It is time to release prisoners trapped by inhuman endless jail terms

The Imprisonment for Public Protection (IPP) sentence, introduced in 2005 under the Labour government, was intended to protect the public from serious offenders deemed too dangerous for a fixed-term release. But nearly two decades on, this law stands as one of the most egregious stains on Britain's criminal justice system.
Abolished in 2012 for its inherent flaws, it nonetheless continues to trap thousands of people in a cruel legal limbo, as a debate in the House of Lords today will no doubt highlight.
It is long past time that every person still serving an IPP sentence be resentenced. The continued use of this now-defunct punishment is both unjust and, arguably, inhumane.
At its core, the IPP sentence allowed judges to hand out indeterminate prison terms for offences that did not justify life imprisonment but were deemed serious enough to warrant extended supervision. Offenders were given a 'tariff' – the minimum time they must serve before being considered for release. Many of these tariffs were shockingly short, some as low as two years. Yet thousands remain in prison long after these tariffs have expired.
Why? Because release is dependent not on time served, but on proving to the Parole Board that they are no longer a danger to the public – a nebulous, subjective, and often unreachable standard.
This flips the basic presumption of justice on its head. In a fair system, the state must prove guilt beyond reasonable doubt to imprison a person. Under IPP, once the tariff is served, the burden of proof shifts unfairly to the prisoner. It is no longer the state's job to justify incarceration; it is the prisoner's burden to earn freedom. This is particularly problematic when access to rehabilitative programmes, often required for parole, is limited or unavailable – especially in overcrowded prisons. The system sets people up to fail and then blames them for not succeeding.
Moreover, the psychological toll of such indefinite punishment is catastrophic. Suicide and self-harm rates among IPP prisoners are significantly higher than average. Many live in a state of constant uncertainty and despair, unsure if they will ever be released, even decades after their offence. It is not unusual to find individuals still imprisoned for minor crimes – such as theft or assault – that would today warrant only a few years behind bars, yet they languish without a release date. The punishment no longer fits the crime, if it ever did.
The injustice of the IPP system has been widely recognised. The House of Commons justice committee labelled it "irredeemably flawed" and called for all remaining IPP prisoners to be resentenced. The European Court of Human Rights has also condemned aspects of the sentence as incompatible with human rights obligations.
Yet the government has so far refused to act decisively, citing public safety and political sensitivity. This is a failure of courage and leadership. Protecting public safety does not require trampling basic rights or holding people indefinitely for crimes long past. Dangerous individuals can be managed through proper risk assessment and robust parole conditions – not through perpetual punishment without end.
Resentencing every IPP prisoner is not only fair, it is necessary. It would give judges the opportunity to reconsider the nature and severity of each offence and impose a proportionate, fixed sentence with clear guidance for release. For many, this would mean immediate or imminent freedom; for others, it would offer clarity, rehabilitation goals, and hope – something the current system wholly lacks. Justice demands consistency, proportionality, and transparency. The IPP sentence undermines all three.
Some argue that resentencing might release dangerous individuals back into society. But the risk can be responsibly managed without recourse to indeterminate detention. Modern sentencing tools, community supervision, mental health support, and parole frameworks are all capable of mitigating risk. Perpetual incarceration without due process is not a solution – it is a violation.
Britain prides itself on the rule of law, but this chapter of penal policy betrays that principle. IPP sentences should not only be consigned to history – they must be actively undone. Every person still caught in this Kafkaesque trap deserves a proper sentence, a path to rehabilitation, and a chance at freedom. Anything less is a continuation of a deep and unforgivable wrong.

Euan Stainbank said strict procurement rules should be reformed to ensure UK manufacturers are given priority when it comes to investing in the public transport of the future. ‌ The Labour MP for Falkirk is campaigning to save jobs in his constituency at two closure-threatened Alexander Dennis (ADL) factories. ‌ Bosses at the firm launched a consultation last month on plans to shutter the plants at Camelon and Larbert and centralise production in Scarborough. The move would end a century of bus building in the Falkirk district and comes just weeks after the oil refinery at nearby Grangemouth was shut down, with 400 jobs lost. Stainbank told the Record: "There's global momentum to decarbonise transport. The UK must lead — not fall behind. A greener bus network should mean jobs and prosperity. But only if we have the right strategy. "In 2020, Boris Johnson promised to deliver 4,000 zero-emission buses, built in Britain. By 2024, only about 2,270 had been delivered through the ZEBRA scheme, with nearly half made abroad — despite £312 million in taxpayer funding. "Scotland has seen worse. In the most recent ScotZEB2 scheme, over 80 per cent of buses were ordered from overseas. Just 44 of 252 orders went to Scottish producers. That's simply unacceptable — 400 skilled jobs in Falkirk are at stake. "We cannot justify using UK public money to support foreign competitors while British factories struggle. A global economy doesn't mean outsourcing opportunity. It means competing with confidence — and with a plan. ‌ "Manchester has shown what leadership looks like. Under Mayor Andy Burnham, the Bee Network brought buses back under public control and procured the fleet domestically, including from Falkirk." The Falkirk MP added: "Ministers have shown they're willing to intervene, from supporting British steel in Scunthorpe to committing £200 million to Grangemouth. Now they must act to safeguard UK bus manufacturing. "For the 400 workers at Alexander Dennis, this isn't an abstract policy debate — it's their future. These are the people who have helped build the UK's low-carbon transport network. ‌ "They deserve more than warm words. We have the skills. We have the capacity. We have the need. Now we need the political will to back British buses — for British passengers, with British workers." Shona Robison, the SNP Finance Secretary, welcomed the announcement last week that ADL had extended its consultation on potential job losses - allowing more time to find an alternative. She said: "The company has been clear there are a number of factors that impact on its decision about the future of its workforce in Scotland - the availability of orders both in the short and long term, changes to the regulatory landscape around procurement, and assistance in supporting a short-term company furlough scheme. "The Scottish Government is continuing to work tirelessly on this issue, and is maintaining close contact with the company, the unions and the UK Government to understand all options to support the workforce."

