship with the complainant, promising her that he would marry her. Under apprehension of arrest, the engineer moved an anticipatory bail application, which was allowed. He then moved an application before the trial court to allow him to go abroad to the USA for employment. The trial court dismissed the application, which was assailed before the high court, which allowed him to go abroad but imposed a condition that his wife must remain in India.

Importance of invoking Section 15-A of SC/ST Act highlighted
Director of Prosecution, B. Ramakoteswara Rao, reviewed the progress of cases under the SC/ST (Prevention of Atrocities) Act pending in special courts from January to June 2025, in a meeting here on Saturday. Addressing joint directors of prosecution, Special Public Prosecutors (SPP) and officials of the Police and Social Welfare departments, Mr. Ramakoteswara Rao said a comprehensive understanding of the SC/ST (Prevention of Atrocities) Act, including its amendments, the Witness Protection Scheme, 2018, and the new Bharatiya Nagarik Suraksha Sanhita (BNSS) 2023 were essential to achieve the best outcomes. He highlighted the importance of invoking Section 15-A of the SC/ST Act and implementing victim protection measures to prevent witnesses from turning hostile. He also stressed on the mandatory use of video recording of witness statements during investigation and trial stages in order to improve the credibility of evidence and reduce the probe errors. Mr. Rao also spoke about filing appeals in cases of acquittal or inadequate sentencing, and the larger goal of delivering justice to the victims, among other aspects.

KP appoints legal coordination officers
Kolkata: Police commissioner Manoj Verma instructed all divisional deputy commissioners to ensure appointment of an SI with sound legal knowledge as the legal coordination officer at every police station within its jurisdiction. This decision followed a couple of inept handling of cases that drew criticism from the high court and led to Lalbazar carrying out an internal investigation of the acts of the IOs concerned. The directive came immediately after an investigating officer filed a charge sheet in a lower court, allegedly disregarding an HC dismissal of the same case registered at a south Kolkata PS. Under the new order, each PS must designate a sub-inspector as a legal coordination officer to prevent such procedural lapses. These officers will work closely with public prosecutors and ensure investigating officers' attendance at court proceedings.