A Reform-led council says its 'trans-related' library book ban is 'not a change of policy' after conflicting social media posts from councillors. In a post on social media, Kent County Council (KCC) leader Linden Kemkaran said the books were to be removed with immediate effect after a fellow Reform Councillor said he had been informed of 'transgender ideologies' in the children's section of a library. But KCC has since said that the book which triggered the ban was in fact on display at the front of a library in Herne Bay, rather than the children's section. The council's Liberal Democrat opposition leader, Antony Hook has said that Reform not following 'proper process' in the council and announcing things on social media has created uncertainty. Cllr Kemkaran added on X that 'telling children they're in the 'wrong body' is wrong and simply unacceptable' and said that 'trans-related' works would be removed from the children's sections of all 99 of the county's libraries. The book Reform were referring to was The Autistic Trans Guide to Life by Yenn Purkis and Dr Wenn Lawson, which is a book for autistic trans and/or non-binary adults marketed as providing 'tools and strategies they need to live as their best self'. There is no suggestion from the promotional material around the book that it contains any reference to telling children they are in the 'wrong bodies'. In his video posted to social media on Thursday, the Reform Cllr responsible for the ban Paul Webb claimed: 'I was recently contacted by a concerned member of the public who found trans-ideological material and books in the children's section of one of our libraries – I've looked into this, and it was the case, 'I have today issued an instruction for them all to be removed from the children's section of our libraries.' The council has since rowed back on his suggestion that the book was in the children's section and says that they have not, in fact, changed policy. A KCC spokesperson told PA Media: 'We have not changed policy. We have simply issued internal instructions to reaffirm existing expectations: that adult books are not to be placed in areas specifically aimed at children, such as children's sections or public welcome displays where children select books.' It is unclear how the council will classify transgender-related books, and whether there will be a tangible change as a result of this instruction. Cllr Webb, the Cabinet Member for Community & Regulatory Services said: 'We rightly place child protection and safeguarding at the very top of our list of priorities, as should all adults, especially those that hold public office.' Cllr Kemkaran heralded her colleagues' actions as showing 'courage and common sense in Kent' on X. Cllr Hook told the BBC: 'It is bizarre that the leader of the council is making announcements on social media, rather than to the council.' The copy of The Autistic Trans Guide to Life has been moved from a display at the front of the library 'to a section that is unlikely to be visited by children', the KCC spokesperson said.

Britain's most notorious gangster and the detective who pursued him have been involved in a bizarre confrontation…at a charity lunch. Former Detective Superintendent Ian Brown was at a Kent golf club and about to give a talk on the infamous £26m Brink's-Mat gold robbery when he was summoned from the stage by officials. Mr Brown, who appeared on the award-winning Sky News StoryCast podcast The Hunt For The Brink's-Mat Gold in 2019, said: "I go outside and they say 'he's here' and I say 'who's here' and they say that table over there in the corner, that's Kenny Noye with a baseball cap pulled down over his head." Noye stabbed to death an undercover policeman during the Brink's-Mat investigation, but was acquitted of murder, though he was jailed for handling the stolen gold. After his release, he used a knife again in the M25 road-rage murder of motorist Stephen Cameron. "They said what are we going to do?" said Mr Brown. "I said are you serving food? Well, just use plastic knives." Although Mr Brown had not personally arrested Noye over Brink's-Mat he had identified him as a suspect months after the robbery. Years later he met him during an ill-fated TV interview in which he quizzed him about his role in the robbery. He said: "He told me everything I wanted to know except the truth. He still insists he had nothing to do with it." The interview was never broadcast after the prison authorities threatened to send Noye back to jail for a breach of his parole. Mr Brown, 86, said: "I went over to him and said 'thanks for coming, nice of you to pop in', but I don't believe you've turned up with your sons and grandkids to listen to me telling how you killed a police officer. "And he said 'I want to make sure you don't say I've been dealing drugs' and I said 'I've never said that Kenny'." The retired detective told Noye he wasn't going to change his presentation just because he was there. "He said 'mate, I wouldn't expect you to and I'll come up [on stage] if you want me to'. "Can you think how he's turned up with his family to listen to somebody talking about you killing the police? Now, you put logic on that." The bizarre story emerged when I rang Mr Brown after I'd been told about the meeting. I also wanted to ask him about the recent BBC hit drama series The Gold which retold the story of the Brink's-Mat heist at Heathrow Airport in 1983. "It was an absolute shambles, far too much dramatic licence and the real story was so much better," said the ex-detective, whose job had been to follow the trail of the 6,800 gold bars to the US and the Caribbean. He said he chatted to one of the show's writers for a long time in a phone call but then heard no more. "They invented people, changed a bit here and there and made it politically correct in so many ways. I'm just very sad that that is what people will believe. "And I couldn't work out who my character was supposed to be. I could have been one of the female cops." He also criticised the portrayal of Noye, now 78, as a likeable jack-the-lad character when the truth about the double killer with a volatile temper was quite different.
